No doubt no more than politics, but he's skirted the law (via his wife) in so many instances, I'd love to see an investigation. He's always been an unqualified puppet to me, and was the straw that broke ANY confidence I had in the Supreme Court.

I believe in solving problems, not sharing them.


Based on what I have read, it was clear to me that Thomas was harassing Anita Hill. This was no "black courtship" kind of thing, the man is a bully. Furthermore, he has written no judicial decisions of note; he is not much more than a "me-too" to Scalia. In a words, the man is a creepy idiot.

I wish there was some other way to test the mental competency and moral fiber of judicial candidates other than by a group of mentally incompetent and morally bankrupt politicians.

Well, this'll get interesting indeed, if anyone actually bothers to investigate beyond obligatory political sabotage, cause don't you know - they're ALL guilty as hell of this, and so far ain't hardly nothing ever been done or said about it.

But it's a VERY common practice, and has been for a while.

So you think it's okay for a judge to take bribes from people whose cases are before his court, as long as he's black and conservative? Or do you just not think we should look into such conduct if said judge is black and conservative? Seems like you're clinging to a double standard.

Oh I assure you, anyone who makes it far enough to BECOME a judicial candidate is the very scum of the earth.

They start out, many of em, as public defenders, professional dive-takers betraying their so-called clients to the state in hopes that by so prostrating themselves before the power of the state eventually they'll be seen as "loyal" enough to wind up on the OTHER side of the court with the stacked deck.

Then as prosecutors, they're basically handed a crooked game with a stacked deck and zero consequences for any misconduct, and provided they don't have other political aspirations and comply with orders handed down from on-high to fuck over certain people for political points, eventually they wind up a judge...
(notice how guilt or innocence NEVER enters this?)

And then as a judge, they're pretty much a rubber stamp unless someone totally fucks up, I mean it's all decided before they let us peons (and yes, that includes a so-called-jury) in there, the rest is just a dog and pony show to delude us into thinking the system works, a veritable facade for the masses - and most judges are rated by how often they successfully manipulate the evidence and the jury in collusion with the prosecutor to produce a guilty verdict...
And of course, local politics, which as they rise in stature so does the level of influence and the size of the bribes, cause there's not one bloody black robe who's not accepted them - to refuse means being ostracized, cast out, and unsupported by the few agencies supposed to oversee judges, which I can tell you are far more corrupt than the boys in black are, that for damn sure.

And so, by the time you have someone even considered potential for a supreme court judge, they are as corrupt as satan hisself, heavily invested into a system as profoundly unfair and malicious as anything on the planet, and generally seething with personal vices and psychological issues far beyond joe sixpack due to the stress of maintaining the illusion - or they're a damn sociopath, born or learned-behavior, usually the latter cause at the bottom a born sociopath general goes straight into criminal private practice.

But here's where it gets interesting - a buddy of mine and myself have been doing some psych analysis of what HAPPENS after confirmation to the bench for these folks, once ALL accountability is gone.
Now, as per my opinion - the way to tell who someone really is inside, involves removing ALL consequence, positive OR negative, from their behavior and seeing what they do.

Now, initially, they step to the beat of the drum which got them there, out of perhaps a sense of twisted loyalty or partisanship or what have you, but after a while, and it takes some time - they actually become LESS corrupt, the inability to retaliate against them, and advancing awareness of mortality and the simple fact that they'll soon be beyond retaliation wears upon them, and they start lookin at the world around them and how they wanna leave it...

The powers that be know this, and as such, by determined effort they ensure that any potential for that bench is so steeped in corruption, avarice and malice that it will take decades to fade, ensuring many years of compliant service.

The best example of the above phenomenae though, it Rehnquist, all but dead in his chair, grimly hanging onto even life itself by sheer force of will, REFUSING to step down because it would have allowed Bush to appoint some fucking lunatic to the bench to further enable his madness - that this failed due to his untimely death means far less than that he tried, in the end he gave it all for a cause he no longer even believed in.
I can forgive a lot, for such an act.

Anyhows, the notion that supreme court potentials are anything but the scum of the earth is preposterous cause of how the system really works, and pretending otherwise is simply enabling it's brokenness.

