President Donald Trump has been ordered by a New York State judge to pay $2 million to a group of nonprofit organizations as part of a settlement in a civil lawsuit stemming from persistent violations of state charities laws.

The payment is the final resolution to a case brought by the New York attorney general's office after the Trump Foundation held a fundraiser for military veterans during the 2016 campaign.

The televised fundraiser took in nearly $3 million in donations that were dispersed on the eve of the Iowa caucuses as directed by then-campaign chief Corey Lewandowski.

The two million must be paid by President Trump himself for breaching his fiduciary duty to properly oversee the foundation that bears his name.

"I direct Mr. Trump to pay the $2,000,000, which would have gone to the Foundation if it were still in existence, on a pro rata basis to the Approved Recipients," Judge Saliann Scarpulla wrote.

The lawsuit filed by the state's attorney general accused President Trump -- along with his children, Donald Jr., Eric and Ivanka -- of conflating charity with politics, repeatedly using charitable donations for personal, political and business gains, including legal settlements, campaign contributions and even to purchase a portrait of Trump to hang at one of his hotels..

Donald Trump, his oldest sons and his businesses orchestrated a “persistent and repeated fraud” in which they vastly exaggerated the extent of the former president’s wealth to procure favourable loans, a New York judge ruled, in an order that could deal a damaging blow to Trump’s real estate empire.

Judge Arthur Engoron on Tuesday found that the Trump Organization had inflated the value of properties in Manhattan and Florida, as well as golf courses in the US and Scotland, by hundreds of millions of dollars. He also ordered the suspension of licences for Trump’s New York entities.

However the impact of the decision was not immediately clear, leading an attorney for Trump, Christopher Kise, to ask for a clarification during a court hearing on Wednesday on whether assets such as the flagship Trump Tower would have to be sold. Engoron declined to elaborate on the order, saying: “I am not prepared to issue a ruling right now.”

The ruling is the latest development in a case brought by New York attorney-general Letitia James in 2022, which is due to go to trial on Monday. The trial will determine further damages and the matter of whether the defendants were also liable for issuing false financial statements and insurance fraud.

In a statement released on his Truth Social platform, Trump said the ruling was a “terrible reminder that the Radical Left Democrats will stop at nothing” in trying to prevent him from winning office again.

Kise said the court was seeking to “nationalise one of the most successful corporate empires in the United States and seize control of private property all while acknowledging there is zero evidence of any default, breach, late payment or any complaint of harm”.

James wrote on the social media platform X: “We look forward to presenting the rest of our case at trial.” Her office did not provide a further statement and did not respond to requests for comment on the potential suspension of Donald Trump’s business licences in New York.

The long-running lawsuit brought by James’ office alleges Trump and his businesses inflated the value of assets by more than $2bn in total to obtain hundreds of millions of dollars in loans on favourable terms.

The attorney-general is seeking to recover $250mn in damages and attempting to bar the defendants from ever acting as an officer or director of a corporation in the state again.

The ruling deals a significant setback to the eponymous business empire that made Trump a household name and adds to the mountain of legal woes he faces while vying to again become the Republican nominee for president next year. The 77-year-old has been charged in four separate criminal indictments over matters including the retention of classified documents and attempting to subvert the result of the 2020 election. He has pleaded not guilty to all charges.

In his decision, Engoron agreed with the New York attorney-general’s office that assets including a Park Avenue skyscraper and a property on Wall Street were unlawfully inflated, and further ordered that several of Trump’s New York businesses be dissolved, accusing them of continuing to “disseminate false and misleading information” even after a monitor was appointed by the court last November.

Lawyers for the Trumps, including Kise, a former solicitor-general of Florida, were also fined $7,500 each by the court for repeatedly making “frivolous” arguments.

The judge also dismissed arguments by the Trump lawyers that the banks in question, including Deutsche Bank, were not defrauded as the loans were ultimately repaid in full.

Trump himself echoed this on social media, saying no harm had been done to the “sophisticated Wall Street banks” from whom he borrowed money. But Engoron said “the first principle of loan accounting is that as risk rises, so do interest rates”, and the lenders could have made “even more money” had the true value of Trump’s collateral been stated.

In his ruling the judge accused Trump’s lawyers of living in a “fantasy world” in which “square footage [is] subjective”. He ruled that Trump had overvalued his Trump Tower apartment by up to $207mn, falsely stating in annual financial records that it was almost three times its actual size, and — in one year — exaggerated the value of apartments in Park Avenue by 700 per cent.

