This is why I hate the Portable Breath Test, it leads to sloppy police work. The PBT should be used in conjunction with standard sobriety tests.

As for the taser...I'm ok with that. She ordered him out of the car, his job is to comply. No discussion, no calling the lawyer. Due process gives you the right to call a lawyer, just not at that point. It generally comes after the tests, arrest, and booking. If time permit an officer may, at their discretion, allow it earlier, generally prior to taking the formal breath test at the station. It's not something to be done on the side of the road.

Besides, what's he going to ask?

"Golly Mr. Attorney, should I obey the police officer?"
"Yes."

It's always yes, the argument comes later. If you say "no" and resist, then you'll likely lose on that alone. Resisting the police, causing a fuss, refusing the tests, it all adds up to a big fat guilty verdict.

Just had a great trial, no tests, great video of guy going batshit crazy cussing and making a fuss.
