That link is showing all of the documents I had access to the day before the case. I don't know why my link stopped working last night when I checked it but it worked just fine a day earlier.


It doesn't look good for Holcomb, does it?

What do you suppose will happen to him if it is decided that the benefits need to continue but he already screwed that up by terminating whatever contract he had with the federal government?

I'm sure at that point it would become national news on every Lefty shill site out there.


I was bummed when he didn't get the boot last election, but now I might end up with quite a lot of entertainment since he just won't go away.

The whole point 25 GOP governors were trying to make was to help employers by forcing the unemployed to get minimum wage jobs by denying the unemployed $300 per week from the Federal government. The GOP governors were successful in stopping the $300.

If the judge eventually disappoints the employers by ordering the Indiana governor to pay that $300, it will be easy for governor to give away money. The very hard part, sometimes even impossible, is having money in the bank so that you can give it away. President Biden will do the hard part by providing the money in the bank, leaving Indiana's governor to do the easy part, give it away. The governor's attorneys will say giving away $300 can't be done, but the judge might tell the governor that it can easily be done and if the governor doesn't hand out $300 checks then he will be guilty of contempt.

Thousands of Texans have banded together and hired an attorney to file suit to block Gov. Greg Abbott from ending emergency federal unemployment benefits before the programs expire in September.

The plaintiffs, two groups that organized over Facebook with more than 30,000 people, argue that the decision to end the benefits early exceeded the governor’s authority, according to the lawsuit, filed this week in state district court in Austin. The benefits, aimed at providing relief to workers during the pandemic, are scheduled to expire Saturday under Abbott’s order.

Abbott last month ordered the early end to federal programs that provided supplemental payments of $300 a week to unemployed workers and extended jobless benefits to gig workers and other self-employed people not covered by the traditional unemployment system. Abbott argued that job openings in the state are plentiful and the additional benefits were no longer needed.

His office did not respond to a request for comment.

The move was praised by employers, who have complained that generous unemployment benefits were discouraging workers from taking jobs, leading to a labor shortage. Economists say the reasons for reported labor shortages are more complex than that.

On Friday, Judge Dustin Howell denied a temporary restraining order to block the governor from ending the federal benefits while the case is proceeding.

The plaintiffs are asking the court to order the Texas Workforce Commission to make the decision on whether and when to end the benefits. They acknowledge that the workforce commission could reach the same decision as the governor, but it would delay when the federal benefits would expire.

The two unemployment groups are crowdsourcing to be able to pay legal fees. So far, they have raised more than $8,000 to cover the estimated $15,000 it will cost in legal fees.

Looks like organizations from several other states are fighting it now as well. I've heard rumor on reddit that there is similar language in other state laws which could lead to the same conclusion (obviously, take that with a grain of salt until anything happens).

States I've heard that are going to have a fight over this now are Texas, Georgia and Maryland. There may be more.




Nobody in Indiana has actually been able to file their voucher for the week ending 6/26/2021 yet. The login page which updates new information has said since late Friday that there will be some vague system maintenance being performed Monday afternoon (It even mentioned something about Windows). This message is no longer on the page as of Monday morning, but people's claims had still been marked as "expired" through Sunday. This is obviously a front to hide the fact that they need to open these claims back up to people as any down period for the regularly scheduled Thursday evening maintenance is rare.

Interestingly though, the front page never made any mention about benefits being terminated early in the weeks leading up to 6/19/2021 either. To get those messages you had to be logged in or read the email(s) that were sent to you.


I'd actually be willing to bet that 1/2 of the people on Unemployment weren't even aware that their benefits had been terminated if not for this court case and are wondering why they still can't file their voucher for last week, despite the emails and warnings printed post-login. Yanno... leading horses to water and all of that.

The whole point 25 GOP governors were trying to make was to help employers by forcing the unemployed to get minimum wage jobs by denying the unemployed $300 per week from the Federal government. The GOP governors were successful in stopping the $300.

