Former President Donald Trump used a dubious accounting maneuver to claim improper tax breaks from his troubled Chicago tower, according to an IRS inquiry uncovered by ProPublica and The New York Times. Losing a years-long audit battle over the claim could mean a tax bill of more than $100 million.

The 92-story, glass-sheathed skyscraper along the Chicago River is the tallest and, at least for now, the last major construction project by Trump. Through a combination of cost overruns and the bad luck of opening in the teeth of the Great Recession, it was also a vast money loser.

If the IRS prevails, Trump’s tax returns would look very different, especially those from 2011 to 2017. During those years, he reported $184 million in income from “The Apprentice” and agreements to license his name, along with $219 million from canceled debts. But he paid only $643,431 in income taxes thanks to huge losses on his businesses, including the Chicago tower. The revisions sought by the IRS would require amending his tax returns to remove $146 million in losses and add as much as $218 million in income from condominium sales. That shift of up to $364 million could swing those years out of the red and well into positive territory, creating a tax bill that could easily exceed $100 million.

The only public sign of the Chicago audit came in December 2022, when a congressional Joint Committee on Taxation report on IRS efforts to audit Trump made an unexplained reference to the section of tax law at issue in the Chicago case. It confirmed that the audit was still underway and could affect Trump’s tax returns from several years.

Biden’s Approval Is Low, Except Compared With Everyone Else

Q. What do you call someone who speaks only one language?

A. An American.

It’s an old joke, but it still works. In fact, I’m monolingual myself, even though my academic work was largely focused on international trade and finance. In my defense, the great bulk of global economic research is published in English; and in general, Americans’ lack of language skills is less important than their insularity, their relative unfamiliarity with what happens and how things work in other nations.

Other countries, especially wealthy ones that more or less match the United States in technological development and general ability to get things done, are a sort of mirror that helps us see ourselves more clearly. Yet many Americans, even supposedly knowledgeable commentators, often seem unaware of both the ways other nations are similar to us and the ways they are different.

In particular, with the looming election on everyone’s mind, how many are aware that President Biden is among the more popular — well, less unpopular — leaders in the Western world?

I’ll come back to that surprising fact, and what it tells us, in a minute. First, let’s talk about some other international comparisons that seem relevant to the current situation.

Although we hear politicians on the campaign trail trying to make hay with the old Reagan-era question — Are you better off than you were four years ago? — there’s a lot of amnesia about what was actually happening in 2020, namely a deadly, terrifying pandemic. To some extent, I guess, people treat Covid-19 as an act of God, beyond the reach of politicians.

But that isn’t really true. No matter what we did, many people were going to die — but the death toll was affected by politics, perhaps especially by the way vaccines became a front in the culture war. And America had a really bad pandemic, even compared with its peers. U.S. life expectancy was already lagging behind comparable countries’ by 2019, but the gap widened after Covid-19 struck.

On the other hand, the U.S. economy experienced an exceptionally strong bounce back from the pandemic recession. Even after adjusting for inflation, U.S. gross domestic product per capita is up 7 percent since the eve of the pandemic, greatly exceeding growth in other major wealthy economies. This would seem on the face of it to say something good about Biden’s economic policies.

But public perception of our economic performance is strongly colored by rising prices. Inflation — the rate at which prices are rising — has subsided a lot, but prices haven’t and won’t come down. And there have been huge recriminations against policymakers, both the Biden administration and the Federal Reserve, either for supposedly causing the bout of inflation or at any rate failing to prevent it.

Here, however, is a case where the similarities between the wealthiest nations are more revealing than their differences. Inflation surged almost everywhere after the pandemic. And if you take care to compare “apples to Äpfel” — to use the same consumer price measures — inflation has been remarkably similar in different countries. Since the eve of the pandemic, the Harmonized Index of Consumer Prices has risen 19.6 percent in the United States and 19.8 percent in the euro area. This strongly suggests that pandemic-related disruptions, rather than national policies, were inflation’s main driver.

Still, inflation rankles voters. Even when income growth exceeds inflation, as it has in the United States, people tend to feel that they earned their higher wages only to have them snatched away by higher prices. And this is probably the most important reason that, according to tracking polls conducted by Morning Consult, every single leader of a Group of 7 nation is underwater, with more voters disapproving than approving of their leadership.

So who’s the winner of this unpopularity contest? Who has the least bad net approval? The answer is Joe Biden, with Giorgia Meloni of Italy a close second. The other Group of 7 leaders are even more unpopular. And this has political consequences. The U.S. election, worryingly, looks like a tossup, but in Britain, which must hold a general election by January, current projections say that Rishi Sunak’s extremely low approval is setting the stage for the virtual collapse of the Conservative Party.

Now, you could (and I would) say that Biden should be doing better in the polls given the economic and social fundamentals: very low unemployment, fairly low inflation and violent crime on the decline. And the United States does seem to stand out for the extent to which voters insist that the economy is bad even as they say they themselves are doing well.

