In May, Montana became the first state to approve the Firearms Freedom Act, which declares that guns manufactured and sold in the Big Sky State to buyers who plan to keep the weapons within the state are exempt from federal gun regulations.

According to the act's supporters, if guns bearing a "Made in Montana" stamp remain in Montana, then federal rules such as background checks, registration and dealer licensing no longer apply. But court cases have interpreted the U.S. Constitution's Interstate Commerce Clause as covering anything that might affect interstate commerce - which in practice means just about anything.

"The Interstate Commerce Clause has grown and grown until the government asserts authority over everything under the sun," said Mr. Marbut, who wrote the original firearms legislation. "How much water you have in your toilet. Almost all environmental laws. Maybe one-third of all federal regulations are asserted under the Commerce Clause."



TN passed a similar bill this week, and passed another bill allowing guns in state/fed parks, overriding the DEmorat governor's refusal to sign.

Our Demorat governor calls this "a fringe constitutional theory that I believe will be quickly dispensed with by the federal courts."

Apparently the US Constitution is a frivolous argument in court.

Gonna be interesting to see how these things pan out in the courts. Texas is doing the same thing - at least when our douchebag haircut of a governor isn't threatening to secede from the union, in between rounds of begging for federal assistance and federal bailout money that he said he doesn't want!

Heh, oh yes - try actually using it, believe me, you WILL be threatened with a contempt charge.

I did that once via testimony, setting up a good cop/bad cop dynamic with my lawyer and his "honor" (who works for the state and is therefore unqualified to judge cases for that reason alone) decided to go on a rampage and threaten me with contempt, etc etc.

To which the evil bastard who serves as my attorney (who, mind you, thinks Wolfram & Hart were a buncha week kneed moralistic pansies) sleazes his way in from the side and has at him by pointing out that if the constitution is nothing more than a quaint and frivolous document then all law based on it is by that action irrelevant, etc etc...

Resulting in a high speed backpeddle, and the judge making the prosecutors case fall apart by exposing his bias and eagerness to convict on it, sticking his head WAY out at me, while my lawyer sharpened the axe and brought it home from the side with a resounding slam.

He shoulda KNOWN it was a setup the moment I opened my mouth, cause I usually just sit there silently and watch my lawyer rip the prosecutor to bits since we're not stupid enough to hand them a silver platter, have all our ducks in a row even if/when the prosecutor violates discovery, and can have any cop in this state booted off the stand as non-credible due to their own histories of perjury and criminal behavior.

The real key to making cops look like the lying scum they are is to sequester them and force them to testify one by one, while asking unexpected questions and bringing up their previous behavior, which puts them on the defensive and causes them to offend the jury with their smug arrogance - THEN start slamming home the hardballs, and watch as their emotions get in the way and they badly fumble the prepared little story they've all been rehearsing...

Couple rounds of that, the jury gets SO hostile that the prosecutor brings it to the bench and starts begging for a dismissal in exchange for an agreement not to pursue a lawsuit - which is what we call the instant-win victory.

I highly suspect the local prosecutor is behind the rumor that anyone on the force successfully layin harm to me will be compensated...

The local rumor mill had plenty to work with this weekend, since I cut my hand on a sharp edge of the lockbox we keep the site three equipment in, and a few folk noticed the cut and resultant blood on my sleeve - and I don't think not a one of em actually *believed* that was how it happened despite it being the stone truth.

People are weird.
