A federal appeals court on Monday upheld the dismissal of a lawsuit challenging Houston Methodist’s COVID-19 vaccine mandate, which last year thrust the hospital into the national spotlight as the first healthcare system in the U.S. to require the shots for its employees.

The lawsuit, filed on behalf of 117 Houston Methodist employees who refused to abide by the policy, was dismissed in June 2021 by U.S. District Judge Lynn Hughes, who at the time decried arguments comparing the requirement to those made under Nazi Germany.

In its opinion, the U.S. Fifth Circuit Court of Appeals said it affirmed the original ruling “because plaintiffs do not demonstrate any error in the district court’s judgment on the arguments made in that court but instead make an entirely new argument on appeal.” -- https://www.ca5.uscourts.gov/opinions/unpub/21/21-20311.0.pdf

The plaintiffs’ attorney, Jared Woodfill, said “this battle is far from over.”

“We believe employment should not be conditioned on your willingness to take an experimental shot,” he said in an email to the Chronicle. “During oral argument, the court indicated that one way to potentially address this case of first impression is to take it back to state court. We will pursue every legal avenue available to our clients, including taking this case to the United States Supreme Court.”

Woodfill added that a “companion case” has been filed in Harris County, though records of that lawsuit could not be found by press time.

Houston Methodist announced its mandate April 1, requiring employees to be fully vaccinated with a one- or two-dose series or request a medical or religious exemption. Protests ensued among a small group of hospital workers. Those who did not receive a vaccine or a religious exemption were first suspended and eventually fired.

In the end, 153 employees out of roughly 25,000 in the hospital system were either terminated or resigned. Many Texas Medical Center institutions have since implemented their own mandates.

Jennifer Bridges, a former nurse at Houston Methodist Baytown Hospital, was among the most vocal opponents of the mandate and the lead plaintiff in the federal lawsuit. She previously described the plaintiffs as “a mix of those who want more trial data to emerge on the long-term effects of the vaccine before taking it, and those who simply don’t want any shots,” according to earlier reports.

The lawsuit brought three separate claims of wrongful termination, alleging violations of state and federal law. In their appeal, the plaintiffs “pivoted” from focusing on the federal law violations to state law, the appeals court notes in its opinion.

The plaintiffs “now even equivocate on whether federal law supports their claim,” according to the opinion. “Federal law does not, and the district court did not err in dismissing plaintiffs’ claim.”

Politicians don’t want to talk about Covid-19 anymore. But it’s still influencing voters.

The pandemic is still having enormous, if subtle, influence on American politics. Inflation — a crisis that began with supply-chain and workforce issues caused by Covid-19 and was likely amplified by some aspects of the US relief legislation — is the No. 1 issue for US voters right now. Murders and drug overdose deaths began rising during the pandemic, souring the public’s mood on the country’s future and presaging a difficult campaign for the party in power.

“It’s been so extensive that you just don’t notice it,” John Gasper, an economics professor at Carnegie Mellon University who has studied the effect of prior natural disasters on political behavior, said. “People are sick of blaming Covid for a lot of things. Politicians don’t want to keep talking about Covid.”

Much of the Republicans’ voter base has been skeptical of Covid-19’s significance for a while, giving their candidates little reason to focus on it.

The exception is the hard-right candidates who oppose public health interventions to slow down the pandemic. Certain Republicans continue to make clear their opposition to mask or vaccine mandates and other measures, even though those restrictions have been lifted almost everywhere.

That bizarre reality — in which the pandemic that killed 1 million people is being most effectively politicized by the people who opposed the response to it — reflects the unusual nature of Covid-19 as a political event. It started as something akin to a natural disaster: disruptive, but not something that sticks in voters’ memory. But, unlike most hurricanes or tornados, the pandemic wasn’t over within a relatively short time. It lasted years — long enough to evolve into a political wedge issue that candidates use to stir up their most strident supporters.

“Covid has transformed from a disaster to ... fodder or kindling for the ongoing culture war,” Gasper said. “It’s one more thing to stoke the fire in order to feed your base.”

Even though Trump himself tried to counter vaccine skepticism, many of his favored candidates have continued to run very publicly on their opposition to not only vaccine mandates but to getting vaccinated at all.

It fits into the general themes of distrusting experts and institutions that have been a hallmark of Republican campaigns for a long time now, most notably during Trump’s rise to the presidency. Those with anti-establishment attitudes attack health experts.

Republicans politicians placed themselves in opposition to health experts as a way of indicating they are on the side of their own voters -- angry poor white trash, who are about 100 million out of a population of 330 million. 75 million voted for Trump.

The entire health-care system is now perpetually overburdened and unable to provide its former standard of care. People are still being disabled by long COVID, often without ever landing in the hospital.

Local officials, community organizers, and grassroots groups are swimming furiously against the tide of governmental apathy to push some pandemic response forward, even if incrementally. The late Paul Farmer, who devoted his life to providing health care to the world’s poorest people, understood that when doing such work, victories would be hard-won, if ever won at all. Referencing a line from The Lord of the Rings, he once said, “I have fought the long defeat.” In the third year of the COVID pandemic, that fight will determine how America fares against the variants and viruses still to come.

