Texas Gov. Greg Abbott craved a showdown with President Joe Biden over illegal immigration. He wanted a test case that would give the Supreme Court a chance to expand states’ authority over unauthorized immigrants. He wanted to shift jurisdiction over the southern border from the federal government to the state of Texas.

What he got, instead, was a dispute over the Rivers and Harbors Appropriation Act of 1899.

Abbott’s scheme to seize control over immigration enforcement crashed against that law on Monday, when Biden’s Department of Justice filed a lawsuit against Texas. At Abbott’s direction, state officials constructed a 1,000-foot barrier in the Rio Grande designed to block migrants from crossing the river. The governor justified the project in a letter to Biden by asserting Texas’ alleged prerogative to defend itself against “invasion,” teeing up a constitutional confrontation. But he and his lawyers appear to have overlooked a more mundane problem with this plan: Federal law prohibits any state from obstructing a navigable waterway like the Rio Grande without a permit from the Army Corps of Engineers. Abbott’s brawl over the border is fizzling into a dispute for permitting—one that the governor will lose.

So far, Operation Lone Star (only a single 1,000-foot barrier) has had no evident impact on unlawful border crossings, and many Texas Guardsmen—who receive none of the benefits awarded to federal agents—have nothing to do; suicide and criminal conduct are rising in their ranks.

Americans mostly hate Republican cultural beliefs

Jonathan Chait has a long piece in New York about the right's latest "master theory" of political war: namely that ever since the '60s the left has engaged in a cultural "long march" that has steadily taken over practically every influential American institution—entertainment, universities, big business, etc.—and the only hope for conservatives is to wage a scorched-earth counter-revolution from within the government. Why government? Because it's the only institution they still have a chance of controlling. Now, some of this has an obvious element of truth, but other parts are faintly ridiculous. Big corporations might spout crowd-pleasing slogans now and then, but they're still a Republican stronghold. Just check out the Chamber of Commerce or the Business Roundtable if you're unsure of this. The military remains steadfastly conservative regardless of their pragmatic stance toward gay and trans recruits. The Supreme Court is dominated by conservatives. Churches that involve themselves in the culture wars are strongly conservative.

So the liberal domination of institutions is a little less complete than the "long march" theorists would have you believe. But the real weakness of their argument is simpler: public opinion is what really matters. Institutions are always downstream of public opinion, changing only after the public demands it. And the plain fact is that conservative social attitudes are overwhelmingly unpopular. Just to run through some of the most obvious examples:

• Opposition to abortion remains limited. Solid majorities say abortion should be legal in all or most circumstances and that women should be allowed to have abortions "for any reason." Bans on abortion have never been popular and are even less so now. They poll in the mid-teens following the Dobbs decision.

• Only about a third of the country still wants to ban gay marriage.

• Immigration remains polarized, but there's little support for abolishing policies like DACA. Even a majority of Republicans oppose getting rid of it.

• Less than a third of Americans want to keep marijuana illegal.

• Virtually no one opposes sex education in schools and less than a third support the conservative insistence that sex ed classes should exclusively teach the benefits of abstaining from sexual activity.

• At the time they were taking place, only a third of Americans opposed the George Floyd protests. To this day, only a minority think the police treat white and Black people equally.

• Transgender issues are still new and fraught, but a core belief in protecting trans people from discrimination in jobs, housing, and general public acceptance generates only tiny opposition.

• Only a third of the country believes that churches should be involved in politics. Less than a quarter think churches should endorse candidates. Only small minorities think the government should favor Christianity. And only about a quarter think the religious freedom of Christians is threatened.

• Only about 15% of Americans think gun laws should be loosened. About a third oppose background checks, high-capacity magazines, and bans on assault weapons. That said, this is one of the very few issues where conservative views, broadly speaking, retain fairly high support.

• Taken as a whole, we can say that public opinion remains split on guns and immigration, but in virtually every other area conservative social attitudes are strongly unpopular. Even on the semi-cultural question of raising taxes on the rich, only a quarter of Americans share conservative opposition to the idea.

There are obviously still polarized opinions on the newer and more extreme borders of cultural issues—things like wokeness, puberty blockers for minors, and trans women in sports. There always is until enough time has passed for public opinion to settle down. Generally speaking, though, conservatives have simply lost the country on cultural issues. That's their problem, not the fact that institutions have followed along.

