ROCKVILLE, Md. -- Montgomery County Police say they are noticing a speed camera prank that targets innocent drivers.

The prank works this way: A driver will take down someone else's license plate number, print a high resolution image of that license plate, attach it to their own license plate, then speed by a speed camera on purpose, so that the fake license plate gets hit with the fine.

"Fool-proof" systems continue to create smarter fools.

Let me say that, as a Prosecutor, I am opposed to these camera systems.

In general, I like cameras. They can be great witnesses, but their utility is limited at best. For example...I love Best Buys' camera system which gives you a digital image of PirateNews stuffing copies of 'Bridget Jones' Diary' down his pants trying to shoplift them out of the store.

When I prosecute a speeder I have to prove that the officer was on duty, in uniform, in a marked police cruiser, in my City, County, and State, on a particular date and at a particular time, when they observed the alleged traffic offense. When a speed measuring device is used I have to prove the officer was trained to operate the device, that he tested the device and, in his opinion, it was operating properly that day. THEN I have to prove that the person he observed committing the alleged act is in fact the person on trial.

In Ohio these speed devices require not one bit of the above proof which I consider essential to a fair trial on the issue. Instead the tickets are "administrative" rather then "traffic/criminal". In effect they replace the traffic and criminal rules of procedure with a quasi-judicial administrative hearing that requires no real proof.

The Supreme Court of Ohio recently decided that this was all ok...but I had a rough time following their decision...some nonsense about coexisting with state traffic laws rather then usurping them or decriminalizing behaivor, either of which would be wrong.

So I think all you folks out there should challenge these ticket whenever or however you get them. They aint right...and I think most of you will agree that if I'm against them, there must be something seriously wrong here (or else your changing your minds and saying 'if Hero's against them...they must be ok').

I note for the record that covering your license plates with a phoney license number as described in the above article is both very clever and illegal. In Ohio using phoney plates is a Minor Misdemeanor punishable by up to $150. So don't let me catch you doing it...seriously...don't let me CATCH you doing it...if you do it and don't get caught...

Arizona Law Enforcement Joins Anti-Camera Crusade

"As Sheriff, I will eliminate Photo Radar vans in Pinal County and replace them with a traffic unit of highly trained deputies. Photo radar tries to replace deputies and police officers. You can not replace a police officer or deputy with machines or cameras. I live locally in Johnson Ranch, where we are already paying the highest property tax rates in Arizona. Don't be fooled, photo radar is yet another tax and trick to get more money from hard working citizens."

Here in Knoxville Tennessee, sheriff deputies just shoot redlight scameras, with immunity from the Knox County district attorney.