You keep making the assumption that his skin color has anything to do with it. You, who continually, for years now, have complained about people "playing the race card", have now played it at least a half-dozen times in the last couple weeks. Pretty hilarious in its hypocrisy, that.


I don't care what someone's skin color is. If they're corrupt, I want them investigated.


By your logic, Rappy, the ONLY reason you want Eric Holder investigated is because he's black. That's also why you hate Cynthia McKinney, Barack Obama, and a host of other black people. His skin color isn't relevant. His political ideology shouldn't be relevant, either. A corrupt Supreme Court justice should be a concern to every U.S. citizen, and if he's taking money and gifts from people whose cases he's sitting in judgement of, that's a pretty clear conflict of interest.

Frem, your background, in my opinion, has made you cynical of virtually everything and anyone. I disagree with your theory in this case. I think there are good and bad judges, cops, etc., like all humans; there are some who get into it and give in to weakness and/or are pressured this way or that; and there are STILL good judges, cops, etc., who do their job well.

Mike: This surprises you exctly why (rhetorical question)? Those of us who think have figured this out long ago. But thanx for noting it, for those who might not have noticed.

Let's just say that tomorrow imma have to put up with it in a fashion that's made me more snarky than usual about it - but I *do* quite earnestly feel that pretending our justice system isn't a complete facade enables its very brokenness, that's not rhetoric at all.

Also, provided there's time and I don't wind up pitched out on my ear or cooling my heels in slam for a couple hours.. there's gonna be some strong words exchanged downtown over the matter of Aiyana Jones, and prosecuting the ONE DECENT PERSON (Allison) who blew the whistle on the lies and behavior of the police, who (and I posted about this here) ran down and made dissappear the folks who had the original cell phone footage in a guns-blazing chase through the same neighborhood shortly thereafter, over a supposed "traffic violation".. yeah, right, since when does half the department involve a chase and shoot up an entire goddamn neighborhood in the process over a traffic ticket ?
They're also trying to crush the kids father, since they offered the ACTUAL perp (Owens) next best thing to full immunity to get him to testilie and lay all the blame on Aiyanas father as a retaliatory gesture.
Which would all fall apart save that the Judge will very likely try to strike the ABSOLUTE evidence of wrongdoing (i.e. the film, including the cops planning their cover-up) cause of how it was obtained and the charges against Allison.

All so the cops can get away with the negligent homicide of a seven year old girl.

You're damn right I am cynical - but there's a difference between "nothing you can do" cynicism, and "we *will* fix this!" cynicism of the type that puts the boot of public ire straight up the asses of the Worthy - in this case one PARTICULAR Worthy, by the name of Kym.

Oh you'll love this - the supposed "Grand Jury" that allegedly "indicted" Allison ?
One person - whom of course we have no evidence even exists (and there's some evidence I'll not share that indicates they may well not, right up there with the ubiquitous "anonymous informant" scheme...) AND all the documents and evidence are sealed in about as complete a violation of discovery as ever existed.

I find it telling that the Wayne County Prosecutors Office is so hell bent on bringing charges down upon the person who blew the whistle, but trying every trick in the book, legal or not, in order to get that negligent dickhead Weekly (the jerk who fired the shot which killed Aiyana) off the hook - also worth remembering are the plethora of lies and false charges originally against other members of the Jones family in an effort to shift the blame onto them, particularly the grandmother, who WOULD have been charged had it not been for Allisons act of common decency in sneaking out a copy of the footage, again including the cops PLANNING the cover-up, quite blatantly.

And of course, they're willing to let a fucking murderer (Owens) slide, in order to bring further hell down upon Aiyanas father for daring to be upset about the negligent homicide of his daughter, cause they've offered the sumbitch damn near a walkaway in order to pin it all on Aiyanas dad - they'd pin the murder on him if they could, but that runs into the little problem of the witnesses... some of whom have been "encouraged" to shut up or change their story by Wayne County PD.

Fucking star chamber, is what it is...

