The decision supports rapid removal of asylum-seekers, per 1996 law. How is this "going left"? This has been a Trump goal since before he was elected.

The law clearly says this is a matter that is NOT OPEN to judicial review.

Ginsberg read the law and she agrees that this is NOT OPEN to judicial review:

The statute at issue here. 8 U. S. C. §1252(e)(2), sets forth strict limits on what claims a noncitizen subject to expedited removal may present in federal habeas corpus proceedings. I agree that enforcing those limits in this particular case does not violate the Suspension Clause’s constitutional command: “The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.” U. S. Const., Art. I, §9, cl. 2. But we need not, and should not, go further.

If Congress wants foreigners such as Thuraissigiam to get a month in court, then Congress needs to change the law so that foreigners like him who touch American soil for less than a minute have legal rights written into law equal to foreigners who have been living illegally in America for years.

What makes this too complicated for Trump lovers to understand is that they don't know that the law gives illegal aliens rights, and the law clearly does that in some well described situations. Thuraissigiam's situation was deliberately not covered by the law.

You know what "Trump lovers" do understand?

They understand that of the 9 Justices on the Supreme Court, the two Cringe Fringe, agenda driven Lefties appointed by Obama purposefully misinterpreted the law.

Elena Kagan and Sonia Sotomayor are not there to be Supreme Court Justices.

They are key players in the Left's concerted effort to undermine our country.



Had Hillary Clinton won and replaced two more judges with Elena Kagen 2.0 and Sonia Sotomayor 2.0, we'd already be very much further along into an America that wouldn't even resemble what it was.

Trump threw a wrench into that.


More important than anything else Trump could do in his second term is to make sure that Ginsburg's replacement is not another Kagen or Sotomayor.

And it should be noted that I absolutely loathe you Lefties for doing what you've done. It is NOT a good thing to have the scales tipped too far on any one side. The pendulum will begin swinging the other way and with how extreme Left it has gone this time it's going to go so far right we're all going to be wishing that we had the GWB Administration again.

Justice Sotomayor and Justice Kagan dissented: The Court holds that the Constitution’s due process protections do not extend to noncitizens like respondent, who challenge the procedures used to determine whether they may seek shelter in this country.

The disagreement is over the rights of noncitizens. Seven justices think that noncitizens have no Constitutional rights, unless Congress says they do.

In theory, Congress cannot strip citizens of their Constitutional rights, but we know, for example, Japanese-American citizens lost their Constitutional rights during WWII. A more brazen historic example is that any Black could lose all their Constitutional rights even if the Blacks were born free but they fell into the hands of pro-slavery Whites. The Sotomayor and Kagan want to nail down the law to say that neither Congress nor President nor States can strip citizens and noncitizens of their Constitutional rights. The Japanese-Americans citizens were being treated like they were noncitizens. Free Blacks were treated like noncitizens, even if they had certificates proving citizenship. If it doesn't matter about citizenship to have rights, then Congress and the President won't be able set up prison camps for the future equivalent of Japanese-Americans.
