In Federalist 65, Alexander Hamilton considers the problem of impeachment and the Senate. The process, the Constitution framer writes, is meant for offenses “denominated POLITICAL, as they relate chiefly to injuries done immediately to the society itself.”

Political offenses are, by nature, politicized. They “agitate the passions of the whole community” and “divide it into parties more or less friendly or inimical to the accused.” The danger, Hamilton says, is that the impeachment process will be decided “more by the comparative strength of parties, than by the real demonstrations of innocence or guilt.” If that proves either the perception or the reality of impeachment, the process loses its legitimacy, and America loses critical protection against tyrants and criminals.

Everything, then, rests on the independence and authority of the body charged with impeachment. Hamilton admitted that there was no tribunal capable of “the most exact standard of perfection,” but the best possible hope lay with the Senate. He believed that no “other body would be likely to feel CONFIDENCE ENOUGH IN ITS OWN SITUATION, to preserve, unawed and uninfluenced, the necessary impartiality between an INDIVIDUAL accused, and the REPRESENTATIVES OF THE PEOPLE.”

He was wrong about the Senate. He would have been right, if the Senators could work in secret, keeping their vote from being known to the voters back in their home states. Jurors in criminal trials are the perfect example -- if the jurors received the same punishment as the accused, the jurors won't punish, no matter how guilty the accused.

Seriously though... I've been batting around this idea for a scifi story. Could be a short story or film, whatever, and it has aspects of presidential mass distraction in it.

Consider: lots of hand held camera work. We see a young couple driving around on a sunny summer day. We see them looking for a condo to move into and we're in the car with them as they have small talk conversations while they look at a few units. We see a montage of their efforts with a edits of interiors and exteriors and just basic shots of their day and back and forth convo. Nothing special, just 2 regular people living their lives. What some viewers might notice is the number of exteriors that have fungus on them. Larger than usual areas that our couple don't seem to notice - easy to miss really.
Cut to: New president being briefed on his first week in office. Solemn setting, big oval table with about 2 dozen very serious looking members of the staff and top representatives of the basic military branches all there. His briefing starts...
Cut to: family room somewhere, someone watching tv, flipping through channels, usual nonsense. Viewer stops on a basic public cable channel because a guy is yelling at the camera about cancer treatments. He says. "Have you people been watching?!? Have you noticed that Big Pharma has been relabeling their anti-fungel drugs as cancer treatments? > guy on couch laughs < "It's a sign! I'm telling you there's ..." *click* channel is changed to Married with Children...
Back to: "Mr. President, time for this week's threat assessment..." we hear the usual threats, many are of a human nature, man v. man type thing, bombs, terrorism, etc... and then, "Oh, and one thing our lab guys wanted me to pass on... it seems a little odd, and we're still defining it, but there's a new study on a new strain of air born fungul / virus we're looking at... probably nothing..."

Texas Republican voters do not think Trump fucked up. It is right, and it is a GOP President's right (but not a Democratic President's) to use Federal money in order to get cooperation from Ukraine to reelect Trump. What most GOP voters think is right is scandalous. Trump is merely following and is very conscious of what his voters will approve of. With them, his rating is going up and up, right now, today.

I think most of the people who voted for Trump in 2016 don't care about facts, and never will, which kind of explains how their lives get into binds and blind alleys. It is literally, not metaphorically, impossible to get them to understand how Trump is transferring Federal money into his own pocket. These are the same people who get screwed over time after time in their personal financial decisions and by their the bosses and in their dealings with landlords, etc. You'd never be able to get those kind of people to pay intelligent attention to what is being done to rip them off. Well, to be fair, if anybody asked me I would tell them that I approve of the impeachment inquiry. I've been saying that they should impeach him as long as any of you guys have.

Glad to see that they're finally doing an investigation to decide whether or not they're going to impeach him at a later date or not.

Trump says the whistleblower complaint isn’t accurate. The White House keeps showing how it is.

COMPLAINT: "Multiple White House officials with direct knowledge of the call informed me that, after an initial exchange of pleasantries, the President used the remainder of the call to advance his personal interests.”

TRANSCRIPT: Trump speaks in nine discrete segments.

He congratulates Zelensky on winning the presidency.