Not all so evil as that, over here, I was somewhat amused at not being pitched out on my ear because I am an Anarchist, do not believe in the legitimacy of the court, feel that it violates the constitutional requirement for a fair trial, and consider agents of the State to be untrustworthy... not to mention my annoyance at what I feel amounts to gunpoint conscription in order to be held over folks head as a threat against them (and the judge ADMITTED we were there in part to pressure the putative defendants to plea bargain).
After grilling me under oath, despite my comment I'd rather not answer those questions, despite the answers he recieved, the damn judge seats me anyways, stating "Well I presume you have no problem with the basic presumption of innocence, then..." and the DEFENSE attorney throws a hissy and sends me off, it was all I could do not to facepalm - the judge was OBVIOUSLY trying to tank the case (I guess he felt it was bullshit) since by my own statements there's no way in hell I could *possibly* deliver a verdict of guilty if the States trial has failed Constitutional Requirement, and HE KNEW THIS...
And the "defense" attorney then goes and sabotages what would have been a slam-dunk walkaway for his client ?
(Public Defender, obviously, as I said, professional dive-takers)
I consider that somewhere between deliberate negligence and "ineffective assistance of counsel" - the onus to prove guilt is on the State, and the defendant at no time is required to correct errors of the State, no matter how deliberately introduced.

So what we had here is a Judge who WANTED to dismiss the case, who likely felt it was all bullshit but had not the ability to dismiss it outright, trying to follow his conscience in a corrupt system which wouldn't ALLOW him to do the right thing directly - and an attorney SUPPOSED to be *defending* his client subverting that and hanging him out to dry.

Now, the latter I am used to, one reason I find public 'defenders' so despicable - but this is the first time I've seen a Judge actually allow his conscience to be a factor in his administration of the law - which it SHOULD BE, that's WHY we have human Judges instead of machines, so imma be remembering this guy next time we decide at the ballot box who gets or remains on the bench.

Mind you, after being pitched off, I did out of naught more than idle curiosity look over the case, and without sharing details - it *WAS* bullshit, someones designated driver pulled a bonehead move in traffic, and for whatever reason the dickhead cop thought he could shovel a faery story about the guy who was IN THE BACK SEAT THE ENTIRE TIME, supposedly being the one driving the car at the time of the accident, despite statements to the contrary by everyone *but* him, despite airbag residue all over the designated driver - fuck me but that whole matter was a waste of the courts time.
And mine.

American "Justice" at it's finest, grrr.

I did get to see the closest thing to an honest Judge I ever have though, so it wasn't a complete wash.

I was unaware that he was even married, so I guess her skin color never even entered into it for me. I don't find his resumé that impressive, though.

But it's be nice if the article specified to whom Mrs. Thomas' income should be reported. If she's a salaried employee of the Heritage Foundation, her income would be reported to the IRS and cross-checked against the Thomases tax returns, so that can't be that.

ETA: apparently, Justice Thomas amended his disclosure forms in January 2011 to indicate his wife's employment. Per the article, he does not have to report the amount of her compensation.

Jesus. Looking him up, it struck me forceably how frequently Supreme Court Justices are attacked from the right on their beliefs and connections.

How come I never heard at the time that he was also influenced by Ayn Rand, particularly The Fountainhead, and would later require his staffers to watch the 1949 film version? And good lord, if ANY proposed Supreme Court Justice had a spouse working for the left equivalent of Heritage Foundation, they'd have been screaming to the heavens!!!

Seems to me this woman is a STRONG activist for conservative causes, in which case it CERTAINLY concerns me that she's marriage to a Supreme Court Justic, and should everyone else (except of course the right, who adore it and who would be hollering from the rooftops if the situation were reversed and any left-leaning candidate for the Supreme Court had such ties!).

I find this reprehensible; it's one thing for a Justice to be married to someone who has their own leanings, but for a Supreme to have openly expressed strong feelings pro-conservative, married to a well-known ACTIVIST who has HEADED a conservative organization Pro-Tea Party, and worked for something like Heritage? That's just wrong.

Gawd what we've come to...

ETA: As far as racism, I would feel precisely the same if a "White" Supreme had done what he did or this was true of him, and I was totally unaware his wife was Caucasian until now. I would ALSO be enraged at the thought of a Supreme who had such obvious strong leanings to the left, and was married to someone who was actively involved in leftist politics/organizations and worked for (what's the equivalent of Heritgage?). It's wrong in EITHER direction!
