The final decision is for an appeals court ten or fifteen years from now, after a jury has decided Trump is guilty and Trump's lawyers take his conviction to every court in the land, including the Supreme Court, in an expensive effort to overturn a decision about a tax cheating crime Trump committed back in 2010. Maybe Trump will be lucky and die from obesity before the final decision. Wouldn't that be nice! He could say for the rest of his life that he was "innocent" and his estate will pay the taxes Trump owed since 2010. (Trump's heirs will probably be sued to pay what Trump's estate owed in taxes. Litigation for that will take years and will be stymied by the bankruptcy of Trump's children. With the best lawyers, Trump's taxes from 2010 will never be paid.)
