Federal Judges Have Shown Leniency in Nearly All Jan. 6 Cases

Trump and his allies have repeatedly claimed that the federal judicial system has been unnecessarily punitive in its treatment of January 6 defendants, complaining that they are “political prisoners” who have been unfairly persecuted for trying to prevent the congressional certification of Biden’s 2020 election. One leading January 6 defendant compared himself to a Jew living in Nazi Germany and said that his “only crime is opposing those who are destroying our country.”

The Intercept’s analysis sharply contradicts that right-wing narrative. In many cases, judges have rejected prosecutors’ requests for prison time, often reducing defendants’ sentences to home detention or probation. Defendants have been sentenced to standard prison terms in only 429 out of 719 cases, or 60 percent. Another 31 defendants were sentenced to intermittent incarceration, meaning they only had to serve time on nights or weekends. Home detention was given instead of prison in 101 cases, while defendants in 135 cases got probation.

The Intercept’s analysis is the most comprehensive examination so far of how federal judges appointed by Republican and Democratic presidents ruled in January 6 cases that have reached a final resolution in the U.S. District Court for the District of Columbia, which is handling all the criminal cases stemming from the insurrection. Hundreds more cases are still in progress and will likely be assigned to the same group of judges. A total of 1,233 individuals have so far been charged in connection with the January 6 mob, according to a running tallyOpens in a new tab compiled by the Associated Press.

Lawyers for Peter Schwartz, who threw a chair at police officers and attacked them with pepper spray, told the court that he was only following Trump’s directions. “There remain many grifters out there who remain free to continue propagating the ‘great lie’ that Trump won the election, Donald Trump being the most prominent,” they wrote in an April 2023 court filingOpens in a new tab. “Mr. Schwartz is not one of these individuals; he knows he was wrong.”

Trump and the MAGA right have ignored these statements of remorse and continue to treat the defendants as heroic figures. At a campaign event in Texas in November, the Republican front-runner described incarcerated January 6 offenders as “hostages, not prisoners.” Last June, Trump attended a fundraiser for January 6 defendants, calling them “great people” who have “been made to pay a price.”

J. Michael Luttig, a former judge on the U.S. Court of Appeals for the 4th Circuit, said that the pro-Trump attacks on the judicial process in the January 6 cases are deeply damaging to the nation. “The American people, as well as the courts, must understand that the former president will continue these disgraceful, condemnable attacks on our institutions of law and democracy until he has succeeded in delegitimizing them in the eyes of a sufficient number of Americans that not only will they not accept the justice system’s verdicts against him, but they will return him to The White House in 2024 precisely because of those verdicts.”

Can a President be arrested, indicted, prosecuted, and punished? Although some believe that these possibilities are unconstitutional, even absurd, I demur. For a host of reasons, the presidency lacks immunities from criminal process and punishment. First, some constitutions from the Founding Era included express executive immunities, not relying upon shadowy inferences. This practice sheds light on how to best read our Constitution. Second, though James Madison sought the creation of express presidential privileges at the Philadelphia Convention, he failed. Third, during the ratification fight, many denied that the President would have special immunities of any sort, with some noting that presidents had fewer privileges than members of Congress. Fourth, a sitting President was arrested and essentially admitted his guilt, never asserting that the Constitution shielded him from arrest, prosecution, or punishment. Fifth, the Constitution supplies a constitutional solution when circumstances, including arrest or incarceration, incapacitate a sitting President. The “Acting President”—the Vice President—takes over, ensuring continuity and energy in the Executive. Lastly, the Constitution authorizes Congress to supply a statutory immunity. By ordinary law, Congress can grant immunities that the Constitution itself never accords. Further, it can curb, expand, or eliminate its grant as circumstances warrant. Because Congress can solve any difficulties that might arise from the arrest, prosecution, and punishment of our presidents, there is little need to infer or imagine a constitutional solution.

As he arrived at a federal courthouse in lower Manhattan, Donald Trump’s Truth Social account released an avalanche of prerecorded posts attacking E Jean Carroll, who is suing the former president for defamation.

It’s the second trial stemming from defamation claims brought by Ms Carroll, and a jury already found him civilly responsible for sexually abusing her in the 1990s. He continues to claim that he never met her and has repeatedly mocked and ridiculed Ms Carroll in the wake of that verdict.

