For nearly half a century, Americans have lived under a legally incorrect and morally bankrupt court decision that created, out of thin air, a constitutional “right” to abortion. Roe v. Wade was an act of raw, partisan political will of unelected judges, and it had no basis in the text of the U.S. Constitution then or now. Today we celebrate Roe’s reversal, mindful that nothing can bring back the millions of lives lost since the Supreme Court federalized abortion policy and prohibited States from fully protecting their most vulnerable citizens. Thankfully, the current Court has finally acted to overturn this egregious act of unconstitutional judicial activism.

Texans want to know what to expect now that Roe is overturned. The answer is that without further action by the Texas Legislature, abortion will soon be clearly illegal in Texas. In 2021, the Texas Legislature passed the Human Life Protection Act of 2021 (“the Act”), which prohibits abortions in most circumstances and takes effect on the 30th day after “issuance of a United States Supreme Court judgment in a decision overruling, wholly or partly, Roe v. Wade. 410 U.S. 113 (1973), as modified by Planned Parenthood v. Casey, 505 U.S. 833 (1992), thereby allowing the states of the United States to prohibit abortion.”

(This is where the law says abortion is homicide without saying abortion is homicide, which is political poison, but a prosecutor can read this law and charge the woman with homicide, or even murder.)

By the way, Supreme Court Justice Clarence Thomas said that he would be pleased with overturning/reversing/nullifying all previous court decisions ruling that state laws forbidding contraception were NOT constitutional. In Thomas' opinion the states can do whatever they please about contraception because the word "contraception" is not in the Bill of Rights.

H.R.8373 was written to stop Clarence Thomas and the other Catholics Republicans on the Supreme Court, but they won't be stopped because no Republican Senators will vote for it. The bill was received in the Senate on 07/21/2022 but there has been no action, yet, because the Democrats know for sure that the Republicans will filibuster the bill for the same stupid reason Clarence Thomas gave: the word "contraception" is not in the Bill of Rights and therefore any state that wishes to forbid contraception can make it illegal as the Catholic Church wants.

The House will vote Thursday to protect access to contraception nationwide after Clarence Thomas suggesting overturning it.

The Dystopian Myths of Red America

The Big Lie about the election is embedded in an even bigger lie.

Desensitization is an amazing thing. At this point most political observers simply accept it as a fact of life that an overwhelming majority of Republicans accept the Big Lie that the 2020 election was stolen — a claim with nothing to support it, not even plausible anecdotes.

What I don’t think is fully appreciated, however, is that the Big Lie is embedded in an even bigger lie: the claim that the Democratic Party is controlled by radical leftists aiming to destroy America as we know it. And this lie in turn derives a lot of its persuasiveness from a grotesquely distorted view of what life is like in blue America.

Urban elites are constantly accused of not understanding Real America™. And, to be fair, most big-city residents probably don’t have a good sense of what life is like in rural areas and small towns, although it’s doubtful whether this gap justified the immense number of news reports interviewing Trump voters sitting in diners.

But I’d argue that right-wing misperceptions of blue America run far deeper — and are far more dangerous.

Let’s start with the politics. The other day The Washington Post’s Dave Weigel, reporting from the campaign trail, noted that many Republican candidates are claiming that Democrats are deliberately undermining the nation and promoting violence against their opponents; some are even claiming that we’re already in a civil war.

Some (many?) of these candidates have been winning primaries, suggesting that the G.O.P. base agrees with them. Actually, I’d like to see some surveys along the lines of those showing that most Republicans accept the Big Lie. How many Republicans believe that President Biden and other leading Democrats are left-wing radicals, indeed Marxists?

Relatedly, I’d like to know how many Republicans believe that Black Lives Matter demonstrators looted and burned large parts of America’s major cities.

Now, the reality is that the modern Democratic Party is a mildly center-left coalition, consisting of what Europeans would call social democrats, and relatively conservative ones at that. To take one measure, I can’t think of any prominent Democrats — actually, any Democratic members of Congress — who have expressed admiration for any authoritarian foreign regime.

This is in contrast to widespread conservative admiration for Hungary’s Viktor Orban, who recently denounced other Europeans for “mixing with non-Europeans” and declared that he doesn’t want Hungary to become a “mixed-race” country.

On the domestic violence front, a study by the Anti-Defamation League found that 75 percent of extremist-related domestic killings from 2012 to 2021 were perpetrated by the right and only 4 percent by the left.