“Good faith measurements could vary by as much as 10-20 per cent, not 200 per cent,” Engoron wrote, adding that Trump’s lawyers were asking the court not to “believe its own eyes”.

A discrepancy “of this size, by a real estate developer sizing up his own living space of decades, can only be considered fraud”, he wrote.

Engoron further found that Trump’s Mar-a-Lago resort had been inflated by at least 2,300 per cent compared with an appraiser’s assessment.

Actually, it's Trumps' businesses.

Poor Jack, again he is wrong. Trump is getting killed in the courts, and today he loses control of all his businesses. Just as I predicted. The judge found him guilty of being a persistent fraudster. Just as a different judge found him to be a rapist.

Trump is hanging up a going out of business sale. His assets have been handed over to an arbiter. A person who settles a dispute or has ultimate authority in a matter: There is also the fine. 250 million was asked for. It could be higher.

Alina Habba Denies Donald Trump's Lack of Jury Is Her Fault

Donald Trump's lawyer, Alina Habba, has denied suggestions that the former president is not getting a jury trial in his New York $250 million fraud civil case because his legal team did not request one in legal filings.

On the first day of proceedings, Judge Arthur Engoron told the Manhattan courtroom that "nobody asked for" a jury trial, and that is why the outcome of the lawsuit filed by New York Attorney General Letitia James will be decided by the judge in a bench trial.

Legal experts said that all Trump's legal team had to do to request a jury trial was to tick a box in court filings, with some suggesting that Habba herself failed to do so. In late July, James' office filed papers to request a trial without jury, which is common for civil cases, with Trump's legal team apparently not opposing the request.

Speaking to Newsmax on Monday, Habba denied that the reason Trump has not got a jury trial in the fraud case is because his legal team "had this great option to have a box checked" which they did not take, describing the suggestions as a "misconception."

Habba argued that the case was filed under New York Executive Law 63(12), which she described as a "very narrow, not appropriately used section of the law" for consumer protection where a jury are generally not required.

"It's not this, and that is why we're sitting here in front of a judge dealing with values of property, where real estate, anybody with real estate brains, anybody with real estate experience, even laymen, can understand that a tax assessment is not the same as the market value of your property, period," Habba added.

A similar argument was made by a Trump spokesperson in a statement. "The Attorney General filed this case under a consumer protection statute that denies the right to a jury," the spokesperson told Newsweek. "It is unfortunate that a jury won't be able to hear how absurd the merits of this case are and conclude no wrongdoing ever happened."

Former Deputy Assistant Attorney General Harry Litman was one of those who suggested Trump's legal team are to blame for there not being a jury to decide his fate in New York.

"It's incredibly easy to ask for a jury trial. You just check a box on a form," Litman posted on X, formerly Twitter. "Hard to believe that Trump understood that his lawyers hadn't done it when he's been savaging the judge who is now the factfinder in his huge fraud trial."

Katie Phang, a lawyer and MSNBC legal analyst, added: "So Alina Habba didn't demand a jury trial?! I wonder how Trump feels about this screw-up by his legal team."

California Democratic Representative Ted Lieu suggested Trump and his team may have purposely opted to not have a jury trial so the former president "can keep falsely blaming the judge for the outcome."

However, lawyer Andrew Fleischman dismissed the suggestions that not having a jury trial is a tactic from Trump's team.

"I honestly can't believe that any lawyer hired on such an important case could make this mistake. But I also can't think of any strategic reason you'd want a bench trial in front of a judge who just sanctioned your lawyers for making frivolous arguments," Fleischman posted on X.

Engoron already ruled on September 26 that Trump committed fraud while inflating the value of several of his properties and assets for years while filing financial statements, the main crux of James' $250 million lawsuit against the former president, his sons Eric and Donald Trump Jr., and The Trump Organization.

The ruling means that the civil trial will now look at other allegations from James' lawsuit related to falsification of business records, issuing false financial statements, insurance fraud and conspiracy, as well as the size of the penalty which will be decided by Engoron — a judge Trump has frequently attacked on social media as "deranged."

Speaking outside the New York courtroom on Monday, Trump, the frontrunner in the 2024 GOP presidential primary, continued his attacks on Engoron and the case.

"This is a judge that should be disbarred. This is a judge that should be out of office. This is a judge that some people say could be charged criminally for what he's doing. He's interfering with an election, and it's a disgrace," Trump said.
