N.Y. attorney general seeks to depose Trump on property valuations

Dec. 9 (UPI) -- New York Attorney General Letitia James is seeking to depose former President Donald Trump as part of a civil fraud investigation of the Trump Organization, several outlets reported Thursday.

Unnamed sources told The Washington Post, CNN and The New York Times that James requested an interview with Trump on Jan. 7 at her Albany office. The investigation seeks to determine whether the company committed fraud by lowering valuations of its properties in reports to property tax officers and raising them to secure loans or tax breaks.

Judge rules against Trump, releases his taxes to Congress

A federal judge on Tuesday ruled that Donald Trump's tax filings can be released by the Treasury Department, striking a death blow against the former president's years-long crusade to keep them hidden from public scrutiny.

Robert Brockman faces tax evasion and money laundering charges that accuse him of hiding $2 billion in income over two decades.

The biggest tax evasion case against an individual in U.S. history, at least until Trump's case gets filed has been unspooling in a Texas court around the tortuous question of whether 80-year-old Robert Brockman is faking dementia. And while the prosecution may be in trouble — Brockman stares vacantly and multiple experts say he’s incompetent — a parallel but little-publicized effort could bring in a fortune in back taxes even if he dies.

The second effort, brought by the Internal Revenue Service, is civil rather than criminal, so has a lower burden of proof. And it’s aiming at $1.4 billion in taxes, penalties and interest dating back some two decades.

“The IRS goes after people even after they’re dead, so competency or being alive doesn’t matter,” said Megan Brackney, a New York tax attorney not involved in the case. Even so, it will not be easy to collect on the claim, she said.

Brockman, a computer whiz, amassed his fortune building Reynolds & Reynolds, a software vendor for car dealerships, into an industry giant, and investing in private equity firm Vista Equity Partners. Prosecutors allege Brockman evaded taxes on $2 billion, mostly on Vista income, while hiding it in entities that include a Bermudian trust and Swiss bank accounts. Brockman has pleaded not guilty.

Robert Smith, Vista’s billionaire founder, admitted to tax crimes in a related scheme but avoided prosecution in part by agreeing to cooperate in the case against Brockman.

In September, the IRS slapped at least 10 liens on Brockman, his relatives or entities the agency linked to him that own properties in Texas and Colorado. The properties include a stately, 17,000-square-foot home on four acres with a swimming pool and tennis court in Houston.

Collecting on claims

Liens also cover properties in Aspen, Colo. The U.S. is separately trying to seize a $15 million fishing lodge on the nearby Frying Pan River, a trout playground for fly fishing enthusiasts like Brock-man, and a $77.9 million Swiss bank account.

While the civil case poses less of a challenge to the authorities than the criminal one, it’s unclear whether the IRS will collect the $1.4 billion the government says Brockman owes.

That’s because a well-funded defendant has numerous options to fight back, according to tax attorney Bruce Zagaris, who isn’t involved in the litigation. Brock-man’s legal team can contest the IRS claims in U.S. Tax Court, District Court or the Court of Federal Claims. Each has its own pros and cons, Zagaris said.

Brockman and his family already filed five lawsuits in Tax Court against the agency in 1997 and 1998. Those outcomes aren’t public, but the former manager of his Bermudian trust testified at the Houston competency hearing that the dispute intensified Brock-man’s penchant for secrecy and distrust of the IRS, which he dubbed “The House.”

Zagaris said the rules of procedure and evidence in Tax Court are more truncated than in District Court, and a larger portion of cases there tend to end with settlements. In District Court and the Court of Federal Claims, taxpayers must pay the tax ahead of time and seek a refund. Zagaris said the Court of Federal Claims is often considered more favorable to taxpayers.

Any of these paths could takes years to litigate. The IRS will have to show that Brockman, and not a trustee, is the real owner of assets held through a web of companies and trusts in offshore tax havens. In an affidavit filed in a Bermuda court last December, his wife Dorothy valued holdings in a family trust at more than $7 billion. A majority stake in Dayton, Ohio-based Reynolds & Reynolds represented the largest holding.

However, the U.S. doesn’t have agreements to collect assets in most offshore tax havens, including Bermuda and Switzerland.

The IRS has wide latitude to try to seize and sell Brockman’s assets in the U.S., but the real estate known to be targeted with liens so far represents just a fraction of the agency’s claims. One potential avenue for the IRS would be to go after any remaining Brockman holdings at Vista, where an entity linked to him, Bermuda-based Point Investments, was the company’s original investor and eventually provided at least $1 billion in capital, prosecutors said.

Vista proved lucrative for Point, which moved a large portion of its private equity profits offshore, according to prosecutors. In 2010, Vista transferred $799 million to accounts at Swiss bank Mirabaud & Cie. opened in the name of Point, which Brock-man controlled, prosecutors have stated in court filings.

‘Huge amount of money’

Mirabaud has said it was unaware until Brockman’s indictment that he was linked to the account, and the bank claims it has complied with all U.S. treaty requests for information and the Foreign Account Tax Compliance Act.

Spokespeople for the IRS and Vista declined to comment, as did lawyers for Brockman.

Brockman, who as a chief executive aggressively bought companies and litigated disputes, spent decades building a business valued at more than $4 billion, according to court filings.

Brackney, the tax lawyer, said that the Brockman proceedings are emblematic of the difficulties that the IRS has in collecting taxes from the wealthy.

“It’s a huge amount of money,” Brackney said. “It’s almost like the higher net worth and the more complex the case, the harder it is to collect. It’s probably going to take years to figure out.”