Finally, about B.L.M.: The protests were, in fact, overwhelmingly peaceful. Yes, there was some arson and looting, with total property damage typically estimated at $1 billion to $2 billion. Here’s one point of comparison. Back in April, Greg Abbott, the governor of Texas, pulled a political stunt at the border with Mexico, temporarily imposing extra security checks that caused a major slowdown of traffic, disrupting business and leading to a lot of spoiled produce. Total economic losses have been estimated at around $4 billion; that is, a few days of border-security theater appear to have caused more economic damage than a hundred days of mass protests.

Yet pointing out these facts probably won’t change many minds. Nor does there seem to be any way to change the perception, also alluded to in that Post article, that a lax attitude toward law enforcement has turned America’s big cities into dangerous hellholes. It’s true that violent crime rose during the pandemic, but it rose about as much in rural America as it did in urban areas. And despite that recent rise, violence in many cities is far lower than it was not long ago.

In New York City, homicides so far this year are running a bit below their 2021 level, and in 2021 they were 78 percent lower than they were in 1990 and a quarter lower than they were in 2001. As Bloomberg’s Justin Fox has documented, New York is actually a lot safer than small-town America. Los Angeles has also seen a big long-term drop in homicides, as has California as a whole. Some cities, notably Philadelphia and Chicago, are back to or above early 1990s murder rates, but they’re not representative of the broader picture.

But who among the Republican base will acknowledge this reality? Whenever I mention New York’s relative safety, I get a wave of mail saying, in effect, “You can’t really believe that.”

The fact is that a large segment of the U.S. electorate has bought into an apocalyptic vision of America that bears no relationship to the reality of how the other half thinks, behaves or lives. We don’t have to speculate about whether this dystopian fantasy might lead to political violence and attempts to overthrow democracy; it already has. And it’s probably going to get worse.

Trump returns to DC with apocalyptic speech: ‘Our country is going to hell’

The former president addressed a conservative think tank in Washington, where he painted a picture of a Democrat-run nation overrun by criminals and the homeless

Donald Trump on Tuesday returned to Washington DC for the first time since leaving office, over a year and a half after the January 6, 2021 attack on Capitol Hill currently under investigation by a congressional committee.

Speaking at an event organized by the America First Policy Institute, a think tank he helped fund, the former president delivered a speech riddled with inaccuracies and falsehoods in which he exaggerated the achievements of his administration, presented himself as a victim of the system, and focused on public safety, law enforcement and protection of the border with Mexico.

“Our country is going to hell, and it’s going to hell very fast,” he asserted, painting an apocalyptic landscape of crime-ridden cities controlled by Democrats that have become “war zones.” Trump described green areas taken over by homeless encampments, stores where criminals steal merchandise with complete impunity, and “sadists who prey on children and are released on bail.”

Trump, who is flirting with a new presidential run in 2024, promised to impose the death penalty for drug traffickers if he returns to power. “America first must mean safety first,” he said, supporting being “tough, nasty, mean if we have to, to restore public safety.” He also supported a return to “stop and frisk” policies and attacked the “ridiculous” idea of defunding the police.

Trump referred to “the anti-police narrative of the radical left” as “the big lie,” in a sarcastic reference to the way the media refers to the conspiracy theory he still espouses, according to which the 2020 election was stolen from him. “Have you ever heard that expression before?”

It was the first time in 566 days that Trump was seen in a public act in DC. The last time had been January 6, 2021, when he harangued thousands of his followers to march on Capitol Hill in a bid to influence the certification of the electoral votes that gave the presidential victory to Joe Biden. The insurrection that followed, which endangered the lives of hundreds of police officers, is the target of a criminal investigation by the Department of Justice, as well as a probe by a congressional committee that last Thursday provided evidence that during the three hours that the assault lasted, Trump sat back and did nothing to stop the violent mob, even though he was “the only person on the planet capable of sending them home.”

Trump Got Burned by a Major Mistake in His First Term. He Won’t Make It Again.
(It is quite possible that any populist Republican would exploit Schedule F. It’s not just Trump. )

There’s a reason authoritarians target the bureaucracy. Once they have it under their control, they are better able to stifle dissent and criticism, reward friends and punish enemies, using the levers of government to maintain power. In his first term, Donald Trump largely failed to take control of the administrative state, that sprawling web of agencies that keeps the federal government running. To be sure, he ignored scientists and punished bureaucrats. But Trump’s officials largely lacked the capacity to manage the institutions they were charged with leading.