In a study of 177 countries, people’s level of trust — in the government and especially in one another — predicted COVID infection rates and vaccine uptake. In America, trust is in short supply, and accordingly, the country has underperformed throughout the pandemic despite its considerable resources. This problem is getting worse: A poll from January found that only 44 percent of respondents trusted the CDC’s statements on COVID, down from 55 percent in 2020.

As the pandemic has revealed, even powerful biomedical tools such as vaccines sputter in practice if disadvantaged people can’t access them, or if distrusting people refuse to use them. America’s recurring mistake is to create such technofixes at warp speed, while neglecting the systems that actually deploy those tools.

America actually has an entire workforce that specializes in earning trust: community health workers. They’re hired for their empathy, their strong local ties, and their personal experience with hardship. Breanna Burke, a community health worker in Bristol, Tennessee, where she has lived since she was 3, told me that her job is to “get to the root cause of ongoing health issues,” with the understanding that a person’s circumstances constrain their choices. For example, she helped one of her diabetic clients plan a budget to keep their power on so they could keep their insulin cold; another time, she figured out that a patient whose pain wouldn’t stop had been sleeping on a hardwood floor for nine months, and contacted a local women’s club to raise money for a mattress.

When COVID hit, Burke provided people with emergency food supplies so they could weather quarantine in safety, and talked others through their hesitancy over getting vaccinated. She can do that because her nonjudgmental approach and shared life experience make her trustworthy — the secret to community health workers’ extraordinary effectiveness.

Here is yet more bleak news about the obesity epidemic: Obesity isn’t just killing millions of people. It’s giving lots of them Alzheimer’s first.

“Obesity is now the top modifiable dementia risk factor in the U.S.,” reports the Journal of the American Medical Association in its latest bulletin. Obesity in midlife is now leading to more cases of dementia than any of the other usual suspects, including depression, smoking, diabetes, high blood pressure, physical inactivity, or low levels of education. About a third of dementia cases in America are now associated with some combination of these factors, with midlife obesity, physical inactivity and low education levels leading the way. According to the medical study, midlife obesity was a contributing factor to some 18% or just under 1 in 5 cases of dementia in America.

A decade ago obesity wasn’t even in the top three.

But why should we be surprised? Nearly half of all Americans are now clinically obese. The percentage has risen by a third in a generation, while the rate of severe obesity has more than doubled.

The comedian Bill Maher spoke out about the subject three years ago, and the main result was a “social media backlash”… against Bill Maher. Go here to watch a licensed therapist tell people that if they are trying to lose weight they are giving in to “fatphobia.”

In the years before I quit alcohol and cigarettes, statistically zero people ever told me not to give in to smokephobia or boozephobia. Not one.

Is it true that obesity kills 325,000 Americans a year?

Nope. That official figure is more than 20 years out of date.

Since then, based on data from the U.S. Census and the Centers for Disease Control and Prevention, the number of adult Americans with obesity has risen by about 70% and the number with severe obesity by 140%.

So simple math says the death toll is now probably around 500,000 every year, which is more than the annual Covid deaths in 2020 and 2021.

Now compare the extraordinary and heroic national measures taken over the last two years to combat Covid with the mass passivity about obesity.


Obesity now kills more Americans than smoking, says the Cleveland Clinic.

On average it wipes about 15 years off your life, according to this medical study from 2021.

The annual cost to America is an estimated $173 billion.

News that obesity also helps cause dementia has further grim news on the economic front as well as the human one. Some 6 million Americans already have dementia and the numbers are rising steadily as more people age. Dementia is a vicious and cruel disease that is especially devastating to family members, but also imposes a severe burden on everyone around the victim.

The cost to the economy of dementia is nearing $300 billion a year, including the terrible toll the disease takes on families and carers.

You’d think we’d be tackling this for the thing it is: The No. 1 health crisis in America — worse than drugs and worse than Covid. You’d think we’d be tackling a food industry that pushes edible crack. You’d think we’d be teaching kids about better and simpler nutrition in schools. You’d think we would, at the very least, stop subsidizing unhealthy food through the SNAP program. You’d think we wouldn’t be trying to stop people talking about the subject honestly.

America was in an early-death crisis long before Covid

Jacob Bor has been thinking about a parallel universe. He envisions a world in which America has health on par with that of other wealthy nations, and is not an embarrassing outlier that, despite spending more on health care than any other country, has shorter life spans, higher rates of chronic disease and maternal mortality, and fewer doctors per capita than its peers. Bor, an epidemiologist at Boston University School of Public Health, imagines the people who are still alive in that other world but who died in ours. He calls such people “missing Americans.” And he calculates that in 2021 alone, there were 1.1 million of them.

