The closest comparison between January 6 and another instance of partisan activists aggressively disrupting Congressional proceedings was the confirmation of Brett Kavanaugh. For weeks prior to the vote, the news media, Democratic lawmakers, and feminist groups made life hell for Kavanaugh and for the country. The chaos began during Kavanaugh’s initial hearing on September 4, 2018. Senator Kamala Harris (D-Calif.) interrupted Chairman Charles Grassley’s opening remarks, talking over him as the longtime senator tried to introduce the nominee and his family. Senator Amy Klobuchar (D-Minn.) quickly joined Harris’ harangue. “Mr. Chairman, I move to adjourn,” Senator Richard Blumenthal (D-Conn.) demanded. Activists seated in the hearing room loudly cheered then started to berate Grassley and Republican members of the committee. The mayhem lasted for several minutes as protesters were removed. It was a harbinger of how vociferously, and violently in some instances, Democrats and their allies would fight Kavanaugh’s confirmation. That week, more than 200 people were arrested by U.S. Capitol Police, paid a minimal fine, and were released. Despite the uproar, Kavanaugh’s confirmation seemed almost certain. But unsubstantiated stories about Kavanaugh’s behavior in high school, including accusations of sexual assault, were reported by the Washington Post and threatened to doom his ascendancy to the nation’s highest court. A dramatic showdown between Kavanaugh and his chief accuser, Christine Blasey Ford, during a Senate Judiciary Committee hearing on September 27, 2018 further inflamed both sides. The siege of government buildings escalated. Republican senators were angrily confronted in elevators and outside government buildings. Some received death threats. The outrage was heavily fueled by Democratic leaders including Senator Elizabeth Warren. “Hello resistance!” Warren shouted to a raucous crowd assembled outside on October 4. “I am angry on behalf of women who have been told to sit down and shut up one time too many. This is about hijacking our democracy.” Thousands heeded Warren’s call for action. “We were planning to shut down the Capitol Building but the authorities were so scared of this #WomensWave that they shut it down for us,” the official account of the Women’s March tweeted that day. “1000+ women, survivors, and allies have gathered in the Hart Senate Building. Every hallway. Every floor.” When Pence announced on the afternoon of October 6, 2018 that Kavanaugh’s nomination was confirmed, women shouted from the Senate gallery and were removed. The nation was roiled by the Kavanaugh fiasco for more than a month yet activists opposed to his nomination were considered heroes, not villains, by the national news media. Protesters who defiled government buildings or harassed elected officials or scuffled with police were not considered “domestic terrorists.” Democratic senators were not condemned as a “sedition caucus” for disrupting and delaying an official government hearing. To the contrary, theatrics by Harris and Warren elevated their public profile and helped launch their presidential bids the following year. More than 230 people were arrested in D.C. on January 20, 2017 when protests against Donald Trump’s inauguration turned violent. Activists associated with the “#DisruptJ20” movement, which organized “widespread civil resistance [in] the streets of Washington, D.C.” during Trump’s swearing-in festivities, set fires, vandalized businesses, and clashed with police that day. But the same office prosecuting January 6 defendants eventually dropped all cases related to the J20 rioting. A more recent example is the hostile occupation of the Mark O. Hatfield United States Courthouse in Portland, Oregon in 2020. The government building and surrounding streets were under attack for months by leftwing activists following the death of George Floyd. The U.S. Attorney for the District of Oregon, Billy J. Williams, detailed the destruction on the one-hundred-day anniversary of the siege: “There has been nothing civil, respectful, or positive about the nightly violent and destructive protests in Portland, Oregon,” Williams wrote in a press release on September 25, 2020. On many nights, after peaceful demonstrations end, violent agitators have physically attacked police officers and firefighters, damaged buildings, and repeatedly attempted to set public buildings on fire. Following one of these political rallies, a man was shot and killed. Most recently, acts of violence towards law enforcement and first responders include a Portland firefighter being shot in the chest with a steel ball bearing launched from an arm-mounted slingshot, a man dousing several police officers with high-powered bear deterrent spray, a man punching a female police officer in the face, and a woman striking a police officer in the head from behind with a wooden shield. Some of the weapons confiscated during the Portland riots were the same that landed January 6 defendants behind bars and denied bail. Those items included a helmet, tasers, and chemical spray. But a March 2021 investigation by KGW-TV, a Portland news station, revealed that at least one-third of the federal cases had been dropped, including defendants accused of assaulting federal officers or destroying government property. Half were dismissed “with prejudice,” which means the case cannot be brought back to court.118 Some also took plea deals that only required a period of probation or a thirty-day stint in jail. One legal expert—law professor Laura Appleman of Willamette University—defended the move, explaining on KGW-TV how prosecutors needed to ask, “Is it worth using our limited time and energy to prosecute each and every of these federal misdemeanors?” However, January 6 protesters received none of the usual protections or praise afforded to activists on the Left. Even more troubling for Trump supporters would be the ultimate judgment for their actions would be rendered in a city where only 5 percent of the residents voted for Donald Trump in 2020. Since the “crime scene,” as former acting U.S. Attorney Michael Sherwin described the Capitol building after January 6, was in Washington, D.C., every case is handled in the nation’s capital—a bad omen for Trump supporters. The overwhelming number of judges and magistrates of the D.C. District Court were appointed by Barack Obama and Bill Clinton; only four were Trump appointees. Judges such as Amy Berman Jackson and Emmet Sullivan had been openly hostile to President Trump and his associates during his presidency. In a forty-minute tirade from the bench in February 2020, Berman Jackson berated longtime Trump associate Roger Stone and accused him of “covering up” Trump’s role in imaginary Russian election collusion. “There was nothing phony about the investigation,” Berman Jackson said about Special Counsel Robert Mueller’s investigation, which had already come up empty-handed. She accused House Republicans of issuing a misleading report on Trump-Russia election collusion. “The truth still exists, the truth still matters. Roger Stone’s insistence that it doesn’t, his belligerence, his pride in his own lies are a threat to our most fundamental institutions. If it goes unpunished it will not be a victory for one party or another. Everyone loses.” All of this was irrelevant to the matter at hand. Stone was not charged with any crime related to election collusion. But in the mind of this liberal judge, it was all about Trump and Russia. Beryl Howell, the chief judge of the D.C. District Court, also is no fan of Donald Trump. A former Democratic Senate staffer, Howell was appointed to the bench in 2010 by Barack Obama; she became chief judge in 2016. The following year, Howell supervised Mueller’s grand jury. Mueller’s nineteen-lawyer team issued 2,800 subpoenas and executed at least 500 search warrants over a two-year period with Howell overseeing most of the legal proceedings.