If the judge eventually disappoints the employers by ordering the Indiana governor to pay that $300, it will be easy for governor to give away money. The very hard part, sometimes even impossible, is having money in the bank so that you can give it away. President Biden will do the hard part by providing the money in the bank, leaving Indiana's governor to do the easy part, give it away. The governor's attorneys will say giving away $300 can't be done, but the judge might tell the governor that it can easily be done and if the governor doesn't hand out $300 checks then he will be guilty of contempt.



Guess Biden* better do the hard part and get that printing press back out.

Because right now it looks like Holcomb and the Indiana DWD are in violation of a court order and are claiming that the money isn't there, just like I predicted they would.

I am sure that The Honorable John F. Hanley, Judge, Marion Superior Court 11 decided it was too much trouble standing against what Governor Holcomb wanted, so the judge let somebody else volunteer to be judge of this case. Holcomb wins because switching judges delays paying unemployment benefits. Delays are almost as good as an outright win. Holcomb is on the side of employers wanting to force the unemployed to take minimum wage jobs. Holcomb wins really, really big if the only volunteer judges are ones who have already decided in favor of Holcomb's position of NEVER paying $300 per week unemployment benefits.

That's why I said if the law was applied equally to everyone, Holcomb would be sitting in a jail cell right now. At least until they got off their asses and figured this out.

That is, unless their argument that the word "enjoined" in this case simply meant they were "urged" not to discontinue the benefits, but since enjoined was followed by "from" and this was a legal case, I don't think that argument is going go fly.

If you don't count when the papers report they supposedly said they don't know what to do because the money is no longer there, they haven't said a single word about it.





P.S. It has been reported that the change in judge was granted because that's the rules of the local law.

Supposedly, the final hearing wouldn't take place until both parties agree on a new choice of judge.

With one more wrench thrown into Holcomb's plans only after decreeing that the benefits still need to be paid out until a final judgement is rendered, Hanley might end up being a hero to 230,000+ residents.

This is an interesting pandemic result. People always felt that job stress - needing to keep your job no matter how much it sucked and how little it paid - was a normal part of life. And then it wasn't. A year of not having to suck it up, and of not being at the mercy of business, has changed a lot of attitudes, at least for now.

But if we keep the emergency orders in place then the Medicaid and other Federal money that Eric will mismanage keeps rolling in.


Labor Secretary is "watching" this unfold, but keeping his mouth shut.


Hopefully the law firms that brought up the case held out and didn't just let Fatass get the appeal judge that he wanted.

He had no intention of ever following Hanley's order and somehow managed to break records getting the appeal case for this to happen next week.

I don't recall ever hearing an appeal case happening that quick. Eric REALLY hates poor people in his state.


At least we have photographic evidence that he's not worried about where his next meal is coming from. Dude eats 5,000 calories per day.

Meanwhile, after a similar court order in Maryland, federal unemployment benefits continue to roll out in that state without any interruption.

Those began again July 15, and DWD said 25,000 had already been processed for more than $30 million. Those benefits include the $300 weekly add-on, Pandemic Unemployment Assistance (PUA) and Pandemic Emergency Unemployment Compensation (PEUC). Payments for those will be retroactive to the week ending June 26. The final payment after the governor's order had been made, went out the week ending June 19.

Workers who have since found employment will still receive retroactive payments for claims filed for the weeks they were unemployed. If the courts later rule Holcomb can end the federal unemployment benefits in Indiana, no money will need to be paid back from anyone already receiving a payment.



It will be interesting to see if Holcomb is going to continue this fight or if he just lets it fall through the cracks now, after two judges ruled against him.

Unlike when he immediately went on record saying that he would appeal when the Marion County judge ruled against him, he doesn't have any comment this time.

Since it appears that there hasn't been a proper hearing yet and it's just been two judges saying that the payments must continue until there is one, who is to say that the switch can't be turned off again at any time. At least it's known that if it happens the people who are getting unemployment (and retroactive weeks) right now don't have to stress over the prospect that they'd have to pay all of that back if an appeal is successful between now and September.


Good luck to any other states ending these programs early. Every one of you should be fighting this. ESPECIALLY in states where your Governor shut off unemployment but continues to extend the State of Emergency like Holcomb did.
