If racial disparities are innate, then promoters of equality are to blame for society’s ills. Although genetic determinists occasionally pay lip service to the idea of “equal rights,” their core claim is that certain groups of people are better than others. Ultimately this logic leads to the idea that certain “races” are beasts of burden unfit for higher thinking, meant to toil with their hands while their betters take their rightful place as a genetic overclass.

The lure of this logic for the right is obvious: If you want to argue against the state intervening to rectify racial, gender, or economic inequalities, it is simpler to say that the people the state would be helping are biologically inferior, and therefore nothing can realistically be done.

Even for those who lack wealth and status, being a member of a genetic overclass has its appeal: Your dream job? A supermodel-like girlfriend? The jealousy and admiration of your friends and colleagues? You should have all those things, as a white man, except that the Woke State took them from you.

They don't want civil-rights laws that would level the playing field, or policies that would erode the privileges they’ve inherited. Of course if you are really genetically superior, you do not require a society built on that premise. You only seek to create one because, on some level, you know you are not superior.

It may sound like an insensitive statement, but the cold hard truth is that there are a lot of stupid people in the world, and their stupidity presents a constant danger to others. Some of these people are in positions of power, and some of them have been elected to run our country. A far greater number of them do not have positions of power, but they still have the power to vote, and the power to spread their ideas. We may have heard of “collective intelligence,” but there is also “collective stupidity,” and it is a force with equal influence on the world. It would not be a stretch to say that at this point in time, stupidity presents an existential threat to America because, in some circles, it is being celebrated.

Although the term "stupidity" may seem derogatory or insulting, it is actually a scientific concept that refers to a specific type of cognitive failure. It is important to realize that stupidity is not simply a lack of intelligence or knowledge, but rather a failure to use one's cognitive abilities effectively. This means that you can be “smart” while having a low IQ, or no expertise in anything. It is often said that “you can’t fix stupid,” but that is not exactly true. By becoming aware of the limitations of our natural intelligence or our ignorance, we can adjust our reasoning, behavior, and decision-making to account for our intellectual shortcomings.

To demonstrate that stupidity does not mean having a low IQ, consider the case of Richard Branson, the billionaire CEO of Virgin Airlines, who is one of the world’s most successful businessmen. Branson has said that he was seen as the dumbest person in school, and has admitted to having dyslexia, a learning disability that affects one’s ability to read and correctly interpret written language. But it wasn’t just reading comprehension that was the problem — “Math just didn’t make sense to me,” Branson has said. “I would certainly have failed an IQ test.”

So, what is responsible for his enormous success, both financially and in terms of being a prolific innovator? Branson attributes his success to surrounding himself with highly knowledgeable and extremely competent people. Branson’s smarts come from his ability to recognize his own limitations, and to know when to defer to others on topics or tasks where he lacks sufficient knowledge or skill.

This means you don’t have to be traditionally intelligent or particularly knowledgeable to be successful in life, make good decisions, have good judgment, and be a positive influence on the world. Stupidity is a consequence of a failure to be aware of one’s own limitations, and this type of cognitive failure has a scientific name: the Dunning-Kruger effect.

The Dunning-Kruger effect is a well-known psychological phenomenon that describes the tendency for individuals to overestimate their level of intelligence, knowledge, or competence in a particular area. They may also simultaneously misjudge the intelligence, expertise, or competence of others. In other words, they are ignorant of their own ignorance. The effect has been widely written about, and investigated empirically, with hundreds of studies published in peer-reviewed journals confirming and analyzing the phenomenon, particularly in relation to the dangers it poses in certain contexts.

It is easy to think of examples in which failing to recognize one’s own ignorance can become dangerous. Take for example when people with no medical training try to provide medical advice. It doesn’t take much Internet searching to find some nutritionist from the “alternative medicine” world who is claiming that some herbal ingredient has the power to cure cancer. Some of these people are scam artists, but many of them truly believe that they have a superior understanding of health and physiology. There are many people who trust these self-proclaimed experts, and there is no doubt that some have paid their lives for it.

