The bad news for Democrats is that this is an obvious concession that they know their days are numbered and that there is zero chance that they're going to be able to pack the Supreme Court before November.

Yeah. I'm sure that was the plan.

My guess is that Breyer didn't want to retire, but there was a lot of pressure and some closed door discussions where he was made an offer he couldn't refuse. He certainly didn't seem quick to announce a retirement that everyone else knew of before hand. If you watch Diversity Hire Jen Psaki's press conference yesterday, she even jokingly referred to his retirement as hypothetical and the room full of press agents got a good laugh of it.



Don't ask me where in the video it was. I was trying to skim through it to find something JSF mentioned she said in another thread, but accidentally found that part. I think it was toward the beginning somewhere.



It is the right play for Democrats. I can't fault them there. They know their time is about up and who knows when they might ever get a chance to choose a SCJ.