But every political analysis that says the fault for Biden’s low approval lies with the president and his campaign — that he’s too old (although that narrative, after suddenly peaking, mostly faded away after his State of the Union address) or is out of touch with the concerns of “real” Americans — needs to explain why he’s doing less badly than his foreign peers.

Many believe that the New York “business records” charges now playing out in court would not have been brought against anyone but Trump.

And that’s probably true.

But there’s a reason.

It’s that mischaracterizing a hush-money payment as a legal expense to spare embarrassment — or even to cheat on taxes — is not something of great consequence . . . whereas doing it to become President of the Unted States and change the course of history is — and something no one but Trump has ever done.

Yes, it would have been better if Al Capone had been tried for murder instead of tax evasion.

So, too, if Trump could be timely tried for lying to the FBI about documents he claimed not to have had and then worked to conceal.

Better still, if he could be timely tried for attempting to overturn an American election.

He seems clearly guilty of both.

But given that he appointed judges (one in Florida, three to the Supreme Court) seemingly intent on dragging those cases out long enough for him to shut them down once reelected, we have to take what we can get — if we get anything at all. (It’s not easy to get all 12 jurors to agree; and not enough if only 11 do.)

The next administration “should also pursue the death penalty for applicable crimes—particularly heinous crimes involving violence and sexual abuse of children—until Congress says otherwise through legislation.”

That the Supreme Court has in the past ruled that the death penalty should not be used for crimes that do not involve the death of the victim, such as child rape, seems not to matter to Project 2025. Perhaps the authors of “Mandate for Leadership” think that the current Supreme Court would take a different view.

And, with Trump, the authors of Project 2025’s death penalty plan know they will have a very receptive audience. In fact, he has long loved the death penalty.

That love affair goes back at least to 1989 when, as the Washington Post notes, “Trump, then a celebrity real estate developer, took out full-page advertisements … to call for a return to the death penalty after a female jogger was beaten and raped in Central Park. Five black and Hispanic teenagers were arrested and convicted in the case, spending years in prison. The ‘Central Park Five’ were later exonerated.”

He said at the time, “I want to hate these muggers and murderers. They should be forced to suffer and, when they kill, they should be executed for their crimes.” Since then, as the Post observes, “Trump has weighed in … on a number of other cases,” using Twitter to make his pro–death penalty feelings known.

During his time as a candidate for president and then during his term in the Oval Office, he has frequently talked about, and talked up, the death penalty. He has embraced it as a sign of his toughness and masculinity and a blunt instrument of public policy.

He has long wanted to expand the range of offenses for which someone could get a death sentence. In 2018, Trump proposed executing drug dealers.

He also claimed that leaders in China and Singapore had told him that the death penalty was an effective method for dealing with drug problems.

In the waning months of Trump’s presidency, his administration went on a killing spree, reviving long-dormant federal executions. It put 13 people to death in a span of six months.

Along the way, the Trump administration dramatically expanded the federal government’s ability to carry out the death penalty by issuing a rule allowing it to hang, electrocute, gas, or shoot individuals it did not want to kill by lethal injection.

Since he left office, Trump has continued to embrace capital punishment. In 2022, he used speeches delivered in Las Vegas and at the America First Policy Institute to bemoan this country’s crime problem and again offer the death penalty as a surefire way to deal with it. “To put it simply, we are a nation in decline,” he said in Vegas. “The streets are flowing with the blood of innocent crime victims. … We need to end the crime wave immediately.”

A second Trump presidency could have dire implications for European security.

Trump’s defenders argue that he is bluffing to pressure Europe into spending more on defense. But former U.S. officials who worked closely with Trump on NATO during his tenure, including one of us (Hooker), are convinced he will withdraw from the alliance if he is reelected. The Republican 6-week abortion ban is really a 4-week abortion ban

A trio of academic researchers are concerned that most Americans don't know how pregnancies are dated. It turns out I didn't know either. I've always assumed that pregnancy is dated from conception and lasts about 39 weeks.

Nope. Pregnancies are dated from the start of the mother's last menstrual period, which is usually about two weeks before conception. The average gestation lasts a hair over 38 weeks, for a total of 40.

Does this matter? The authors suggest it does because it means "6-week" abortion bans are actually 4-week bans dated from conception — when it's unlikely a woman even knows she's pregnant. So it's an important distinction.

I suppose. My own take is that the whole point of a 6-week ban is to seem a little less extreme than the zealots while still effectively prohibiting all abortions. So it's not as if the dating distinction is just an innocent mistake that needs explanation. It's all part of the Republicans' plan.

The New York Trump Case Is Kind of Perfect. The case embodies the defendant.

Not all that long ago, I thought that the trial currently being held in The People of the State of New York v. Donald J. Trump would be the last one I’d want to see as the first one tried against the former president. It seemed the least serious of the cases against him. Here’s a man who tried to overthrow American democracy by launching a coup to stay in power. A man who allegedly stole dozens of boxes of classified national-security documents from the White House, some containing secrets about other countries’ nuclear-weapons capabilities, then lied about the documents, concealed them, and obstructed a federal investigation about them.

