Fink underwent the double mastectomy on Oct. 9, 2009, taking two weeks of paid medical leave. On Jan. 22, 2010, Fink had reconstructive surgery. According to Fink, the day before her second surgery she received a review that was "negative and scathing."

On March 25, she was fired.

In the complaint, Fink said that MXenergy said they fired her because her "position was terminated." But Fink claims that another woman was brought on to do her job and was later promoted as her superior while she was out on medical leave.

Fink Says Poor Reviews Happened Only After She Discovered She Had the Breast Cancer Gene
"It has been horrible," Fink said of the ordeal. Fink, who has a husband and two small children, had been the primary breadwinner for her family and had been the insurance provider.

MXenergy had employed Fink as the director of public relations and marketing communications since January 2006, according to the complaint obtained by ABCNews.com.

In Fink's 2009 performance review, her employers told her that she was doing an "exemplary job" and has been a "relentless crusader" for the brand.

During an August 2009 meeting about her review Fink said that her supervisor Gina Goldberg told her "that if she was to lay off everyone in the Marketing Department except one employee. I would be the one employee she kept."

Sadly Niki, this is all too common in corporate america - hell, up here with the Big Three, getting pregnant, or knocking your wife up, is a death knell for your career, and having any interest outside of work is just more fodder for "human resources" (a phrase that has become synonymous with "pure evil") to find some way to dump you.

ANY major surgery which results in you not being there the 60-80 hours a week they demand, all on a 40 hour salary to get out of that overtime, is gonna result in your ass being dumped - only thing special about this case is someone gave a shit and it got noticed, is all.

And heaven help us when those poor bastards who got stop-lossed several times come back to find their positions outsourced or terminated, many of whom also had their marriages collapse, homes foreclosed, etc - while not bein wrapped too tight anymore thanks to the constant stresses of being overdeployed, that's a recipe for disaster in the making we haven't even *begun* to experience just yet.

Hell, I got pitched from a night stocking job, from a Toys-R-Us, cause I was in the reserves, and they were pissed about me being gone one weekend out of four - and what can you really do ?

I mean, if you DO sue and get your job back, you know damn well they'll find a freakin reason, and engage in enough petty harrassment besides to drive you out, while blackballing you with a reputation that will prevent any future employment, so you really ain't got much choice but to suck it up and move on, or take the third option and find some way other than being a drone in the corporate machine to survive.

I don't support or engage in that behavior, I got one guy out backstopping his wife, who just popped one out, who is MORTIFIED that we'll ditch his ass like his last employer did - bastards called in a couple days into his paid vacation, first one in years, and demanded he come back (and lose the rest of the paid days off, conveniently..) and when he refused, they fired him on the spot AND tried to revoke the vacation pay besides!

And him with a pregnant wife, which they were already pissed about, at the time, assholes.

I practically had to physically pitch him out the door, told him not to show his face around here for six weeks, cause his wife needs him more than I do, and he has a *responsibility*, but he's so afraid of being dumped... bleh.

He was almost in tears when we ambushed him with a baby shower and all the stuff neither of em thought to buy and prolly weren't sure they could afford - cause WE support our own, dammit.
(Just wait till he sees I paid his utility bills for the next two months out of pocket as a gift in celebration of his fatherhood!)

But corporate america ?

Pffffth, that goes all the way back to them using the US Military to crush those pesky unions, and how they co-opted the government into what has evolved to an italian fascism economic model - which was kinda what Hamiltons plan was in the first place, so this was all a long time in comin, all but inevitable, and was indeed the plan of certain forces of our Gov all along.

So expecting them to do anything about it now is kind of wishful thinking, innit ?

No, that's down to *us*.

Tell ya this much, in this podunk little county here, my people can absolutely outcompete any of the security giants on price, professionalism and effectiveness, so let them and their contracts suck on dust and ashes, then - in THIS corner of the verse, mutual support and respect have won the day.
