One of the most disturbing trends in school discipline and juvenile justice is what Texas Municipal Courts Education Center General Counsel Ryan Turner calls the passing of the paddle. Municipal courts and jusjustice of the peace courts are receiving an avalanche of Class C misdemeanors written to students in school, mostly for violation of the Student Code of Conduct. Speaking at a December 7, 2005, Texas Public Policy Foundation primer, State Rep. Harold Dutton (DHouston) recalled how he successfully defended an eight year-old student in municipal court who had received a Class C ticket from a school police officer for chewing gum in class. Dutton said the courtroom was full of other young students (and their parents) who had received similar tickets. Similarly, Turner, who also works as a prosecutor in Hays County, was referred a student who had been issued a Class C ticket for going out to get her books from her car in the school parking lot. Speaking to a group of 200 municipal court judges, Turner said almost all of them raised their hands when asked whether they felt like they had become the Vice Principal. One Harris County judge noted, A fight around the flagpole used to be handled at school; now it gets filed in court. Growing pains should not be dealt with in court. The kids miss school, the parents miss work, and they have to pay for parking. This has gone too far. Such anecdotal evidence is borne out by the little data that is available. From September 1, 2004 to August 31, 2005, there were 10,149 Education Code cases referred to Texas municipal courts, according to the Office of Court Administration.22 During the same period from 1998 to 1999, the first years in which such data was kept, there were 6,888 Education Code cases referred to municipal courts.23 This category of cases does not represent all citations issued at school, but only those issued for violations of the Student Code of Conduct. Many other citations issued in schools for violation of local or state criminal laws are classified in other, broader categories of municipal court cases. Education Code cases in Justice of the Peace courts are not separately tracked by the Office of Court Administration. With regard to juvenile court, in Harris County alone, of the 20,812 referrals, over a quarter (5,591) were school referrals. Section 37.102 of the Education Code, enacted as part of the 1995 Safe Schools Act, has been interpreted by school boards as empowering them to designate specific violations of the Student Code of Conduct that are Class C misdemeanors, even if such conduct is not a criminal offense under state or local law. Remarkably, some districts have even argued in court that these criminal offenses they create are not subject to the general defenses in the Penal Code, such as selfdefense. Students are issued citations for the school board-created offenses by school police officers, which they are expected to sign promising to appear in court, even though as minors they cannot enter into a contract. In most instances, the teacher, not the officer, is the one who saw the conduct at issue. Class C misdemeanors issued to students follow the same procedure as speeding tickets, which are also Class C misdemeanors. Assuming the student brings the citation home, his parents can choose to simply plead guilty and send in a payment for the fine amount, which can be up to $500, and court costs, which are $50 to $100. If the student does not plead guilty and pay the fine, a complaint is sworn out and the case is scheduled for trial before either the judge or a jury.

Seriously, in an ideal world, the parents would do their freaking job right and raise their children themselves, instead of just dumping them off at school and acting like it's their very own private day-care facility. The schools are overwhelmed, and are probably just trying to find a way to keep up AND to scare the living shit out of the kids and their parents to keep them from being fuckups in the first place.

Me? I don't have kids, so I could really give two shits about WHAT they do to the little bastards... ;)

And by the way, PirateJews, only about 10% of this reply is serious.

Also, your title says chewing gum is now a $50,000 fine. I don't see that in the legal stuff, though - I see vandallism being punishable by "UP TO" a $50,000 fine and community service, but that doesn't automatically assume that ALL such cases will instantly be given a $50,000 fine. So, while you accuse all "gangsta-govt copsters" of over-reacting, tell me again how you're any different?

He might be a little nuts, Kwicko...

But when it comes to Government sponsored, organised, institutionalised wholesale mistreatment and social engineering directed at children, I myself can show you hard evidence that would put a sub zero chill right into your bones.

As the dividing line between the harsh teen gulags that I mainly work against, and the public school system diminishes, I find myself a bit concerned.