What’s particularly disturbing about the Dunning-Kruger effect is that people are attracted to confident leaders, so politicians are incentivized to be overconfident in their beliefs and opinions, and to overstate their expertise. For example, Donald Trump — despite not having any real understanding of what causes cancer — suggested that the noise from wind turbines is causing cancer (a claim that is not supported by any empirical studies). It is well documented that on topics ranging from pandemics to climate change, Trump routinely dismissed the opinions of the professionals who have dedicated their lives to understanding those phenomena, because he thought that he knew better. It’s bad enough that politicians like Donald Trump and Marjorie Taylor Greene don’t recognize their own ignorance and fail to exercise the appropriate amount of caution when making claims that can affect public health and safety — but what is really disturbing is that they are being celebrated for their over-confidence (i.e., stupidity).

It is less surprising that politicians who regularly exhibit the Dunning-Kruger effect are being elected to office when one realizes that they are being voted in by people who also display the Dunning-Kruger effect. A 2008 study by the political scientist Ian Anson surveyed over 2000 Americans in an attempt to see whether or not the effect was playing a role in one’s ability to overestimate their political knowledge. The results clearly showed that the people who scored lowest on political knowledge were the very same people who were the most likely to overestimate their performance. While this is shocking, it also makes perfect sense: the less we know about something, the less of an ability we have to assess how much we don’t know. It is only when we try to become an expert on some complex topic that we truly realize how complicated it is, and how much more there is to learn about it.

This new theory of stupidity I have proposed here — that stupidity is not a lack of intelligence or knowledge, but a lack of awareness of the limits of one’s intelligence or knowledge — is more important right now than ever before, and I’ll tell you why. The same study by Anson mentioned above showed that when cues were given to make the participants “engage in partisan thought,” the Dunning-Kruger effect became more pronounced. In other words, if someone is reminded of the Republican-Democrat divide, they become even more overconfident in their uninformed positions. This finding suggests that in today’s unprecedently divided political climate, we are all more likely to have an inflated sense of confidence in our unsupported beliefs. What’s more, those who actually have the greatest ignorance will assume they have the least!

What we are dealing with here is an epidemic of stupidity that will only get worse as divisions continue to increase. This should motivate all of us to do what we can to ease the political division. When we can clearly see the social factors that are causing people to become increasingly stupid, our anger and hatred toward them should dissipate. We do not have much control over our level of intelligence or ignorance, or our ignorance of our ignorance.


But this does not mean that we should accept stupidity as the result of deterministic forces that are beyond our control. After gaining a deeper awareness of our own cognitive limitations and limited knowledge base, we should do what we can to instill this higher awareness in others. We must not just educate the public and our youth; we must teach them to become aware of their own ignorance, and give them the skills they need to search for more knowledge, and to detect when they or others are overestimating their knowledge or competency.

We have good reason to be optimistic that this is possible. A 2009 study showed that incompetent students increased their ability to estimate their class rank after being tutored in the skills they lacked. This suggests that we can learn a type of “meta-awareness” that gives us the power to more accurately assess ourselves and our own limitations. Once we can do that, then we can know when we need to do more research on a given topic, or to defer to experts. We can also get better at distinguishing between true experts and those who only claim to be experts (but are really just demonstrating the Dunning-Kruger effect).

We are all victims of the Dunning-Kruger effect to some degree. An inability to accurately assess our own competency and wisdom is something we see in both liberals and conservatives. While being more educated typically decreases our Dunning-Kruger tendencies, it does not eliminate them entirely. That takes constant cognitive effort in the form of self-awareness, continual curiosity, and a healthy amount of skepticism. By cultivating this type of awareness in ourselves, and making an effort to spread it to others, we can fight back against the stupidity crisis that threatens our nation.

The unchanging malleability of Donald Trump

Everyone should know his playbook by now. We should know that Trump will

1) flood the zone with things that are burbling on the right-wing fringe,
2) make sweeping promises without much follow-through and
3) reject any criticism out of hand, spinning it into a reason to praise himself.

And so it was with his interview on NBC’s “Meet the Press” that aired Sunday.

One of only a few interviews with a traditional news outlet since he announced his 2024 candidacy last November, the discussion began precisely as his 2015 announcement at Trump Tower had begun: He would make America great again in part by repelling the hordes of criminal immigrants flooding into the country.

“They come from prisons. They come from mental institutions, insane asylums,” he said as he was answering the first question from host Kristen Welker. “They say, ‘Sir, please don’t use that term,’ but it’s true.”

As was the case eight years ago, this is not generally true. Some of those seeking to enter the country may have criminal records or even mental illness, of course, but there’s no indication that this constitutes a significant component of those seeking asylum or work in the United States. It’s almost certainly true that the universe of people who have served in senior positions on Trump’s political campaigns is more densely populated with accused criminals than the pool of recent immigrants.

