Obama scolds George that ObamaCare isn't a tax.



Barry, it's a tax.


Congress called the payment a penalty, not a tax, but Roberts said the court would not get hung up on labels. Among other indications it is a tax, Roberts said, "the payment is collected solely by the IRS through the normal means of taxation."

"Because the Constitution permits such a tax, it is not our role to forbid it, or to pass upon its wisdom or fairness," Roberts said.



Basically, what Justice Roberts did was grade Barry's work , and instead of giving him an F, he simply changed Barry's argument, so that it fit in with what would allow the Court to pass this abomination, and save Barry's marxist ass.

My guess is, this isn't the first time a teacher has 'fixed' Barry's work, and given him a passing grade.

This is just one in many steps we've taken as a nation towards the potential death of freedom.

Freedom will only die when the time comes that action needs to take place but we're all still too comfortable and/or meek to take it.



I'm really looking forward to the day that China cuts our credit and our nations credit rating falls to "D". Virtually overnight nearly every government hand out will dry up and this ruling won't even matter. A lot more people will also find themselves out of work and with a lot of extra free time on their hands to brood and fester over the mess our Government has blindly led us into.

Civil War II is coming. I don't think I could smoke enough cigarettes in time to make sure that it doesn't happen in my lifetime.

The irony is that the second Civil War will be fought by the slaves themselves, and not "for the slaves", as our school's textbooks would have us believe.



Stock up on a few years worth of food and water rations when money allows. Get yourself a cache of weapons and ammo and some training in how to safely use them and clean them so you can protect your investment and your loved ones. When the shit inevitably hits the fan, you'll be in a better position than most, and that's just about as much as you could ask for. I sure sleep better at night knowing that I'm prepared for the worst.

As much as we might fight, brother, this is one of the key points I hope to instill on others...

I take you at your word that you do this yourself, and I implore you to make it your duty to implore your neighbors and friends and family to do the same. They're all paying rediculous tax payments for the land... they might as well start making the land pay back some for them...., right?

It's not a tax, but Roberts claimed it was, in order to make the law work. This is how contorted and convoluted this ruling is, that ObamaCare is called a tax, but not a tax, so that it would stand.

This may seem a little technical, but it is not a minor matter. A number of politicians and commentators are claiming that the Supreme Court in the Obamacare case “limited” the reach of the commerce clause, i.e., five justices held that individuals cannot be mandated to buy insurance under the commerce clause. Actually, the five justices did not limit anything. They simply did not accept the Obama administration’s ridiculous argument that inactivity is commerce. The status quo stands because Obamacare was upheld under the tax provisions. However, the bigger point is this — when a court issues an opinion, it is said to be the “Opinion of the Court.” The Opinion of the Court is the controlling precedent. Chief Justice Roberts wrote the Opinion of the Court for Parts I (background on the Obamacare law), II (the Anti-Injunction Act is not a bar to the lawsuit proceeding and being decided) and III-C (Obamacare is valid under the tax power).

But respecting Part III- A, the commerce clause and necessary and proper section, the decision notes that Roberts is writing for himself, not for a majority. Furthermore, the Dissent is labeled as: “Justice Scalia, Justice Kennedy, Justice Thomas, and Justice Alito, dissenting.” It is not labeled as “dissenting in the judgment, concurring in part” or some permutation.

You cannot say it was the “opinion of the court” that the mandate violated the commerce clause. You have to cobble together sections where Roberts is writing for himself and the dissent (which did not formally join with Roberts), is writing for itself.

In fact, Justice Thomas, in his separate dissenting opinion, wrote:
“The joint dissent and THE CHIEF JUSTICE cor­rectly apply our precedents to conclude that the Individual Mandate is beyond the power granted to Congress under the Commerce Clause and the Necessary and Proper Clause.”


Notably, this does not explicitly state that the dissenters joined with the Chief’s opinion respecting the commerce clause. If five justices had intended for their view of the commerce clause to be controlling as the majority view of the court, they would have said so by joining or concurring in each others’ parts. They didn’t. There was no formal majority on the commerce clause issue. Should this matter come before a court again, it is not settled as a matter of precedent and no doubt the litigants will still be fighting over it.


Point is, this pile of go-se was stood on its head and spun around every which way, JUST so it could be allowed to be upheld. Much like it was rammed down our throats in the first place, using every conceivable trick in the book, ( Cornhusker kick-backs, anyone ? )

The people do NOT want this excessive burden, yet an array of bureaucratic drones in DC are hell bent in forcing it upon us, no matter what.