He says Ukraine is happy Zelensky won.

He mentions how much aid the United States provides to Ukraine.

He asks a favor: Investigate (baseless) rumors about Ukrainian involvement in an assessment of Russia’s hacking of the Democratic National Committee in 2016.

He encourages working with his attorney Rudolph W. Giuliani and pushes for an investigation of former vice president Joe Biden and his son.

He says he’ll have Giuliani and Attorney General William P. Barr call about the investigation.

He invites Zelensky to the White House.

He says he’ll see Zelensky at the White House or at an event in Poland (that he ended up not attending).

He again offers his congratulations.

Except for the invitation to the White House — though even that is questionable — the whistleblower’s allegation is accurate.

COMPLAINT: “According to the White House officials who had direct knowledge of the call, the President pressured Mr. Zelenskyy to … initiate or continue an investigation into the activities of former Vice President Joseph Biden and his son, Hunter Biden. …" (A different transliteration of Ukrainian President Volodymyr Zelensky’s surname is used throughout the document.)

TRANSCRIPT: Trump says, "[T]here’s a lot of talk about Biden’s son, that Biden stopped the prosecution and a lot of people want to find out about that so whatever you can do with the Attorney General would be great. Biden went around bragging that he stopped the prosecution so if you can look into it … It sounds horrible to me.”

COMPLAINT: “ … assist in purportedly uncovering that allegations of Russian interference in the 2016 U.S. presidential election originated in Ukraine, with a specific request that the Ukrainian leader locate and turn over servers used by the Democratic National Committee (DNC) and examined by the U.S. cyber security firm Crowdstrike, which initially reported that Russian hackers had penetrated the DNC’s networks in 2016 …"

TRANSCRIPT: Trump says, “I would like you to find out what happened with this whole situation with Ukraine, they say Crowdstrike … I guess you have one of your wealthy people … The server, they say Ukraine has it. There are a lot of things that went on, the whole situation.” (Ellipses in the original.)

COMPLAINT: “ … and meet or speak with two people the President named explicitly as his personal envoys on these matters, Mr. Giuliani and Attorney General Barr, to whom the President referred multiple times in tandem.”

TRANSCRIPT: Trump praises Giuliani at one point, saying that “[h]e was the mayor of New York City, a great mayor, and I would like him to call you. I will ask him to call you along with the Attorney General. Rudy very much knows what’s happening, and he is a very capable guy. If you could speak to him that would be great.”

At another point he says he “will have Mr. Giuliani give you a call and I am also going to [have] Attorney General Barr call and we will get to the bottom of it.” At another point he says he “will tell Rudy and Attorney General Barr to call.”

COMPLAINT: “The President also praised Ukraine’s Prosecutor General, Mr. Yuriy Lutsenko, and suggested that Mr. Zelenskyy might want to keep him in his position.”

TRANSCRIPT: Trump talks about a prosecutor, but it’s not clear whether he’s referring to Viktor Shokin — whom Biden fought to get fired — or Shokin’s replacement, Lutsenko. Lutsenko, it’s worth noting, had helped propagate anti-Biden stories through the Hill.

“I heard you had a prosecutor who was very good,” Trump told Zelensky, “and he was shut down and that’s really unfair. A lot of people are talking about that, the way they shut your very good prosecutor down and you had some very bad people involved.”

“I heard the prosecutor was treated very badly,” he said at another point, “and he was a very fair prosecutor so good luck with everything.”

By the time of this call, Giuliani and Lutsenko had met personally on multiple occasions, according to the whistleblower.

COMPLAINT: “Aside from the above-mentioned ‘cases’ purportedly dealing with the Biden family and the 2016 U.S. election, I was told by White House officials that no other ‘cases’ were discussed.”

TRANSCRIPT: The only other issue raised in the call was the former U.S. ambassador to Ukraine, whom Trump removed. That subject was raised by Zelensky.

Those are all of the mentions of the call itself in the whistleblower complaint — all clearly and directly verified by the transcript that Trump’s White House itself released.

What has garnered more attention over the past 24 hours is another assertion made in the complaint.