Welker didn’t push back on this claim, in large part because Trump quickly moved on to another bit of patter. Flooding the zone.

She did offer some resistance to his attempt to present the film “2000 Mules” as a legitimate indictment of the 2020 election. Created by Dinesh D’Souza, recipient of one of Trump’s first presidential pardons, the film’s allegations of drop-box-stuffing have been completely eviscerated. When Trump told Welker, for example, that “we have thousands of essentially motion pictures of people stuffing the ballot boxes,” he’s referring to a common belief about the movie that is entirely false. The movie shows only a few examples of someone casting more than one vote at a drop box; none has been shown to have been illegal. One clip, described in the film as committing a crime, was determined to have depicted a man legally adding the ballots of family members. That man is now suing D’Souza.

Welker rejected Trump’s assertion, eager to move on to a different subject. There was probably a way for someone well-versed in the arcana of the allegations to push back harder on Trump’s claims; it’s very safe to assume that his ability to defend the movie is untested and flimsy. But this would almost certainly have simply led to Trump shifting the goal posts somewhere else, until he made a claim that his interviewer didn’t rebut. Falsehoods and conspiracy theories will always find a sturdy enough foundation on which they can rest.

Once you hand Trump a megaphone, he’s going to do with it what he wants. He knows how to use it. This is why it’s better to pretape his interviews, allowing for obvious dishonesties such as the one about “2000 Mules” to be elided or presented with context. For whatever reason, despite taping the interview in advance, NBC chose not to make such edits.

Welker did present Trump with questions about his past actions and future plans. The results were unsatisfying.

Consider Trump’s answer to questions about his efforts to subvert the 2020 election. Welker noted that he’d been told by numerous people, including “the most senior lawyers in your own administration,” that the election was over and he’d lost. She asked why he instead turned to outside attorneys, referring to Rudy Giuliani, Sidney Powell and others.

“You hire them, you never met these people. You get a recommendation,” Trump said. “They turn out to be RINOs” — Republicans in name only — “or they turn out to be not so good. In many cases, I didn’t respect them. But I did respect others. I respected many others that said the election was rigged.”

Later, she asked him if, should he win in 2024, he would pardon himself as protection against the federal charges that ensued.

“I had a couple of attorneys that said, ‘You can do it if you want,’” Trump replied. “I had some people that said, ‘It would look bad, if you do.’ Because I think it would look terrible.”

He also claimed that the call he placed to Georgia officials, the centerpiece of the criminal charges he faces in Fulton County, Ga., was necessarily innocuous because so many lawyers were on the call.

“Who is going to be talking badly when I have lawyers and many other people on the line?” he said to Welker. “Nobody’s going to say something bad.”

There’s no consistency here. Attorneys are a shield against the Georgia charges, a hall-pass for a self-pardon or a biased group of bums when they tell him the election wasn’t stolen. The through line is simply that their standing is tied to what Trump wants to do.

What did we learn? Nothing in particular. Trump offered an objection to a strict ban on abortion, but who knows what he’ll advocate for in a week? In 2015, he took five positions on the subject in three days. He did promise that he’d reach a deal with both sides that would make everyone happy, which might be the most obviously untrue thing he said in the entire interview.

Trump said he might pardon leaders of the Proud Boys. He said he might tap South Dakota Gov. Kristi L. Noem (R) as his potential running mate. He declined to outline his strategy for ending the war in Ukraine (something he’s repeatedly insisted was within his power), arguing that he didn’t want to tip his hand. This, too, echoed 2015: When he didn’t want to answer a question, he’d claim that, as a dealmaker, he didn’t want to constrain his options in advance.

It’s hard not to come away from this with a sense of futility. He’s the leading candidate for the Republican nomination and, in that role, demands scrutiny. But we already know what interviews will produce. Talking to Trump means offering a platform for false claims while generating pledges to which he feels no obligation to adhere.

Welker concluded the interview by asking if he’d somehow try to secure a third term in office if he won in 2024. Trump said he wouldn’t because “in six months to a year, many of the problems, almost all of the problems that you and I have just spoken about, will be solved.”

And if not, it will be someone else’s fault. Probably a lawyer.

On October 3, the Supreme Court will hear a case where the far-right United States Court of Appeals for the Fifth Circuit declared an entire federal agency, the Consumer Financial Protection Bureau, unconstitutional.