Not only that, but because of how bad Bush43's administration ran things and the media on the Left, we're probably lucky that the worst we got was a politician who not only hailed from the most corrupt state of 50, but who has placed his "most trusted advisor" as the mayor of the most corrupt city in the most corrupt county of the US too...

As much as I hate to admit it, we probably got off lucky....

I hate to admit it even more, but GWB and his administration did whatever they could to make everyone hate "white", "men", "rich", "religious" (particularly Christians)..... and we should count our blessings that the aftermath of GWB wasn't the proverbial "Anti-Christ"....

I'm no bible thumper, but the "AC" hails from Europe, not Kenya.

I don't know my Morman History, but without proof, I'd say that Romney isn't "He" either....




I feel pretty comfortable that if the world does end December 12th, it wasn't because of any US Presidential Election anyway....

Romney agrees with Chief Justice John Roberts. Except when he doesn't agree with him. Romney today says it's a tax, but his website says it's a fee, not a tax.

Romney didn't refer to it as a tax when he passed the same plan in Massachusetts.

Meanwhile, right-wingers across the nation are clamoring to call it 'the biggest tax increase hin history' - Rush Limbaugh calls it the biggest tax increase in the history of the universe.

It's not even the biggest tax increase in a generation. *IF* it's a tax increase at all. MItt Romney isn't sure, and neither is his campaign. Rappy isn't sure, either.

Is a fee for not following the law a "tax"? When I got a speeding ticket, was I being taxed for exceeding the speed limit? Or was I being fined so I wouldn't do that again?

Yup. None of it was any conscious end-of-worlder stuff, but it all just kinda happened. The guns and ammo happened because I like shooting. The growing food happened because I like food and wanted to get some real use out of my yard. Tomatoes, peppers, onions, garlic, rosemary, mint, cilantro, limes, grapefruit, peaches, blackberries, squash, cucumbers, and hopefully next year strawberries.

The water happened because of drought conditions.

The car thing happened because it's a Honda. :)

Wish I could afford to put solar panels on the roof and help get off the grid a bit.

"Tax" "Penalty" -- it's all a bunch of bullshit. Whatever it is, VERY few people will encounter it, and even those who do won't have to pay it. Yes, legally it CAN be enforced but the administration has made it patently clear it WON'T be, period.

Obama wants to call it a penalty so he can say he didn't raise taxes...which is more bullshit, because it doesn't "raise" anyone's taxes anyway.

Romney, poor baby, is stuck between calling it a penalty or a tax (actually, he just doesn't want to talk about it at all!); a penalty would be nice, but his base wants it to be a tax--which means he lost his claim of never having raised taxes while he was Governor. I almost feel sorry for him.

But in the long run, it's all just bullshit absurdity, and nothing more. Ridiculous argument taking over the "news" and having people debate it...I mean really???

That's a cute idea Kwick, and maybe it's true. Time will tell.

The truth is, none of us know how any of this is going to play out. All I see when there is another legal avenue for Government to tax us, they will start off small and 30 years from now our kids and their kids will be paying 30% more for the same thing and not even ask why.

This relatively thin sliver of Americans who’d be required to pay for full coverage belies the dominant public perception that the mandate would be a financial strain for wide swaths of the population.

“That was one of the reasons we wanted to do this study, because we felt like the real impact was being blow out of proportion,” said Blumberg, who was the lead researcher on the study.

A closer look at numbers shows that 87.4 million of the 268.8 million Americans under age 65 would be exempt from the mandate because they’re illegal immigrants, have incomes below the law’s tax-filing threshold or can’t get coverage because the premiums would eat up too much of their income.

Nearly 75 percent of this group – 63.4 million – already have coverage, while 24 million do not. Blumberg said these 24 million comprised 7.3 million illegal immigrants, 14.3 million people whose incomes are below the tax-filing threshold and 2.4 million people who can’t get affordable coverage.

That leaves 181 million Americans under age 65 who could be subject to the mandate, Blumberg said. But 86 percent of this group, 155 million people, already have coverage.

“So they’re not going to be subject to any penalty. They don’t have to change anything that they’re doing,” Blumberg said. “Some of them have public coverage already, some of them are buying coverage on their own, some of them are in employer-based insurance.”

That leaves 26 million non-elderly people who are uninsured and potentially subject to the penalty.
Of this group, 8 million are low-income people who’d be eligible for free coverage under Medicaid. Nearly 11 million others probably would get federal subsidies to buy coverage on the insurance exchanges, “so they wouldn’t have to pay the full freight, but they would have to pay something in order to avoid a penalty,” Blumberg said.

In his majority decision, Chief Justice John Roberts Jr. suggested that the law’s penalties for not obtaining coverage may not be enough to compel the uninsured to purchase it.