“White House officials told me that they were ‘directed’ by White House lawyers to remove the electronic transcript from the computer system in which such transcripts are typically stored for coordination, finalization, and distribution to Cabinet-level officials,” the whistleblower writes. “Instead, the transcript was loaded into a separate electronic system that is otherwise used to store and handle classified information of an especially sensitive nature.

One White House official described this act as an abuse of this electronic system because the call did not contain anything remotely sensitive from a national security perspective.”

On Friday morning, the White House provided a statement to CNN: That move did happen, at the request of National Security Council lawyers.

It’s sounding more and more as if the whistleblower is just as credible as the intelligence community’s inspector general, and a subsequent review by the Office of Legal Counsel determined him or her to be.

Four debunked talking points used to discredit the whistleblower complaint

To defend President Trump against the whistleblower allegations, Republicans in Congress are having to dodge or misstate some key facts. Here are the most common talking points they are using to discredit the complaint and why those don’t hold up.

Talking point No. 1: There is no quid pro quo — in the call or the whistleblower complaint

This is technically true. According to a rough transcript of Trump’s July call with Ukrainian President Volodymyr Zelensky, Trump didn’t say: Do this for me, and I’ll do this for you. But he didn’t have to be that explicit. The context surrounding this call would lead any reasonable person to believe that Trump had things to offer the Ukrainian president if he helped Trump out. Consider:

Days before the call, Trump froze bipartisan military aid to Ukraine.
Trump mentioned he needed a “favor” from the president right after Zelensky indicated he would like to buy more Javelin missiles from the United States.

Trump resisted a White House meeting with Zelensky, something Zelensky desperately wanted, for some time. After Zelensky appeared to agree to help Trump out, Zelensky suddenly got what he had long wanted. Trump said: “Good. Well, thank you very much, and I appreciate that. I will tell Rudy and Attorney General Barr to call. Thank you. Whenever you would like to come to the White House feel free to call. Give us a date, and we’ll work that out. I look forward to seeing you.”

Plus, the idea of a quid pro quo may be a red herring. “You normally don’t have a quid pro quo stated expressly,” former federal prosecutor Randall Eliason told The Washington Post. “This is almost as close as you can get.”

Talking point No. 2: The whistleblower has political motivations, and so the complaint can’t be trusted

Page 5 of a report about the whistleblower by Michael Atkinson, the intelligence community inspector general, mentions that the whistleblower has “arguable political bias … in favor of a rival candidate.”

But in the very next sentence, Atkinson also said he had determined that that did not affect the credibility of the complaint. “Such evidence did not change my determination that the complaint relating to the urgent concern ‘appears credible,’ particularly given the other information the [intelligence community inspector general] obtained during its preliminary review."

In other words, Atkinson reviewed all angles of potential conflicts of interest by this whistleblower and still found his or her complaint to be credible, including by finding separate evidence.

Also, in questioning Thursday in the House Intelligence Committee, acting director of national intelligence Joseph Maguire backed up the whistleblower’s credibility. (Maguire said he does not know who the whistleblower is, but read this exchange between him and Chairman Adam B. Schiff (D-Calif.):

SCHIFF: You don’t believe the whistleblower is a political hack?
MAGUIRE: I believe the whistleblower is operating in good faith and has followed the law.

A few minutes later:

SCHIFF: Do you have any reason to accuse him or her of disloyalty to the country or suggest he is beholden to anything else but the country?
MAGUIRE: Absolutely not. I believe the whistleblower followed the steps every way.

Finally, the inspector general who investigated the complaint found the whistleblower to have “subject matter expertise” about the material.
Talking point No. 3: The whistleblower had only secondhand knowledge

This is also true. But it’s not enough to discredit the entire complaint. If we think of the whistleblower as a reporter, the whistleblower talked to a lot of people who had firsthand knowledge.

In one key instance, we have original source material to back up what the whistleblower has alleged. So far, this person nailed the call between Trump and Zelensky. This person correctly reported nuances about how Trump not only asked about the Bidens, but asked Zelensky for help about other election-related topics.

Notably, Trump is said to have asked Zelensky to “assist in purportedly uncovering that allegations of Russian interference in the 2016 U.S. presidential election originated in Ukraine, with a specific request that the Ukrainian leader locate and turn over servers used by the Democratic National Committee and examined by the U.S. cyber security firm CrowdStrike.”