In the unlikely event that the justices uphold this decision, a brief filed by the banking industry explains to the Supreme Court, the entire US mortgage market could seize up, as banks will have no idea what rules they need to comply with in order to issue loans.

And this case, known as CFPB v. Community Financial Services Association, is one of at least six cases the Court will most likely decide this term where Fifth Circuit judges issued legally indefensible decisions that will have calamitous results if they are not reversed. That court, which is dominated by the most reactionary Trump appointees and similarly minded judges, has become the forum of choice for litigants pushing preposterous legal arguments that are unlikely to fly elsewhere, even in a very conservative judiciary.

By next June, the Supreme Court is likely to toss out a Fifth Circuit decision nuking the federal government’s power to prevent companies from defrauding investors. It is also likely to reverse a Fifth Circuit decision holding that people who are subject to domestic violence restraining orders — meaning that a court has determined that they are a violent threat to their romantic partner or their partner’s child — have a constitutional right to possess a gun.

And, on top of these three cases, which the Court has already agreed to hear in its upcoming term, it will also likely take up three other cases where the Fifth Circuit took leave of its senses. These include Alliance for Hippocratic Medicine v. FDA, which attempts to ban the abortion medication mifepristone; Doe v. Mckesson, which effectively strips political organizers of their First Amendment right to organize a protest; and NetChoice v. Paxton, which allows Texas’s GOP-controlled legislature to seize control of content moderation at social media sites like Twitter or YouTube.

At least for now, in other words, the Court’s upcoming term could potentially be very different from the two that proceeded it, where the Court’s GOP-appointed majority seemed to be on a mission to seek out longstanding precedents that are out of favor within the Republican Party, and destroy them. Those decisions appear to have emboldened the most reactionary voices within the judiciary, leaving the justices with a whole lot of messes to clean up.

Which is not to say that Democrats will have much to celebrate when the justices leave town again next June. Many of the Fifth Circuit’s decisions are so poorly reasoned, and so destructive of the interests of the United States, that it would be genuinely shocking if a majority of the justices sign onto them. The Supreme Court will deserve no credit for moderation simply for reversing these decisions.

That is, if it does reverse them. The Supreme Court is still dominated by conservative Republicans, three of whom were appointed by Donald Trump. So there’s always some risk that a majority of the justices will accept even the most outlandish arguments by their fellow Republican appointees on the Fifth Circuit.

Meanwhile, the Court will hear at least one case, Loper Bright Enterprises v. Raimondo, involving a legal doctrine reviled by the conservative Federalist Society. Loper Bright asks the justices to overrule something known as the “Chevron doctrine,” which limits the power of the federal judiciary (which is currently controlled by the Republican Party) to overrule decisions made by the executive branch (which is currently led by a Democrat).

Additionally, the Court will hear cases that could weaken many civil rights laws, and that could invigorate racial gerrymandering. And it’s likely that the Court will take up one or more cases involving state laws that target transgender youth before the upcoming term is complete.

Even so, it’s hard to miss just how much the Fifth Circuit looms over the justices’ upcoming term. And, while the Court is unlikely to show much moderation, it is likely to remind the Fifth Circuit that the judiciary does not exist to sow chaos for its own sake.

House GOP in open warfare over doomed spending plan

One Republican summed up the situation neatly as leadership-empowered negotiators faceplanted with days to go before a shutdown: “It’s a mess.”

As House Republicans began ripping apart their party’s latest spending proposal on a conference call their own leaders held to promote it, the plan’s two main defenders had to hang up the phone. They had flights to catch.

Reps. Dusty Johnson (R-S.D.), who represented centrists, and Byron Donalds (R-Fla.), who negotiated for conservatives, thought they had found a deal that would at least unite the fractious GOP — even if it couldn’t pass the Senate and avert a shutdown. Minutes after Johnson and Donalds left that Sunday night conference call, however, their work imploded, with a half-dozen House conservatives railing against it.

More than a dozen Republicans, mostly Donalds’ colleagues in the conservative Freedom Caucus, are publicly torching the spending plan he brokered. With just a four-seat majority, Speaker Kevin McCarthy can only afford to lose a handful of them given that he can’t count on Democratic votes — leaving the GOP bill effectively dead.

But beneath the surface, things are even worse for McCarthy this time around. The faceplant by the two negotiators he’d empowered has exposed a full-on House Republican rebellion that’s officially underway.

