when the court hides evidence. and lies are told to
put some one in jail. then all the evidence they have
should be dismissed. like what happened in the Macdonald case. the man should not get a new trial they should just
say that he is not guilty and release him. and if D&A
can be used to put you in prison it should be used to open
the door and let you out.

Dismissal was accomplished in the redlight camera sniper case, after cops confessed to the crime. Seems somebody didn't want cops to confess their crimes in a courtroom on TV, so the case was dismissed 1 week before trial.

But of course they tacked on a heap of new charges, so he has 4 or 5 additional jury trials this year... In the next hearing scheduled for 9/11, prosecutors refused to serve notice of their secret motions on the defense. I stumbled across it while reading the court file, or his lawyers would never have known about it. Dirty tricks are a common tactic by the State when you start winning in court. They hate it when The People win.

So half the challenge to winning in court is avoiding trial by ambush, or ambush by stalker cops. In the sniper patsy case, undercover cops or police informants hitched a ride then beat the crap out of him in his own van, and prosecutors refused to prosecute the attackers.

That was punishment for pointing a loaded shotgun at an undercover deputy in a Metallica t-shirt who broke into his home without a warrant ("then ran out of the house screaming with flashbacks to Afghanistan" according to the cop's courtroom testimony).

Capt McDonald was up against martial law by courts martial. That requires even more hardball defense tactics. I used my knowledge of the McDonald case to keep my wife out of military prison during Iran-Contra and Gulf War #1, by preferrign criminal charges against all her commanding officers. Dick Cheney personally offerred her a job at the Pentagon (to cover his ass and keep his enemies closer).

This tactic also works in civilian courts. I always file criminal charges against cops in traffic ticket trials. Very easy to prove cop-crimes by using the cop's own police video.

Thanks for handing out the warm welcome, DT. I tend to *assume* (Yeah, I know - makes an ass out of Uma Thurman) that people have lurked around in here before jumping in.

Could be wrong, though.

Bald Eagle has some good points.

Texas, who leads the nation in executing prisoners ("WE'RE NUMBER ONE! WE'RE NUMBER ONE!"), now also leads the nation in the number of prisoners who are being exonerated by DNA evidence, according to the Innocence Project.

Oddly enough, the vast majority of those who are being found to absolutely NOT have committed the crimes for which they were imprisoned are black men. How weird is it that in this age of "post-racism" America, someone would feel the need to fudge the evidence against a black man in Texas? Seems hard to believe, doesn't it?

I will also note for the record that the Anti-Pinkerton Act in fact makes the Governments use of Blackwater in ANY capacity wholly illegal, not that anyone seems to care.