That’s almost verbatim from the call:

TRUMP: I would like you to do us a favor though because our country has been through a lot and Ukraine knows a lot about it. I would like you to find out what happened with this whole situation with Ukraine, they say Crowdstrike ... I guess you have one of your wealthy people … The server, they say Ukraine has it. There are a lot of things that went on, the whole situation. I think you’re surrounding yourself with some of the same people. I would like to have the Attorney General call you or your people and I would like you to get to the bottom of it. As you saw yesterday, that whole nonsense ended with a very poor performance by a man named Robert Mueller, an incompetent performance, but they say a lot of it started with Ukraine. Whatever you can do, it’s very important that you do it if that’s possible.

The whistleblower also talked to half a dozen U.S. officials over the course of months to put together this complaint.

Does this mean we should take everything in this whistleblower complaint as truth? No, of course not. But it’s worth noting that this person has multiple sources in the room of the president.

Talking point No. 4: This is a ‘secondhand conspiracy theory built on biased media reports’

The Washington Examiner reports that the White House gave this talking point to Republicans in Congress on Thursday to counter the complaint. The idea seems to be to discredit the complaint by tying it to distrust of the media.

The whistleblower does use public events, as reported by journalists, to bolster his or her claims and help paint a picture of a president abusing his power for personal gain. But those news reporters are used to bolster his or her own sources. For example, the whistleblower says that as the Ukrainian ambassador was about to lose her job, this person “learned from a U.S. official that ‘associates’ of [Trump’s personal lawyer Rudolph W. Giuliani] were trying to make contact with the incoming Zelensky team."

Then this person makes the claim that Giuliani had helped oust the ambassador and cites Giuliani’s interview with a Ukrainian journalist that the ambassador was “removed … because she was part of the efforts against the President.” This person also cites a New York Times article showing Giuliani planned to travel to Ukraine days after the ambassador lost her job “to press the Ukrainian government to pursue investigations that would help the President in his 2020 reelection bid.”

News reports are part of the story, but they’re not the whistleblower’s only story. In addition, broadly speaking, the reporting by The Post and other outlets on the contents of this complaint have proved to be accurate.

The odds of impeachment of course favor the president, because 67 votes to remove remains an almost certainly impassable bar. But Trump is bringing nothing else to this contest besides inertia. His own actions are the worst possible. In a fight his opponents probably cannot win, he is exerting all his manic, directionless energy to lose.

During the Lewinsky scandal, Clinton focused on doing his job. Trump isn’t even pretending.

On Sunday, Trump’s senior adviser, Stephen Miller, the author of some of the most troubling aspects of the president’s agenda, appeared on television to dismiss the whistleblower’s complaint as the workings of the so-called Deep State, expressing a kind of political paranoia that used to be reserved for totalitarian regimes but has now become a frequent and utterly misguided talking point by the far-right in this country.

In normal times these statements would have brought everyone in Washington to their feet to protest, or to at least counsel temperance. In these abnormal times, we have seen example after example of silence or complicity throughout nearly the entire GOP caucuses in the Senate and the House. That acquiescence is dangerous.

We don’t know yet whether Trump’s call with Ukraine’s president is part of a pattern of abuse of power that will lead to a trial in the Senate, nor how senators would vote if they were asked to sit in judgment. Speaker Nancy Pelosi has merely authorized the beginning of an investigation into whether he should be impeached.

If the Democrats have overplayed their hands, they will face political consequences for doing so. But if Republicans don’t stand up to Trump’s unprecedented rhetoric about treason, espionage and even civil war if he were to be impeached, then no matter what the proceedings’ outcome, Republicans will be responsible for serious damage to the Republic.

There will be a political price for that, too, but it may come too late.

Reuters had the same news as Vox, about Trump asking China to help him win the 2020 election, with one difference: Reuters did not make the connection between Trump's tweets today threatening China if it does not help Trump destroy Biden. This is the same old thing that got Trump in trouble about Ukraine last week. Obviously Trump will deny that his words mean what his mouth says, but China knows what Trump means, even if 6ixStringJack and other Trump voters know nothing.