It’s bigger than a clash between the centrist and right wings of the party. The Freedom Caucus itself is divided, with many members swatting down a plan backed by their own leader. Many of those conservatives are now openly threatening to try to oust McCarthy if he relies on Democratic votes to avoid a shutdown, but they’re also withholding their support from the only Republican plan on paper.

An out-of-control GOP is the party of nonstop national crisis

Stop me if you’ve heard this one, but congressional Republicans are once again careening toward internal crisis and a damaging government shutdown.

You may remember this song-and-dance from the last four or five times the party’s hard-line Freedom Caucus members held America’s economy hostage.

In the past, Republican leaders managed by the slimmest of margins to avert financial catastrophe by working with Democrats to pass temporary funding bills. This time it isn’t even clear they can achieve that minimum level of competence.

It isn’t even clear that a sizable minority of Republican lawmakers want to keep the government open. Freedom Caucus stalwarts including Reps. Ken Buck (R-Colo.), Matt Gaetz (R-Fla.) and Anna Paulina Luna (R-Fla.) dismissed McCarthy’s proposal out of hand without even attempting to offer an alternative. Luna, who recently gave birth and is still in the hospital, went so far as to say she’d leave her recovery bed in order to guarantee McCarthy’s continuing resolution fails.

Luna offers the perfect visual of the current GOP: A lawmaker willing to drag herself out of a hospital bed in order to ensure the federal government does not function.

Republicans barely won that race in 2020 during the Presidential election. It was a nail-biter with only a 0.4% difference in votes, and hardly the definition of a Republican "stronghold", so losing it with an even-playing field during a Presidential election would have meant nothing, let alone the clown-show that happened last night.

All the fact that Democrats were able to out-fund the Republican running against them in a special election on September 19th of an off-year by 9,200% with out-of-state donor money and still only manage to win that election by 331 votes out of 2,811 people that voted means that Republicans dropped the ball again and had better figure out how to spend money wisely. They could have easily won that election with only $50k spent on promoting Rafter's competition instead of leaving him high and dry with only $500 in his campaign. $500 will buy you a movie night and dinner for two in New Hampshire in 2023.

This was a bellwether of nothing.

Why Kevin McCarthy Can’t Do His Job

Sept. 21, 2023, 7:00 p.m. ET

The speaker of the House is the only congressional officer mentioned in the Constitution, other than a temporary Senate officer to preside when the vice president can’t. The speaker’s job isn’t defined, but surely it includes passing legislation that keeps the federal government running.

But Kevin McCarthy, the current speaker, isn’t doing that job. Indeed, at this point it’s hard to see how he can pass any bill maintaining federal funding, let alone one the Senate, controlled by Democrats, will agree to. So we seem to be headed for a federal shutdown at the end of this month, with many important government activities suspended until further notice.

Why? McCarthy is a weak leader, especially compared with Nancy Pelosi, his formidable predecessor. But even a superb leader would probably be unable to transcend the dynamics of a party that has been extremist for a generation but has now gone beyond extremism to nihilism.

And yes, this is a Republican problem. Any talk about dysfunction in “Congress,” or “partisanship,” simply misinforms the public.
Crises like the one McCarthy now faces didn’t happen under Pelosi, even though she also had a very narrow majority. I’ll come back to that contrast. First, let me make a different comparison — between the looming shutdown of 2023 and the shutdowns of 1995-96, when Newt Gingrich was speaker.

If you had told me back then that I’d someday hold up Gingrich as a model of rationality, I wouldn’t have believed you. But hear me out.

Back in 1995, while Gingrich’s tactics — his willingness to employ blackmail as a political strategy — were new and dangerous, he had an actual policy goal: He wanted to force major cuts in federal spending.

Furthermore, Gingrich tried to go where the money was. The federal government is an insurance company with an army: The great bulk of nonmilitary spending is on the big safety-net programs, that is, Medicare, Medicaid and Social Security. And Gingrich in fact sought deep cuts in Medicare and Medicaid.

He didn’t get them, and the government’s role in promoting health insurance coverage eventually expanded greatly — although Medicare has been surprisingly successful at containing costs. Still, Gingrich’s goals were at least coherent.

McCarthy, in his desperate efforts to appease his party’s hard-liners, has acted as if their refusal to approve federal funding is a Gingrich-like demand for reduced federal spending. He tried to pass a continuing resolution — a bill that would temporarily keep the money flowing — that involved deep cuts to certain parts of the federal government.

