Heard this yesterday on the Kojo Nnamdi Show. Since it's been discussed here, thought I'd post it.

Maryland resident Anthony Graber ... got in big trouble earlier this year after video recording a traffic stop. The state trooper who stopped him was in plain clothes and waived a gun at Graber before identifying himself as police. Graber posted his video of the encounter on YouTube and was later charged with violating the states' wiretap law, a felony. But earlier this week, a Harford County judge dismissed those charges, ruling that law enforcement officers do not have an expectation of privacy while on the job. The case is being closely watched by civil liberties advocates.

This sargent engineer in the national guard is still facing reckless driving charges with potential for jail, and will surely sue for false arrest and malicious prosecution.

The state may appeal the dismissal of the wiretap charge.

This is merely 1 battle in the Neverending War on Freedom.

Ayep, this one is still far from over.

Not to mention I think we all know the guy is gonna get quietly flagged as a "troublemaker" and will be subject to endless petty harrassment unless he moves far, far away, and even then getting a chunk of this bullshit cleared from your official (and unofficial) records is a pain in the ass - not to mention the impact of such things on relationships, employment, and of course the simple fact that most people never get back any property taken during a search, and if the police are forced to return it, often as not it's damaged beyond repair as an act of petty spite.

This is, of course, why lawsuits as retributive/restorative justice are something I feel is warranted, but the financial penalty should fall soley on the department which committed the offenses, because paying it out of the general fund insulates them from the consequences of their conduct, and we have GOT to stop doing that...

We've actually turned around the conduct of the local townships force by hacking large chunks off their budget when they misbehave, and when they went and made THREATS while demanding an increase, we hacked it some more!

One bad cop can pretty much ruin your life, and there's just no restoring it, so the only real consolation prize when the officer is in the wrong, is enough money to go somewhere else and start over - but still, it's like how insurance money after a fire cannot replace the heirlooms, yes ?

We need to hold them ACCOUNTABLE, for this kind of thing.
