Doctors left a premature baby to die because he was born two days too early, his devastated mother claimed yesterday.

Sarah Capewell begged them to save her tiny son, who was born just 21 weeks and five days into her pregnancy - almost four months early.

They ignored her pleas and allegedly told her they were following national guidelines that babies born before 22 weeks should not be given medical treatment.

Miss Capewell, 23, said doctors refused to even see her son Jayden, who lived for almost two hours without any medical support.

She said he was breathing unaided, had a strong heartbeat and was even moving his arms and legs, but medics refused to admit him to a special care baby unit.

Miss Capewell is now fighting for a review of the medical guidelines.

Medics allegedly told her that they would have tried to save the baby if he had been born two days later, at 22 weeks.
In fact, the medical guidelines for Health Service hospitals state that babies should not be given intensive care if they are born at less than 23 weeks.

The guidance, drawn up by the Nuffield Council, is not compulsory but advises doctors that medical intervention for very premature children is not in the best interests of the baby, and is not 'standard practice'.

James Paget Hospital in Norfolk refused to comment on the case but said it was not responsible for setting the guidelines relating to premature births.

A trust spokesman said: 'Like other acute hospitals, we follow national guidance from the British Association of Perinatal Medicine regarding premature births.'

Miss Capewell, who has had five miscarriages, said the guidelines had robbed her son of a chance of life.

She said: 'When he was born, he put out his arms and legs and pushed himself over.

A midwife said he was breathing and had a strong heartbeat, and described him as a "little fighter".

I kept asking for the doctors but the midwife said, "They won't come and help, sweetie. Make the best of the time you have with him".'

She cuddled her child and took precious photos of him, but he died in her arms less than two hours after his birth.
Miss Capewell, who has a five-year-old daughter Jodie, went into labour in October last year at 21 weeks and four days after suffering problems during her pregnancy.

She said she was told that because she had not reached 22 weeks, she was not allowed injections to try to stop the labour, or a steroid injection to help to strengthen her baby's lungs.

Instead, doctors told her to treat the labour as a miscarriage, not a birth, and to expect her baby to be born with serious deformities or even to be still-born.

She told how she begged one paediatrician, 'You have got to help', only for the man to respond: 'No we don't.'

As her contractions continued, a chaplain arrived at her bedside to discuss bereavement and planning a funeral, she claims.

She said: 'I was sitting there, reading this leaflet about planning a funeral and thinking, this is my baby, he isn't even born yet, let alone dead.'

After his death she even had to argue with hospital officials for her right to receive birth and death certificates, which meant she could give her son a proper funeral.

She was shocked to discover that another child, born in the U.S. at 21 weeks and six days into her mother's pregnancy, had survived.

Amillia Taylor was born in Florida in 2006 and celebrated her second birthday last October. She is the youngest premature baby to survive.

Miss Capewell said: 'I could not believe that one little girl, Amillia Taylor, is perfectly healthy after being born in Florida in 2006 at 21 weeks and six days.

'Thousands of women have experienced this. The doctors say the babies won't survive but how do they know if they are not giving them a chance?'

Miss Capewell has won the support of Labour MP Tony Wright, who has backed her call for a review of the medical guidelines. He said: 'When a woman wants to give the best chance to her baby, they should surely be afforded that opportunity.'

It's always sad when something goes wrong during a pregnancy. Often (but, let me caveat that and say not always) there are many hopes a dreams associated with a pregnancy. And usually you expect problems to occur during the first trimester, so after that time passes you feel safe. But this fetus was only 5 months along. That is far before the age when one expects it to survive, let along thrive.

Very small babies have fragile lungs, underdeveloped intestines, and invariably suffer from brain bleeds. Their course is stormy and unpredictable, and nearly always results in death, or severe disability and a lifetime of suffering.

I'm surprised that the guidelines are as generous as they are, and allow for intensive care for fetuses born before 6 months.

But, I suppose this woman has a lot of emotional baggage about having children, and no amount of reason will work with her.

BTW, I worked with a woman who's fetus was severely deformed - it was a genetic disorder that they found out about early in the pregnancy. She carried the baby to term so that she could 'say goodbye' - knowing that it's short life would be one of futile struggle to breathe, ending in death.

I didn't understand that either. In fact, my thoughts about her was that she was a selfish, heartless bitch.

All babies born that early have life long health issues. Most have lungs that never grow properly. It is easy to sensationalize something like this, but it is a lot harder to look at the fact this baby would have a life most likely hooked to machines - a life of continuous pain and suffering, kept in check only by strong pain medications. Below 24 weeks a baby has 99% chance of dying or surviving with a disability. That's 24 weeks. A baby at 22 weeks is substantially less developed.

What trips me out about these debates is that lack of the focus on the greater good. The $100k that one 23 week baby would require in medical attention in that 1 year could keep hundreds of kids from dying of malnutrition.

So, as a society do you focus on the needs of the many? Do they outweigh the needs of the few or the one?