But there are three notable aspects to this attempt. First, even if he had managed to pass that resolution, it would have been dead on arrival in the Senate.

Second, unlike Gingrich back then, McCarthy tried to go where the money isn’t, slashing nonmilitary discretionary spending. That’s a fairly small part of the federal budget. It’s also a spending category that has already been subject to more than a decade of austerity, ever since President Barack Obama made concessions to Republicans during the debt ceiling confrontation of 2011. There just isn’t any significant blood to be gotten out of this stone.

Finally, even this extreme proposal wasn’t extreme enough for Republican hard-liners. I liked what one representative told Politico: “Some of these folks would vote against the Bible because there’s not enough Jesus in it.” The point is that the party’s right wing isn’t actually interested in governing; it’s all about posturing, and the budget fight is a temper tantrum rather than a policy dispute.

If the G.O.P. were anything like a normal party, McCarthy would give up on the right-wingers, gather up the saner Republican representatives — it would be misleading to call them “moderates” — and make a deal with Democrats. But that would almost surely cost him the speakership, and in general more or less the whole G.O.P. is terrified of the hard-liners, so the party’s positions end up being dictated by its most extreme faction.

As I said, all of this is very different from what happens on the other side of the aisle. You still sometimes see analyses that treat Democrats on the left and Republicans on the right as equivalent, but they’re nothing alike. The progressive wing of the Democratic Party is, in fact, interested in policy; it tries to push the party’s leadership in its direction, but it’s willing to take what it can get. That’s why Pelosi, with only a narrow majority during Biden’s first two years, was nonetheless able to get enacted landmark bills on infrastructure, climate and technology, while McCarthy can’t even keep the government running.

Now, a protracted shutdown would be highly disruptive, and if past confrontations are a guide, the public would blame Republicans — which is what led Gingrich to back down in the 1990s. But it’s not clear that McCarthy, or whoever replaces him if he’s overthrown, would be willing or even able to make a deal that reopens the government. How does this end?

How General Mark Milley protected the Constitution from Donald Trump

In The Divider, Peter Baker and Susan Glasser write that Milley believed that Trump was “shameful,” and “complicit” in the January 6 attack. They also reported that Milley feared that Trump’s “ ‘Hitler-like’ embrace of the big lie about the election would prompt the president to seek out a ‘Reichstag moment.’ ”

These views of Trump align with those of many officials who served in his administration. Trump’s first secretary of state, Rex Tillerson, considered Trump to be a “fucking moron.” John Kelly, the retired Marine general who served as Trump’s chief of staff in 2017 and 2018, has said that Trump is the “most flawed person” he’s ever met. James Mattis, who is also a retired Marine general and served as Trump’s first secretary of defense, has told friends and colleagues that the 45th president was “more dangerous than anyone could ever imagine.” It is widely known that Trump’s second secretary of defense, Mark Esper, believed that the president didn’t understand his own duties, much less the oath that officers swear to the Constitution, or military ethics, or the history of America.


The difficulty of the task before Milley was captured most succinctly by Lieutenant General H. R. McMaster, the second of Trump’s four national security advisers. “As chairman, you swear to support and defend the Constitution of the United States, but what if the commander in chief is undermining the Constitution?” McMaster said to me.

For the actions he took in the last months of the Trump presidency, Milley, whose four-year term as chairman, and 43-year career as an Army officer, will conclude at the end of September, has been condemned by elements of the far right. Kash Patel, whom Trump installed in a senior Pentagon role in the final days of his administration, refers to Milley as “the Kraken of the swamp.” Trump himself has accused Milley of treason. Sebastian Gorka, a former Trump White House official, has said that Milley deserves to be placed in “shackles and leg irons.” If a second Trump administration were to attempt this, however, the Trumpist faction would be opposed by the large group of ex-Trump-administration officials who believe that the former president continues to pose a unique threat to American democracy, and who believe that Milley is a hero for what he did to protect the country and the Constitution.

“Mark Milley had to contain the impulses of people who wanted to use the United States military in very dangerous ways,” Kelly told me. “Mark had a very, very difficult reality to deal with in his first two years as chairman, and he served honorably and well. The president couldn’t fathom people who served their nation honorably.” Kelly, along with other former administration officials, has argued that Trump has a contemptuous view of the military, and that this contempt made it extraordinarily difficult to explain to Trump such concepts as honor, sacrifice, and duty.