While he was seated with his attorneys, without his phone, Mr Trump repeated false claims that are at the centre of the defamation cases against him, including his claim that he has never met Ms Carroll, and called the case an “unAmerican injustice” and that he was “wrongfully accused”.

My step-dad always told me that if I were going to be a thief I'd better go robbing banks instead of knocking over convenience stores, because if you get caught you're toast either way. I guess that was his early lesson on ROI before I ever heard the term ROI.

It doesn't matter if it was one paper or 100 boxes. They both had shit they shouldn't have had, and Biden wasn't even authorized to ever have it "off campus" in the first place when he took it home.

I'm not going to argue about this. This is a non-issue, and it isn't going to go anywhere, just like none of the other court cases against Trump are.

If Democrats want to beat Trump in November, they'd better actually focus on making things better for everyone this year after 3 years of things being awful. And they already should have done it, but they need to replace Biden* ASAP. Almost anybody else they could possibly pick would be a better option than Biden*, and the longer they wait to do it the more it's going to look like they've just completely rigged the game and voting doesn't even matter, even among many Democrat voters, many of which already don't approve of Joe Biden*'s job so far, as is evidenced by his abysmally low approval rating compared to pretty much any President in my lifetime, especially Trump.

If they continue on with their ill-advised plan on making this election about Trump and only about Trump, they're going to lose.

Trump has openly praised authoritarian strongmen including Rodrigo Duterte of the Philippines. Anytime you want to come … Keep up the good work, you are doing an amazing job.” Then, in a November 2017 visit to Manila, Trump boasted of the “great relationship” that he had with Duterte. During the trip, the two men laughed together as Duterte referred to the journalists in the room as “spies”. The hilarious punchline? 192 journalists have been murdered in the Philippines since 1992.

Of course, it’s hard to tell whether Trump simply admires ruthless, brutal despots like Duterte, or whether Trump is just acting in the interests of his own wallet (Trump Tower Manila opened in late 2017). But either way, Duterte now no longer has to worry about the President of the United States breathing down his neck and making diplomatic threats when he slaughters his own people. That shift makes it more likely that Duterte will stay in power longer—and abuse more people in worse ways in the meantime.

As with many countries, Trump’s behavior and praise for despots is at odds with the official position of the United States government and the United States State Department.

Trump’s Former Finance Chief in Negotiations to Plead Guilty to Perjury

Allen H. Weisselberg would admit to lying on the stand during the former president’s civil fraud trial, according to people familiar with the talks.

Allen H. Weisselberg, a longtime lieutenant to Donald J. Trump, is negotiating a deal with Manhattan prosecutors that would require him to plead guilty to perjury, people with knowledge of the matter said.

As part of the potential agreement with the Manhattan district attorney’s office, Mr. Weisselberg would have to admit that he lied on the witness stand in Mr. Trump’s recent civil fraud trial, the people said.

Mr. Weisselberg, the former chief financial officer at Mr. Trump’s family business, also would have to say that he lied under oath during in an interview with the New York attorney general’s office, which brought the civil fraud case.

The situation springs from a web of criminal and civil cases brought by the two agencies and would culminate a lengthy pressure campaign by the district attorney, Alvin L. Bragg, whose prosecutors had sought Mr. Weisselberg’s cooperation as they investigated whether Mr. Trump committed electoral and financial crimes. Even without Mr. Weisselberg’s cooperation, they indicted Mr. Trump last year in the election-related case, which is scheduled for trial in late March.

Nope, I've mentioned and posted about it in two different threads before you posted this. One of the things the judge said is that Trumps defense was nothing more than to deny and keep denying, even though the evidence said otherwise.

He used the term out of touch with reality when describing Trump. And that's what you do moron. Trumps business in NY lost its battle last year in the courts. It was fined and his CFO was jailed. Trump university lost its battle in the courts last year. It was shut down and he was fined millions. Trumps charity was shut down and fined for the same thing.

He lost his battle in the courts in the E jean Carol case and ordered to pay 83 million in total for both trials. He lost this NY fraud case and the judge ordered him to pay 350 million. Further, each of his sons must pay 5 million each, and none can do business in NY for 3 years.

I probably missed a few but hey, there is plenty more where that came from.