Trump will not make the same mistake twice. According to Jonathan Swann’s blockbuster two-part Axios report, the former president is currently overseeing plans to build a government based on personal loyalty to him. Trump’s weapon to disembowel government is an executive order he signed shortly before the 2020 election: Schedule F. It allows a president to force tens and potentially hundreds of thousands of career officials to become political appointees, stripping them of job protections. In short, it allows the president to fire civil servants who fail his political loyalty test.

Trump ran out of time before he could implement Schedule F, and Biden rescinded it. But if Trump wins in 2024, an aggressive purge of the civil service will be one of his first priorities.

When he was elected Trump’s use of the “swamp” and “deep state” terminology tapped into conspiracy theories much the same way that he tapped into birtherism, albeit more symbolically than with a strategic intent. He still hired institutionalists, like James Mattis and John Kelly, and even allowed some bipartisan Obama appointees to remain in place.

By the end of his first term, Trump absolutely understood the importance of controlling the bureaucracy. He became convinced that career public servants were responsible for his first impeachment. While Trump largely blocked political appointees from co-operating with the impeachment investigation, a number of career officials did testify.

The White House followed through on a promise of payback against these officials, publicly attacking some, removing them from positions, and denying promotions to the degree the law allowed. It is easy to imagine that with Schedule F, Trump’s payback would have been more comprehensive, simply firing all the officials who dared to respond to Congress, as he did to the inspector general who forwarded the whistleblower complaint about Trump’s withholding arms to Ukraine.

Trump struggled to direct the government because he lacked a deep bench of talented and loyal appointees. In Axios, Swann documents the massive scale of operations in place intended to not just fill existing appointments, but replace careerists by taking advantage of Schedule F.

There are multiple overlapping organizations in Trump World, a fully stocked army of loyalists ready to take control of government: the Center for Renewing America, Conservative Partnership Institute, Personnel Policy Organization, the American First Policy Institute, and the old standby of the Heritage Foundation. They are not just building a database of resumes; each institution has drawn on personnel involved in creating Schedule F and looks forward to exploiting it. Millions of dollars from conservative donors, including the Koch network, are funding their efforts. They are also funding a barely-disguised attack on American democracy.

Proponents of Schedule F presented it as a way of improving government performance by firing poor performers, and improving political responsiveness. Swann’s detailed reporting shows that the goal, instead, is a form of authoritarian control. This is reflected in a primary desire to take control of the national security and justice apparatus. Trump’s inability to capture these institutions stymied his coup attempt. If the top lawyers are Trump loyalists, the most outrageous power grabs and misdeeds will be declared legal, with the implicit backing of the military.

More politicized government workplaces result in lower employee capacity and performance. Swann’s reporting underlines that the types of candidates being sought for Trump World are loyalists first. Relevant experience, or a desire to work in the federal government for the long haul are viewed as a negative. Instead, the ideal candidate is someone who does not believe in government, who has a chip on his shoulder about the system. It would be a government of angry young men, who will not understand what they are doing and do not care.

Schedule F would burn down the civil service system. It would be a government of the lawless leading the incompetent.

I've said that I'm never going to make more than the standard deduction for the rest of my life and I will not be paying FEDERAL taxes, because I don't agree at all with how they spend that money. I brag because I've set myself up for a life where I have a house and car that are mine and zero debt to anybody else so I can EASILY do that for the rest of my life whenever I feel the need to work without ever having to worry about how what small amount of bills and cost of living I have will be paid.

I’m not sure what Americans were like in the 18th and 19th century, but they have to have been a lot tougher, less whining, less self-important and paradoxically more exceptional without thinking they were exceptional than Americans of today.

First, would the law, in fact, reduce inflation? Yes, probably — or at least it would reduce inflationary pressures. That’s because the legislation’s increased spending, mainly on clean energy but also on health care, would be more than offset through its tax provisions; so it would be a deficit reduction act, which other things being equal would make it disinflationary.

But you want to think of the Inflation Reduction Act as being like the National Interstate and Defense Highways Act of 1956, which probably did strengthen national defense a bit but mainly benefited America by investing in the nation’s future. This bill would do the same, and maybe even more so.

To understand why this bill inspires so much hope, it’s helpful to understand what has changed since Democrats’ last big effort to deal with climate change, the 2009 Waxman-Markey bill, which passed the House but died in the Senate.