What's worse is taking a natural human response to that bullshit (really, would YOU tolerate being treated like they do these kids ?) label it a pyschological disorder and try to medicate it.

And when that fails they ship em off to places like Tranquility Bay and Casa By the Sea, or even High Impact... downright gulags that kids are "dissappeared" to, right here in America every day.

It's easy to get children to behave well, simply treat them with the respect due a fellow human being, set an example with your own behavior and be honest about your failings.

But what happens more often is that they are mentally, emotionally, and verbally beaten down by the system and view anyone from the "adult" world as an enemy... it's hard to get past that, unless you can pass yourself off as not PART of that abusive machine, which I can a lot of the time.

Look at it like this... ok...

Say a guy gets a doberman puppy, and buys into all that bullshit about how they are mean and need to be broken and controlled yadda yadda.

So he beats the crap out of it, breaks it down to his will every chance he gets.

Eventually, the puppy grows into a dog, picks his moment, and totally mauls the stupid bastard, who responds "See, they were right, he TURNED on me!" when the truth of the matter is that the dog simply got big enough to fight back, and tired of taking his shit.

Same thing goes for kids, sooner or later, they get tired of taking shit from us and bite, some harder than others - and sometimes that bite is lethal, both to themselves and others.

The violence, school shootings and disrespect of us, our society, and our entire world comes directly from the treatment they recieve at it's hand, it's really not simpler than that.

Parenting is the first line of defense, but as my sister could tell you, when you're working two and three jobs to keep food on the table, how the bloody hell are you expected to DO it anymore ?

We find ourselves trapped between economy and society into supporting a system that is ruinous to all that brought us civilization in the first place - isn't it ironic ?

Frem, I can't comment on all this teen gulag/death camp stuff, because where I live, we just don't put up with that kinda crap.

But the pic that Britney, uh, PN, is using is from a drug raid on a school in 2003. No one was shot, and several students would up receiving sizable settlements as a result of the actions.

The principle is gone, and I think the chief of police was dismissed over it. I can't confirm that, but one article led me to believe it, calling him the 'former' COP.

To me, using that pic, with a heading like, 'death squad secret police' or what ever bullshit it is this week, is misleading to say the least.

But it is funny as hell to read. Makes me think of "fruit of the loomski" from the SWAT movie, ROFL. I can just see him sitting there in his tinfoil hat, computer humming on a dozen conspiracy theory websites at once. I mean, maybe he just got one parking ticket too many? Lives under a power line? Near a reactor?

Seriously though, where we live, I don't see these high handed actions. I'm not saying they don't happen somewhere else, because I don't know one way or the other. I'm just saying that I don't see it here. Maybe that's because if it did, whoever was responsible would get, at a minimum, the shit beat out of him.

Can't mess with someone's kids around here, lol. We're too redneck for it too work I guess. I've never heard of High IMpact or Tranquility Bay, but I'm assuming that's because they're in your neck of the woods, right?

Anyway, just a thought! How's the nephew, btw? Better I hope.

I wouldn't bet on that, if you live anywhere in or near the north american continent I would lay good odds you live within a hundred miles of one or more such facilities.

Tranquility Bay is in Jamaica, currently operational in spite of a history of abuse.
Casa by the Sea and High Impact were in Mexico, and eventually closed by the Mexican Government as "too horrific for words" .

Inside Edition actually got their hands on raw footage showing kids tied down in dog cages in the blazing heat for hours on end, I figure by now you might even have some idea how that happened.

The worst of it is that countries we consider to have less concern for human rights than we do CLOSED these facilities and ran the operators out of the country, while many of them operate here unhindered in spite of proven histories of rampant abuse and a list of deaths and severe injuries that is just plain horrifying.

And that doesn't even scratch the surface of pyschological casualties, suicides, overdoses, alcoholism, drug use, etc.

The nephew is doin ok, between his mothers work schedule and his fathers side of the family not caring for me too much, getting info isn't as easy as I'd like, Sis tends to let her cellphone die and has neither PC nor net access.

But last update he demanded his playstation and went at it, so that's a good sign.
