Is that the official story then. And the facts have been thoroughly investigated to determine that this soldier, held captive for 5 years, abandoned his post and betrayed his country. Was this the official position of the Army?

So those 5 years of torturous existence wasn't punishment enough for his alleged traitorous act? So now he should be subjected to a trial? Or did that happen already and I missed it? Here in this country there is such a thing as due process, remember that. I mean, we had a cowardly act performed right here in our country when an unarmed teenager was shot dead in cold blood, and that "American" (after much protest) was tried in a court of law.

Could someone explain to me how the rights of this American disappear?
Somehow that just doesn't seem American, to just label this man a coward and a traitor without an investigation and trial. Hell, we give more rights to criminal behavior than we do to someone with the balls to go over there in get in harm's way.

There's two possible things you could mean by this.

Ted Cruz said it's "illegal" for the president and state department to "negotiate with terrorists." Which is incorrect. It's a violation of common sense, but there's been no legislation about that, and as such it's not illegal.

The other possibility is you're referring to a 30-day notice to congress about releasing Gitmo prisoners, which was supposedly ignored due to health concerns for the sergeant. There is legal controversy over this particular requirement. And since pretty much everyone hates red tape and bureaucracy, you'd probably be better focusing on the nature of the released detainees.

It's obvious you're trying to build an impeachment case, but impeachment requires a high crime or misdemeanor. The "crime" in question here would be the statutory violation of this notice requirement, not the transfer of prisoners itself, which is what I've heard people arguing constitutes a high crime against the nation but which is legal. Part of any president's war powers is that they are able to negotiate prisoner transfers.

We'll see what the courts decide, it's sounding like this is going to be the incentive for some of the courts to test whether that requirement was constitutional or not.

The law isn't a hard and fast thing, and it's always changing, as you know. Frankly, I get the sense that most of this is Washington politics and one side testing the limits of the other side. I'm not sure ignoring that statute is really a "crime" in the sense that it affects anyone. Certainly it's nowhere near embezzlement or laundering money or gun running or wiretapping or other debacles this administration is responsible for.

Soldiers who were in his unit or have been there actually have said such feelings of disillusion aren't unheard of. But that's kinda part of the military life, one which they ALL freely signed up for,even if they may not have fully understood what it may mean.

In such cases, some say screw the mission, screw the C.O., screw all that rah-rah crap that may have been what brought them there, but at the very least, you're in it for the guys around you. You watch their back, they watch yours, and everyone comes home.

Bergdahl said 'screw you' to his own mates, as well as screw America. he's not even worth a head slap by the great General Patton.

If he's not dishonorably discharged, at the very least, it could get ugly.

I actually think that's pretty fair. People make mistakes where other people die all the time, and this doesn't seem like he premeditated his squadmates dying.

Loyalty is a chain that goes in TWO directions, and since there hasn't been ANY coming back down for a long, long time, don't expect me to get any kind of upset when some poor fucked grunt realizes how screwed he is and the shit sandwich which is gonna be his future and says "Fuck This Noise".
Hell, if ENOUGH of em did that we wouldn't be in this mess in the first damn place.