Bor and his colleagues arrived at that number by using data from an international mortality database and the CDC. For every year from 1933 to 2021, they compared America’s mortality rates with the average of Canada, Japan, and 16 Western European nations (adjusting for age and population). They showed that from the 1980s onward, the U.S. started falling behind its peers. By 2019, the number of missing Americans had grown to 626,000. After COVID arrived, that statistic ballooned even further—to 992,000 in 2020, and to 1.1 million in 2021. Were the U.S. “just average compared to other wealthy countries, not even the best performer, fully a third of all deaths last year would have been prevented,” Bor told me. That includes half of all deaths among working-age adults. “Think of two people you might know under 65 who died last year: One of them might still be alive,” he said. “It raises the hairs on the back of my neck.”



These counterfactuals puncture two common myths about America’s pandemic experience: that the U.S. was just one unremarkable victim of a crisis that spared no nation and that COVID disrupted a status quo that was strong and worth restoring wholesale. In fact, as one expert predicted in March 2020, the U.S. had the worst outbreak in the industrialized world—not just because of what the Trump and Biden administrations did, but also because of the country’s rotten rootstock. COVID simply did more of what life in America has excelled at for decades: killing Americans in unusually large numbers, and at unusually young ages. “I don’t think people in the United States actually have any awareness of just how poorly we do as a country at letting people live to old age,” Elizabeth Wrigley-Field, a sociologist at the University of Minnesota, told me.

Someone might reasonably ask: What’s the big deal if I die at 76 versus 78? But in fact, life expectancy is falling behind other wealthy nations in large part because a lot of Americans are dying very young—in their 40s and 50s, rather than their 70s and 80s. The country is experiencing what Bor and his colleagues call “a crisis of early death”—a long-simmering tragedy that COVID took to a furious boil.

In every country, the coronavirus wrought greater damage upon the bodies of the elderly than the young. But this well-known trend hides a less obvious one: During the pandemic, half of the U.S.’s excess deaths—the missing Americans—were under 65 years old. Even though working-age Americans were less likely to die of COVID than older Americans, they fared considerably worse than similarly aged people in other countries.

After a historic drop in 2020, life expectancy in the United States took another significant hit in 2021.

According to provisional data published Wednesday by the US Centers for Disease Control and Prevention, life expectancy at birth dropped by nearly a year between 2020 and 2021 -- and by more than two and a half years overall since the start of the Covid-19 pandemic.
Life expectancy at birth fell to 76.1 years, the lowest it has been in the US since 1996, and the biggest 2-year decline in a century.

Covid-19 was the driving factor, with deaths from the virus contributing to half of the decline from 2020 to 2021, according to the report from the CDC's National Center for Health Statistics.

The death rate from Covid-19 was higher in 2021 than it was in 2020, so it wasn't particularly surprising that life expectancy would fall again, Bob Anderson, chief mortality statistician for the CDC, told CNN.

Also, drug overdose deaths reached a record high in 2021, killing about 109,000 people. And deaths from unintentional injuries -- about half of which are due to drug overdose -- was the second-leading cause of the decline in life expectancy. . . . "We have the science and the tools available to help us reverse this trend and reduce the number of overdose deaths in this country. But these tools are not being used effectively."

An 'astounding' decline

The recent decline among American Indian and Alaska Native people is particularly "astounding," Anderson said.

The life expectancy for this group plunged by nearly 2 years between 2020 and 2021 and a startling 6.6 years since 2019 -- more than twice as much as it did for the total US population.

At 65.2 years, the life expectancy for American Indians in 2021 was equal to the overall US life expectancy in 1944.

"When I saw that, in the report, I just -- my jaw dropped," Anderson said.
"It was hard enough to fathom a 2.7 year decline over 2 years overall. But then to see a 6.6 year decline for the American Indian population -- it just shows the substantial impact that the pandemic has had on that population."

Deaths from Covid-19 directly were the leading contributor to the decline in life expectancy among American Indian people in 2021, but deaths due to drug overdose and other unintentional injuries, as well as chronic liver disease, which is often caused by alcohol abuse, were nearly equal contributors for this group.

A separate study, published as a preprint in June, ( https://www.medrxiv.org/content/10.1101/2022.04.05.22273393v4 ) found that the decrease in life expectancy in the US over the course of the pandemic was "highly racialized" and substantially larger than it was for a set of comparable countries. In fact, that study found that life expectancy increased slightly between 2020 and 2021 for the set of 21 peer countries.

In the first year of the Covid-19 pandemic, life expectancy declined least among White people. In the second year of the pandemic, however, this group saw the second-biggest decline in life expectancy -- and deaths due to Covid-19 contributed to the drop among White people more than any other racial or ethnic group.

We know that the latest version of Covid us incredibly contagious, but not very serious. It's going to spread really fast in indoor spaces. So be prepared. Paxlovid really does work for the more serious cases,I know somebody who had to take it. Mostly it's like a bad cold tho.

When people start fudging figures it makes me suspect the whole narrative.

How many new hospitalizations does that mean? 100? 1000? 10?

My aunt had it 2 weeks ago. My dad and one of my brothers had it last week and my step-mom has it now. Nobody died. But they were never boosted, thankfully.

I had the sniffles and a minor cough for a few days around the same time, and I had just been with my dad in a confined space down by my brother before he got it, but I don't shit my drawers every time I need to blow my nose. I just had Covid back in April, so I'm probably naturally immune, or Covid is nothing more than the common cold to me now.