Robert Gates, who served as secretary of defense under Presidents George W. Bush and Barack Obama, told me that no Joint Chiefs chairman has ever been tested in the manner Milley was. “General Milley has done an extraordinary job under the most extraordinary of circumstances,” Gates said. “I’ve worked for eight presidents, and not even Lyndon Johnson or Richard Nixon in their angriest moments would have considered doing or saying some of the things that were said between the election and January 6.”

Gates believes that Milley, who served as his military assistant when Gates was Bush’s secretary of defense, was uniquely qualified to defend the Constitution from Trump during those final days. “General Milley expected to be fired every single day between Election Day and January 6,” he said. A less confident and assertive chairman might not have held the line against Trump’s antidemocratic plots.

When I mentioned Gates’s assessment to Milley, he demurred. “I think that any of my peers would have done the same thing. Why do I say that? First of all, I know them. Second, we all think the same way about the Constitution.”

Some of those who served in Trump’s administration say that he appointed Milley chairman because he was drawn to Milley’s warrior reputation, tanklike build, and four-star eyebrows. Senator Angus King of Maine, a political independent who is a supporter of Milley’s, told me, “Trump picked him as chief because he looks like what Trump thinks a general should look like.” But Trump misjudged him, King said. “He thought he would be loyal to him and not to the Constitution.” Trump had been led to believe that Milley would be more malleable than other generals. This misunderstanding threatened to become indelibly ingrained in Washington when Milley made what many people consider to be his most serious mistake as chairman. During the George Floyd protests in early June 2020, Milley, wearing combat fatigues, followed Trump out of the White House to Lafayette Square, which had just been cleared of demonstrators by force. Milley realized too late that Trump, who continued across the street to pose for a now-infamous photo while standing in front of a vandalized church, was manipulating him into a visual endorsement of his martial approach to the demonstrations. Though Milley left the entourage before it reached the church, the damage was significant. “We’re getting the fuck out of here,” Milley said to his security chief. “I’m fucking done with this shit.” Esper would later say that he and Milley had been duped.

For Milley, Lafayette Square was an agonizing episode; he described it later as a “road-to-Damascus moment.” The week afterward, in a commencement address to the National Defense University, he apologized to the armed forces and the country. “I should not have been there,” he said. “My presence in that moment and in that environment created a perception of the military involved in domestic politics.” His apology earned him the permanent enmity of Trump, who told him that apologies are a sign of weakness.

Joseph Dunford, the Marine general who preceded Milley as chairman of the Joint Chiefs, had also faced onerous and unusual challenges. But during the first two years of the Trump presidency, Dunford had been supported by officials such as Kelly, Mattis, Tillerson, and McMaster. These men attempted, with intermittent success, to keep the president’s most dangerous impulses in check. (According to the Associated Press, Kelly and Mattis made a pact with each other that one of them would remain in the country at all times, so the president would never be left unmonitored.) By the time Milley assumed the chairman’s role, all of those officials were gone—driven out or fired.

At the top of the list of worries for these officials was the manage­ment of America’s nuclear arsenal. Early in Trump’s term, when Milley was serving as chief of staff of the Army, Trump entered a cycle of rhetorical warfare with the North Korean dictator Kim Jong Un. At certain points, Trump raised the possibility of attacking North Korea with nuclear weapons, according to the New York Times reporter Michael S. Schmidt’s book, Donald Trump v. The United States. Kelly, Dunford, and others tried to convince Trump that his rhetoric—publicly mocking Kim as “Little Rocket Man,” for instance—could trigger nuclear war. “If you keep pushing this clown, he could do something with nuclear weapons,” Kelly told him, explaining that Kim, though a dictator, could be pressured by his own military elites to attack American interests in response to Trump’s provocations. When that argument failed to work, Kelly spelled out for the president that a nuclear exchange could cost the lives of millions of Koreans and Japanese, as well as those of Americans throughout the Pacific. Guam, Kelly told him, falls within range of North Korean missiles. “Guam isn’t America,” Trump responded.

According to ProPublica, the justice developed a friendship with the Kochs as they were funneling hundreds of millions of dollars into right-wing causes, many of which ended up before the Supreme Court. The brothers then used Thomas to raise money for their sprawling network, inviting him to speak at “donor events” that brought in millions of dollars. He disclosed none of these activities on his annual disclosure forms, an obvious violation of federal ethics law.