Trump’s Great Escape

Trump remains the elephant in the room. If at any point he declares his candidacy for 2024, that would vastly complicate any criminal investigation involving him even peripherally. Before Biden took office, he expressed his discomfort with the prospect of conducting federal investigations that directly concern Trump — on the dubious theory that it would be too politically divisive — and Garland appears to share those concerns, so the idea that the Garland DOJ would criminally investigate Trump while he is actively running for office, much less seriously consider charging him, is hard to envision.

If the Justice Department has not begun a criminal investigation focused on at least Trump’s conduct on the Raffensperger call, it represents an enormous failure on the part of Garland and the department. The ongoing criminal investigation in Fulton County is no substitute: It is far from clear, for instance, that the office could secure access to potentially crucial evidence from within the White House or, more generally, that it has the institutional capacity to pursue someone who has proved elusive to well-resourced investigators elsewhere. It also sets a precedent that has not received the attention it deserves — namely, that local prosecutors are free to criminally investigate former presidents, even when it is clear that the underlying conduct at issue would also be illegal under federal law and that the Justice Department, a nationally representative prosecutorial body, could investigate it.

Meanwhile, our country’s long history of elite political impunity would continue unabated, and the Justice Department’s failure would incentivize even more high-level government misconduct in the future, both related to election tampering and otherwise. As for the next effort to subvert the outcome of a presidential election, that is more likely to look like the Raffensperger call — with the assistance of more pliant state Republicans — than the violence on January 6.

At some point, perhaps in ways that we cannot fully envision, and sooner rather than later, the country will pay the price for this dereliction of duty.

With the National Archives now at the center of a historic fight over records between the current and former president, the two people who once ran that agency are both condemning Trump administration officials for trying to keep documents secret.

Don W. Wilson and John W. Carlin each had years-long stints as the official archivist of the United States, overseeing the massive effort of sorting through presidential records that tell the country’s story.

And they’re dismayed at former President Donald Trump’s aggressive attempts to keep his White House records locked away from the special congressional committee investigating the Jan. 6 insurrection—and his potential role in it.

“Given how frantic they are... there are things in those records that are going to make real trouble. I’m talking about prison time,” Carlin mused to The Daily Beast. “It reinforces the fact that they know they’re in real trouble if these things are released—particularly if they’re released soon.”

An outgoing president’s White House records go straight to the National Archives and Records Administration, where they could be kept away from the public for up to 12 years. However, President Joe Biden waived that presidential privilege when he allowed the bipartisan House Jan. 6 Committee to request some documents about Trump’s final weeks in office. Trump sued to block that, and his odd claims of “residual” executive privilege got knocked down by a federal judge who noted “presidents are not kings” and an appellate panel that found his argument has “no basis.” This epic fight over records is now reaching the Supreme Court.

Those records could show whether the Trump White House plotted to use the Department of Justice to intimidate states to reject 2020 election results, schemed with rogue Republicans in Congress to halt certification of Electoral College votes that reflected Biden’s win at the polls, and interacted with rally organizers who brought the crowds that violently attacked the U.S. Capitol building.

For perspective, Carlin points to his decade at the archives from 1995 to 2005, when he battled the Nixon family over control of records.

“Nixon knew that tapes were going to kill him, and so he obviously fought and said they weren’t records. They were, because they were created in the Oval Office,” said Carlin, a former governor who now lectures at Kansas State University.

That fight is also playing out in the case of former Trump Chief of Staff Mark Meadows, who has already turned over more than 9,000 pages of material to the congressional committee but keeps holding back some communications. Meadows drew rebuke when he asserted that some of his text messages and emails were protected from disclosure because of “presidential privilege,” even though they were on his personal cellphone and two personal Gmail accounts.

Wilson, the other former national archivist, told The Daily Beast that keeping official documents on personal devices is a clear violation of the Presidential Records Act.

“It reinforces the fact that they know they’re in real trouble if these things are released—particularly if they’re released soon.”

Trump, Ivanka, Don Jr. subpoenaed by NY attorney general

NEW YORK — The office of New York’s attorney general confirmed for the first time Monday that it had subpoenaed former President Donald Trump and his two eldest children, Ivanka and Donald Trump Jr., demanding their testimony in an investigation into the family’s business practices.

In a court filing, lawyers for Attorney General Letitia James said they are seeking the Trumps’ testimony and documents as part of a yearslong civil probe involving matters including “the valuation of properties owned or controlled” by Trump and his company.

Monday’s filing was the first public disclosure that investigators scrutinizing the former president’s dealings were also seeking information from Ivanka Trump and Donald Trump Jr., both trusted allies of their father who’ve been executives in his family’s Trump Organization.

Last month, it was reported that James’ office had requested Trump sit for a deposition.

James, a Democrat, has spent more than two years looking at whether the Trump Organization misled banks or tax officials about the value of assets — inflating them to gain favorable loan terms or minimizing them to reap tax savings.

When Eric Trump and Allen Weisselberg, the former chief financial officer, testified in 2020, they both asserted their Fifth Amendment right against self-incrimination in response to over 500 questions each. What questions?

The New York attorney general's office said it is zeroing in on several, including:

• Miscategorized assets outside Trump's or the Trump Organization's control as "cash," thereby overstating his liquidity

• Failed to use fundamental techniques of valuation, like discounting future revenues and expenses to their present value

• Misstated the purported involvement of "outside professionals" in reaching the valuations

• Failed to advise that certain valuation amounts were inflated by an undisclosed amount for brand value.

One contention by James' office is that Trump hasn't complied with subpoenas for records. As an example, they allege that while Trump did not use email, they learned from witnesses that Trump kept hard copies of documents and used sticky notes to communicate with employees. They said a file cabinet pertaining to Trump's records was never searched to comply with a subpoena.

This file cabinet was never searched because the Trump Organization determined, improbably, that Mr. Trump was not involved in the preparation of his own financial statements.