I thought I would have strongly preferred the cases about those matters to have gone first, particularly the secret-documents case, which substantively would be a lock, were it not for the judge overseeing it. But I feel the need to admit error. The truth is, I’ve come around to the view that People v. Trump is, in at least some ways, the perfect case to put Trump in the dock for the first time, and—I hope, but we’ll see—perhaps prison.

Because this case really captures Donald Trump. The legal commentariat have been engaged in an odd debate about what to call it. “The Stormy Daniels case.” “The hush-money case.” “The porn-star-hush-money case.” (Personally, that’s always been my favorite, and I think it sounds even better in German—Pornostarschweigegeldrechtsfall.) The more legally precise would like it to be known as “the New York business-records-falsification case,” because that’s what the New York penal code says it is. Some high-minded people I know prefer “the New York election-interference prosecution,” because it involves the concealment of a matter that might well have affected the outcome of the 2016 presidential race.

All these locutions work, but what the case is really about is Trump’s modus operandi—lying. He’s a matryoshka doll of mendacity. He lies, usually lies some more, and then often lies about the lies he’s previously told. He told at least 30,573 lies while president, by The Washington Post’s count. He lies almost whenever he opens his mouth, even when truth would better serve him. To be sure, his other criminal cases involve lies—lies about the 2016 election, lies about the military secrets he stole. But the alleged lies in People v. Trump strike at the core of his moral putrescence—and Trump knows it. They are lies allegedly meant to cover up a tawdry man’s tawdry behavior. The case truly embodies Donald Trump. And for that reason, I think, it deeply disturbs him.

As usual, this defendant just couldn’t help himself. The prosecution was entitled to put on evidence of the sex to establish Trump’s motive for the payoff and cover-up. The defendant could have had his lawyers not dispute the point, even stipulate to it. What’s the harm? His political supporters stand by him even though he’s already a civilly adjudicated sex offender, so why would they care one whit about what he did consensually for a couple of minutes with an adult-film actor once upon a time in Stateline, Nevada? Had he not insisted on contesting the point, Daniels might not have had to testify, or at least she might have been on and off the stand in a flash. Because, again, what ultimately matters in the case happened mostly in New York City in 2016.

Trump’s insistence on pointlessly contesting Daniels’s veracity entitled the prosecution to draw her account out even more than it otherwise could have—not only to establish a record on why Trump would have been motivated to hush Daniels up (because sex), but to bolster her credibility with detail of her recollection (about sex). As Justice Juan Merchan later told the defense counsel in denying their motion for a mistrial:

"Your denial [of a sexual encounter] puts the jury in a position of having to choose who they believe: Donald Trump, who denies there was an encounter, or Stormy Daniels, who claims there was."

"Although the People do not have to prove that a sexual encounter actually did occur, they do have the right to rehabilitate Ms. Daniels’ credibility and to corroborate her story, which was immediately attacked [by the defense] on opening statements."

"The more specificity Ms. Daniels can provide about the encounter, the more the jury can weigh to determine whether the encounter did occur and, if so, whether they choose to credit Ms. Daniels’ story."

The result, thanks to the defendant, was the introduction of more evidence that made him look like a duplicitous clod.

Even conservative economists agree: We should have higher taxes on the rich

Tyler Cowen points today to a new paper that investigates whether economists tend to talk their own book. That is, do they generally come to conclusions that fit their political leanings?

The answer, unsurprisingly, is yes, and I doubt that we need to bother with any more research on this subject. Tyler particularly directs our attention to this:

That's a big difference. But it's notable that even the furthest-right economists can't manage to twist the evidence any further than a 58% optimal tax rate. That's a very high top tax rate by their standards.

Now, I assume that "optimal" in this context means "the rate that raises the most money"—not the rate that's fairest or most efficient. Still, this indicates that in terms of revenue raising, top rates should be at least 58% and probably closer to 70%. In other words, about what we had before Ronald Reagan wrecked the public fisc for good.

In 2024, the top tax rate of 37% applies to those earning over $609,350 for individual single filers, up from $578,125 last year.

Texas governor pardons racist murderer

You remember Daniel Perry, don't you? He's the guy in Texas who developed a hatred of Black Lives Matter protesters in 2020 and wrote to friends about how he planned to kill a few of them. Eventually, he did. He deliberately drove his car into a crowd of BLM protesters, claimed that one of them had maybe raised a rifle in his direction, and then gunned him down before plowing through the rest of the crowd to make his escape.

A jury — in Texas — unanimously convicted him of murder and sentenced him to 25 years in prison, but right-wingers were outraged and Gov. Greg Abbott promised to pardon him just as soon as he could.

That turned out to be yesterday, and Abbott has followed through. Perry is a free man because it's now legal in Texas to kill protesters if they annoy you a lot. This is disgusting beyond words. Perry's act was a brutal, cold-blooded, violent crime motivated by a long history of outspoken racism, but because he was acting out a conservative anti-BLM fantasy Abbott set him free. I'd say it's unbelievable, but these days that's not true. It's all too believable from a modern Republican.