You think I care about this trivia that you think is important? Hunter Biden is a crook and therefore the Democrats are crooks? I don't care. Hunter got off easy and therefore the Democrats are at fault? I don't care. All that proves is that the court system is underfunded and slow because the GOP wants it that way, forcing prosecutors to make deals rather than go to trial. It doesn't mean Democrats are bad. The IRS doesn't collect a trillion per year in taxes, but I don't blame the Democrats because it is Republicans who are under-funding the IRS. The emissions of CO2 are growing constantly, but I don't blame the Democrats because it is Republicans who want cheap gasoline, and more coal mining, and "Climate Change is a Chinese Hoax" is a strongly held Republican belief of Texas Trumptards.

I will try to simplify this for you, one more time: Every Trump defender I know, every GOP voter I know, I knew them to be unreliable and crooked long before Trump came along. Sadly, some Democrats are the same, but not all of them. I am Democrat because the people who vote for Republicans or defend Trump are all crooks in my experience. I don't know every Republican and every Trump supporter, but I know a large enough sample to decide that the entire GOP is a bunch of extremely defective people.

A program that’s saved 25 million lives is at risk of losing its congressional authorization for the first time.

You may not have heard of the President’s Emergency Plan for AIDS Relief (PEPFAR). But you should: It has saved more lives than any other US government policy in the 21st century. And now, for the first time in the program’s history, it is at risk of losing a critical vote in Congress — for reasons that say a lot about today’s Republican Party.

First passed in 2003 under President George W. Bush, PEPFAR is a vehicle for distributing HIV/AIDS drugs to people in poor countries who wouldn’t otherwise have access to them. It has been astonishingly effective: The most recent US government estimates suggest it has saved as many as 25 million lives since its enactment. It is currently supporting treatment for over 20 million people who depend on the program for continued access to medication.

Given its success, PEPFAR has historically enjoyed bipartisan support. In 2018, Congress reauthorized PEPFAR for another five years without a fuss. But this time around, things look different. Some House Republicans, prodded by an array of influential groups, are threatening to block another five-year reauthorization. Their argument is pure culture war: that PEPFAR has become a vehicle for promoting abortion.

In reality, PEPFAR is legally prohibited from funding abortion services, and the argument against the program on anti-abortion grounds is very thin. But in today’s political climate, where the culture war reigns supreme on the right, this is enough to jeopardize the continued good functioning of a program that the Republican Party used to champion.

This Sunday, it will be 58 years since July 30, 1965 — the day LBJ signed Medicare and Medicaid into law. Two days before, it had passed the Senate 70-24. Seventeen Republicans voted against it.

The Republicans who voted for it — mainly liberal Northeast Senators like Jacob Javits of New York — would no doubt be Democrats today.

Ronald Reagan spoke out against Medicare and Medicaid, calling them “socialized medicine,” and saying they would “supplant private savings and curtail Americans’ freedom.”

Instead, Medicare and Medicaid have expanded Americans’ freedom. The freedom to get medical care when they need it. The freedom to live a longer, healthier life. Yet, to this day, the majority of Republicans remain hostile to everything they deem “socialized medicine.”

When we passed the Affordable Care Act in 2010, we got not one Republican vote. And they fell just one vote short of repealing the ACA in 2017.

When Democrats passed the Inflation Reduction Act, it included a provision giving Medicare the power to negotiate the price of pharmaceuticals. Not one Republican voted for it. Even though Americans pay two to three times as much as Europeans do for the same pharmaceuticals.

At first, in the lead-up to the debt ceiling crisis, Republicans said they wanted to make cuts to Medicaid and Medicare. They backed down only when they heard the outcry from millions of Americans, including Republicans.

But make no mistake. If Republicans take the White House and one or both houses of Congress after the 2024 election, Americans will see drastic cuts in these programs.

The question of why Donald Trump manages to maintain such a grip on the Republican base, to the point where he can remain a nationally viable candidate despite all of his misdeeds and legal woes, is one of the most important issues in American politics. It’s a subject that has been explored extensively, with the best evidence converging on the same general story: Trump is the avatar of a kind of resentful reactionary politics, one uncomfortable with a changing America, that defines the worldview of a plurality (if not a majority) of the GOP faithful.

But this answer offers few easy solutions and makes some people uncomfortable, as it feels a bit too much like a judgment of Trump supporters. So we get efforts to reject the evidence, often relying on long-debunked alternative arguments.