The core of Waxman-Markey was a “cap and trade” system that would, in practice, have operated a lot like a carbon tax. There were and are good arguments for such a system, which would give companies and individuals an incentive to cut emissions in multiple ways. But politically, it was easy to portray it as an eat-your-spinach plan, one demanding sacrifices from ordinary workers.

With the failure of Waxman-Markey, the Obama administration was reduced to a much more limited agenda, one that relied on carrots rather than sticks — tax breaks for clean energy, loan guarantees for companies investing in renewables. I think it’s fair to say that most economists didn’t expect these measures to achieve much.

But a funny thing happened on the way to the climate apocalypse: There was revolutionary progress in renewable energy technology, probably jump-started, at least in part, by those Obama-era policies. In 2009, electricity generated by wind power was still more expensive than electricity generated by burning coal, and solar power was more expensive still. But over the next decade wind power costs fell 70 percent, solar costs 89 percent.

Add in plunging battery prices and it has become possible to see the outlines of an economy that achieves drastic reductions in carbon emissions with little if any sacrifice, using electricity generated by renewable energy — as opposed to burning fossil fuels — to heat and cool our buildings, run our factories, power our cars and more.

The climate portion of the Inflation Reduction Act is, for the most part, an attempt to accelerate that energy transition, mainly by offering tax credits for the adoption of low-emission technologies, including electric vehicles, but also by offering incentives to use less energy in general, notably by making buildings more energy efficient.

There’s every reason to believe that these measures would have large effects. Unlike fossil fuels, which have been around for a long time, renewable energy is still an “infant industry” with a steep learning curve: The more we use these technologies, the better we get at them. So providing incentives for clean energy now will make that energy a lot cheaper in the future.

And support for electric vehicles also helps solve a chicken-and-egg problem, in which drivers are reluctant to go electric because they aren’t sure they’ll find charging stations, and businesses don’t provide many charging stations because there aren’t yet that many electric cars.

The point is that while the climate and energy provisions in the Inflation Reduction Act — about $370 billion over the next decade — would be only about 0.1 percent of projected gross domestic product over the same period, they could well have a catalytic effect on the energy transition.

And they could also transform the political economy of climate policy.

For years, environmentalists have been arguing that transitioning to clean energy should be considered an opportunity rather than a burden — that in addition to saving the planet, the transition would create many jobs and new business opportunities. But that’s a hard point to get across without widespread concrete examples of success. As long as serious climate policy was a proposal, not a reality, it was vulnerable to attacks from right-wingers portraying it as a nefarious plan to undermine the American way of life.

But those attacks will become less effective once people start to see the real-world effects of climate action (which is why the right is so frantic about trying to block this legislation).
If Democrats can pass this bill, the chances of additional action in the future will rise, perhaps sharply.

So let’s hope there aren’t any last-minute snags. The Inflation Reduction Act won’t deliver everything climate activists want. But if it happens, it will be a major step toward saving the planet.

I’m not sure what Americans were like in the 18th and 19th century, but they have to have been a lot tougher, less whining, less self-important and paradoxically more exceptional without thinking they were exceptional than Americans of today.

Even Americans born well into the 20th century had a stoic quality and a modest sense of their own importance that seems to have been washed out of our culture. Not many WWII veterans left, but the ones I’ve met spoke about their battles at Normandy or in the South Pacific as just something that needed to get done. The people I knew who lived through The Great Depression said it was tough but made light of their own hardships.

I fear that to other countries we look like one of those screaming toddlers having a fit in a very public place. Sort of an international cringe.

The city I grew up in has had two drive by shootings this summer as well as a guy who got shot inside his house for yelling out the window at 4:30AM when he woke up to noise and saw 4 hooded thugs in his neighbor's driveway breaking into his car. It used to be a nice neighborhood.

During the 2022 midterm, there are a couple of ways in which the Democratic appeal is essentially that they will act as a counterweight against an out-of-step Republican party.

Accordingly, a vote for Democrats is a vote against a powerful foe — not an incumbent administration, but a government-in-waiting and its accomplices.

I heard the same complaints against Democrats from my East Texas relatives continuously from 1965 until today. Every problem was the fault of Democrats. When Republicans took control of the county government and state, still the same complaint that problems were the fault of Democrats. I know my relatives. Their problems couldn't be corrected by any elected official, but my relatives aren't the kind that understand they and well known local people living close-by (a greedy employer, an incompetent manager, a cheating-lying store owner) are the real problem, not some Democrat they heard about in the news. But my relatives are afraid of these very real people they see all the time. My relatives are much braver and more vocal attacking people they will never know in person.