Is bringing a 21 week old into a life of virtually guaranteed suffering more valuable than to prevent the suffering death of hundreds of children already born?

Tough questions.

All I know is I've been waiting 12 years for a medical appointment with the Veterans Administration. VA stole my wife's VA disability pension for inability to have children after US Army doctors butchered her in "medical school experiments". Social Security Administration refused to pay me disability pension for 12 years then stole at least 75% of it, and my govt TennCare medical insurance was cancelled while I was sick. When I did see doctors they censored cheap natural cures, while demanding $600 an hour to testify as an expert witness in my disability trial. Pentagon threw away all vaccine records of Gulf War #1 vets, when the feds bombed their OKC fed building.

That having been said, when a royally f*cked patient rolls into the emergency room, it's my understanding that no matter how horrifically mangled and hopeless he is, they at least put on a show of an attempt to save him.

I'm surprised that if the mother wanted the attempt made, that they wouldn't even go through the motions. It's essentially like refusing treatment, which feels wrong.

Explain the problem to the mother, if she wants to authorize treatment, even knowing the dim prospects, then do your thing. As things sit now, this is going to be an emotional trauma for the rest of her life, because she'll always think of it as 'they let my baby die, and I had to watch.'

For the mental health benefits alone, attempted intervention would have been worthwhile.

Thanks, but I no longer trust a VA doctor with a needle, scalpel or dope. The only VA doc in Tennessee that does (private) radiation testing is from Pakistan, and he only works part-time 400 miles from here.

I would, however, like to get my wife's VA disability bumped up from $80/month. VA is stealing her disability to "repay her retirement pension". Seems the military is the only govt job in USA that does that (Top Secret).

I kind of agree with this.

For the baby's sake alone, it was probably preferable to let him spend his two hours in the world being cradled in his mother's arms with the least amount of stress, but if she was literally begging them to do something and they just flat said no without even looking at the child (if this is, indeed, what happened), without even checking him over and telling her with certainty what would happen or not happen if they kept on intervening... really, really cold and damaging to the woman. It IS a bit much to ask a woman in the process of losing her child to act with all the rationality and detachement of an unaffected person.

This seems less like a case of Evil Guidelines and more like a case where the lack of compassionate communication vastly amplified an already awful situation.

Ayup, and I have a damned low opinion of that whole concept having *been* on the receiving end by medical personnel who were just "going through the motions" (and halfassing it besides!) cause they were so flamin sure I was gonna die anyway, despite a conscious, angry patient was had his own damn well justified opinions on the matter, thank you!

And later, the endless sandbagging and stonewalling to prevent "wasting" resources on the doomed, till it finally became clear THREE YEARS LATER that ole "CTD BUNDY"* here was just plain unkillable.

Thankfully a couple doctors had broken with managements opinion even before that and were sneakin me supplies on the sly, but mostly everyone played along.

I can only imagine how much better my failing health would be if not for that extended period of neglect after they just barely stabilized me and then booted my ass out the door, all the while sincerely hoping I'd just roll over and die before wasting too much of their time and resources.

And mind you, this was in part helped along by my employers health insurance companies, as the old one dropped me like a hot rock and the new one refused to pick me up - and the drivers insurance company (that being Allstate ) who not only refused to pay up, but did so in a blatantly illegal fashion, which they got away with cause marylands insurance commissioner was in their pocket neat as you please, of COURSE.

So don't never, EVER talk to me about insurance being anything but a fucking extortive protection racket, since I have never, ever, ever, NOT BLOODY ONCE, ever had an "insurance" company uphold their end of the deal, not when my mother passed away and the mortgage insurance company dodged out of it, not when the accident happened and my payment takeover insurance on my vehicle loan bailed out, not when both medical insurance companies bailed out, or any other time in my entire life EVER, ok ?

It's just legalized theft in my opinion, especially auto insurance, since I am forced to pay it, and then I have to hold out more money in case I actually have an accident since I KNOW they will not pay (and too bad for the other guy too, given what Allstate pulled on me, yes ?).

So to HELL if I wanna see that model applied to health insurance, ain't no way.

And here I am trying to patch and paste with fucking drugstore supplies something that SHOULD be dealt with surgically, but of course despite all the money they leeched outta my the supposed healthcare provider we got stuck with now has a disconnected number and no way to contact them.
(but sure as shit they still cash the checks, don't they!)
And I know exactly how this is gonna wind up, same way it ALWAYS fucking winds up, me cornering some poor asshole and making him more afraid of ME than of not getting a bonus for shutting down claims.
(let's NOT pretend they don't do this)

Look folks, it shouldn't HAVE to come to threats, physical violence and extortion, should it ?

Fuck insurance, and fuck insurance companies, we need to nationalise health care, and ensure that a good faith effort is given even to the "doomed".

Cause you know, sometimes those "doomed" will surprise you - case in point, I was supposed to be stillborn, and I didn't have the decency to roll over and die THEN neither.


Even if I *did* expire most of the folk who know me personally wouldn't buy it till ya hammered in the stake.