The best evidence typically points toward identity-based explanations: Racial and cultural conflicts are far, far more important than the kind of economic alienation Brooks wants to highlight. This is true not only in the United States but in other countries facing similar challenges from far-right populist movements.

The overwhelming evidence for a cultural explanation

This story starts with the late 20th-century revolution in social values: the end of segregation, mass nonwhite immigration, feminist challenges to patriarchy, a decline in traditional Christianity, and the rise of the LGBTQ movement. This revolution has transformed America at fundamental levels: the kinds of people who hold positions of power, the ideas that command cultural respect, and even the kinds of food Americans eat and languages they speak in public.

For millions of Americans, these changes made them feel unmoored from their country— “strangers in their own land,” as the sociologist Arlie Hochschild put it. Whether because of pure bigotry or a more diffuse sense of cultural alienation from the mainstream, a large number of Americans came to believe that they are losing America. For historical reasons owing largely to the legacy of the civil rights movement, these voters became concentrated in the Republican party — forming at least a plurality of its primary electorate. The election of Barack Obama, a self-described “Black man with a funny name,” pushed their sense of social alienation to the breaking point.

This cultural anxiety created room for Trump, who rode this group’s collective resentments to control of the Republican party. We know this, primarily, because social scientists have been testing the theory since 2016 — and comparing it with Brooks’s preferred explanations rooted in resentment at a rigged economic game. Again and again, the cultural theory has won out.

For example, in 2018, a trio of scholars used survey data to compare explanations of Trump support based on racism, sexism, and a sense of economic alienation. The former two are far more powerful predictors than the latter, almost entirely explaining Trump’s surge in support among white non-college voters.

A 2018 paper by Alan Abramowitz and Jennifer McCoy, two leading political scientists, found: “After party identification, racial/ethnic resentment was by far the strongest predictor of relative ratings of Trump and Clinton — the higher the score on the racial/ethnic resentment scale, the more favorably white voters rated Trump relative to Clinton,” they write. “The impact of the racial/ethnic resentment scale was much stronger than that of any of the economic variables included in the analysis, including opinions about free trade deals and economic mobility.”

There are dozens of other papers, reports, and even entire books coming to similar conclusions.

There was a time when the two major political parties in America could exhibit bipartisanship by moving across the aisle to compromise on the issues on which they were legislating. Tried and true Republicans who favored small government, lower taxes, and national security could find a middle ground with Democrats who pushed for things like universal healthcare, higher minimum wages, and progressive tax reform. There were largely two sides to the issues and some areas for compromise.

This is no longer possible in today’s sociopolitical climate.

Cult thinking includes ardent adherence to group thinking such as – clinically speaking, in the face of distorted thinking we ask about one’s strength of conviction by querying, ”Can you think of other ways of seeing this?” Sadly, what we are seeing publicly is ‘No’ from those who still subscribe to Trumpism/MAGA.

Here are a few examples in today’s socio-political environment in which cultism has contributed to a lack of middle ground.

There is no middle ground on treasonous, conspiratorial, fraudulent behavior – these are crimes and, arguably, the worst crimes one could commit against their own country.

There is no middle ground on slavery.

There is no middle ground on allowing Americans to die through inaction in response to natural disasters and global health crises.

There is no middle ground on gunning down school children or wearing an AR-15 rifle pin and throwing away a pin to remember a Uvalde victim.

There is no middle ground on jeopardizing national security and retaining and sharing classified documents.

There is no middle ground on breaking campaign finance (i.e., hush money schemes) laws.

There should be no middle ground on tolerance of crime, period.

And so many know this. Tim Scott, Jim Jordan, and Marco Rubio (the last two having gone to law school), all know this and are smarter than they are acting – which takes us back to cult dynamics – if you are a dyed-in-the-wool cultist or pretending to be a cultist – but the outcome is the same – harm to the Country and its people – there is no difference. Whether you actually have a personality disorder or are pretending to be a sociopathically or psychopathically disordered person – if the result is the same – harm to your constituents and your country – what’s the difference? As noted in the opening paragraphs, there is a voluntary submission to cultism – Rubio, for example, identified all of the reasons why the 45th President was not qualified when he himself was running for President in 2016. To name a political figure, or any prominent U.S. person, in a domestic intelligence assessment is taboo. Intelligence analysts and the agencies that oversee them are taught to not politicize threat assessments. To do so would potentially run afoul of civil rights and civil liberties and the First Amendment.

