That's just asinine, ya confiscate the phone and make her parents pick it up, and give both her and them a lecture - and then follow through with suspension if you have to.

And if I was an admin who caught a suspended student on the grounds, oh HELL NO I wouldn't have em cited, I'd put them back in class!

This student, however, from the description, has problems that are NOT going to be solvable by the school administration or justice system, neither of which is even capable of providing the help she needs.

What they are in detail I couldn't say, but there's also the fact that she was arrested for not "playing ball" which is gonna set a precedent in that kids head of an adversarial/confrontational relationship with school and legal authority which is GOING to escalate cause of how badly the situation was handled.

The student is in the wrong, and needs help of a type neither offered nor provided, and the school admin and police are in the wrong for completely bungling the situation, which in the long term is gonna escalate it instead of resolving it.

There's also that I would not exactly take the word of the admin or police as having any more value than the students, since they're well known to lie every bit as much especially when it comes to dealing with young people, look at what Brent Darrow had to deal with, yes ?

Students do not surrender their personhood and humanity when they enter the building, nor should they be expected to - and barring the most critical of incidents, a students parents should ALWAYS be present if they are to be searched, there's just no excuse for doing otherwise.

This smacks of a student with pre-existing problems that are being ignored or at least not addressed, compounded with an administration more concerned with their authority than their students, and typical cop-bully mentality.

It's a recipe for disaster, it always is.

The problem here is COPS, a/k/a Police State DEATH SQUAD.

Immature principal and school board allowed DEATH SQUADS in the skools.

Immature teacher lost control of her classroom.

Immature teached invited a DEATH SQUAD into her classroom.

Immature cop, er, DEATH SQUAD treated this child as any other CROOK, by INTERROGATING her with LIES. All cops are REQUIRED to tell LIES as condition of employment.

This is very confusing to the interrogatee, and often result in false confessions, especially from children. And Martha Stewart.

Fifth Amendment to the US Constitution says STFU. But that's not taught in skool.

It was like prison...without the nice orange jumpsuits.

Legally its a simple issue and one thats been decided by the Supreme Court.

Students have full free speech rights. Does that mean they can text at will in class or be disruptive, etc? No. The Supreme Court has long recognized that reasoble time, place, and manner restraints can be applied to free speech. Hence not yelling "FIRE" in a crowded theater or blocking the streets with an spontanious demostration (without a permit).

Is a no texting rule reasonable? The test is several parts: Is the rule content neutral? Yes, all texting, not just a particular message.

Is the rule for a compelling govt interest? Yes, education requires attention, not just of the student, but it could be a distraction to others as well.

Is the rule narrowly tailored and limited in scope? Yes, the student is allowed to text as much as they want...just not at that particular time or place.

It should be noted that the student was not arrested for texting in class. She was arrested for Disorderly Conduct. That means she was violating a rule, was asked to stop, and refused to comply. Its the 'refusal to comply' that makes a broken rule a broken law.

Zero, I happen to be pointing out that the legal system isn't capable of resolving the problems that lead to that disorderly conduct in the first place - nor should it try.

Sure, in the short term, the issue has been resolved, but it sets up an adversarial condition that *will*, almost without a doubt, lead to further, escalating confrontations which will waste more time and effort on a problem that simply cannot be resolved that way.

And it inspires a lack of respect for law and law enforcement not only in the student described, but all witnesses to the matter since it really was a gross overreaction to the situation at hand, and as such will firmly imprint the image of police as bullies into the minds of the rest of the class, leading to even more potential confrontations down the road, wasting more time and effort.

All of which could have been averted by the legal requirements of having the students parents present during the search, something which might help define if not resolve the problem, and suggest other avenues of resolution like counselling or family therapy.

Yes, the student was being disruptive, and this is a problem, but focusing on the WHY rather than the HOW is far more likely to solve the problem in the long term and save a lotta needless hassle for everyone.

Even you understand that.

As for the rest, barring all but the most critical of situations, the parents SHOULD be present if a minor is to be searched, and this wasn't one of em - rather than making a spectacle in mid class, disrupting it even further, they should have simply escorted her to the office and contacted her parents, which if done in a professional and respectful manner, with an explaination to the student and parents by the officer(s) in question, would come off better as a neutral party appropriately doing their job, than the adversarial perspective of 'hired goons'.

If you want people to obey the law, perception is important, especially to teens who are already naturally mistrustful of authority figures because they're at an age when they're questioning the rules and limits of civilized society - professional conduct and respect, something police officers in general seem to have forgotten, goes a long way towards defusing potential future conflicts before they land in your courtroom.

And wouldn't it be nice to have nothing to do, even though you still get paid, ehe ?

Using the justice system on a problem like this is like using a screwdriver to change a spark plug, it's the wrong tool for the job, isn't gonna work, and the harder you apply it, the more damage you'll do trying.