But times have drastically changed since the Trump presidency began. Even as the homeland security profession has resisted involving itself in politics, politically motivated violence has emerged as a major threat to our homeland. This has led to the rise of stochastic terrorism, which occurs when prominent figures demonize, marginalize or openly target a specific group or individual and violence ensues.

Trump’s affinity for violent extremists and conspiracy theorists is an unspoken concern for many homeland security professionals. Throughout his presidency, he consistently failed to condemn white supremacists and far-right militia groups and created an environment ripe for potential violence. More importantly, the legitimization of extremists and so-called “patriots” by Trump and other prominent Republicans has helped them win converts to their violent ideologies.

And he does so in the political arena, where careers have been ruined for far less.

Consider Howard Dean’s infamous yell. Or President Bush 41 checking his watch. Or Hillary Clinton’s use of the word “deplorables.” Or Michael Dukakis in that tank helmet.

National-level politicians are subjected to a withering standard of scrutiny before a public audience that is seemingly ultra-sensitive to foibles and faux pas.

Yet even in an environment as discerning as national politics, Trump endures.

He can seemingly neither do nor say anything sufficiently offensive to discredit himself – which speaks to Trump’s status as the most resilient politician, perhaps, ever, and to his transcendence beyond just a mere politician to an iconoclastic demagogue.

Donald Trump can seemingly say whatever he wants

By now, Trump has said something to offend just about everyone.

Trump has made so many controversial, offensive, off-putting, and weird remarks that it’s become difficult to keep track of what he said and when.

Most politicians would have ended their careers if they uttered just a few syllables worth of what Trump has been spewing consistently for the better part of a decade.

But that’s just it with Trump; he’s not a normal politician.

In the eyes of his most loyal followers, Trump is the anti-politician.

Trump’s 2016 messaging – which framed Trump as the ultimate outsider, who would go to Washington to drain the swamp, who would speak for the swaths of constituents that mainstream politicians had been neglecting for a generation, who wouldn’t be bullied – has stuck.

In effect, what Trump has done is created a scheme in which all mainstream criticism against Trump serves to validate the narrative that Trump is an outsider with powerful enemies. Trump’s brilliance lies in his ability to essentially invert criticism. What happens is that the things that are said or done in an attempt to degrade Trump or to impeach Trump’s character, serve only to make him stronger in the eyes of the base.

Through that scheme, Donald Trump has built himself a buffer to say or do whatever he wants, which he exploits. Trump knows that a large part of his appeal, his perceived charm, stems from his willingness to speak and act in a way that is unconventional.

And that’s exactly what Trump does.

He says what he wants, off-the-cuff, knowing that it will boost his appeal.

So, to all the observers sitting around waiting for the day that Donald Trump will say something that finally ruins his political viability, I would advise not to hold your breath. With respect to verbal accountability, Trump is an anomaly. If Trump’s political career implodes, it will not be because of something he says. If that were going to happen it would have happened a long time ago.

Trump is absolutely going to be relevant throughout the 2024 election – and perhaps longer.

He’s going to say crazy stuff throughout, the press is going to cover it ravenously – and it’s only going to bolster his appeal amongst his base.

Step back and look at a map of life expectancy across the country and the geographic patterns are as dramatic as they are obvious. If you live pretty much anywhere in the contiguous U.S., you can expect to live more than 78 years, unless you’re in the Deep South or the sprawling region I call Greater Appalachia, a region that stretches from southwestern Pennsylvania to the Ozarks and the Hill Country of Texas. Those two regions — which include all or parts of 16 deep red states and a majority of the House Republican caucus — have a life expectancy of 77, more than four and a half years lower than on the blue-leaning Pacific coastal plain. In the smaller, redder regional culture of New France (in southern Louisiana) the gap is just short of six years. So large are the regional gaps that the poorest set of counties in predominantly blue Yankee Northeast actually have higher life expectancies than the wealthiest ones in the Deep South. At a population level, a difference of five years is like the gap separating the U.S. from decidedly unwealthy Mongolia, Belarus or Libya, and six years gets you to impoverished El Salvador and Egypt.

It’s as if we are living in different countries. Because in a very real historical and political sense, we are.
