Quote:COMPLAINT FOR DECLARATORY JUDGMENT AND INJUNCTIVE RELIEF Motion for the Court to add an Interested party to the lawsuit The Interested Party is just a person who wants to set in the dugout and watch the game played and not interfere. The Interested Party has a problem with what was called a pandemic but now is known as a bio weapon thrown upon the Citizens of the United States of America, by the Chinese Government and the Interested Party understands that Governor Holcomb had to make decisions for the health and safety of the residents of the State of Indiana. However in this decision making Governor Holcomb ordered Self employed people lo drop their businesses, thus Self employed people were placed out of work by the Governor's Order. Then Self employed people whom suffered without any income and suffered financially are being denied unemployment checks. The denial of Unemployment to self employed people looks like discrimination against the Self employed. The benefits of unemployment are the monies that are provided by the taxpayers from taxes and never before more needed than in this national emergency from this Bio attack upon the United States of America. The Court should demand that Indiana Workforce pay all that is due to the self—employed as well.

Quote:Originally posted by second: Quote:Originally posted by 6IXSTRINGJACK: Are you positive about that? The defense claims that they've already gone through the legal process to end it and "don't even know if it can be reversed now".The whole point 25 GOP governors were trying to make was to help employers by forcing the unemployed to get minimum wage jobs by denying the unemployed $300 per week from the Federal government. The GOP governors were successful in stopping the $300. If the judge eventually disappoints the employers by ordering the Indiana governor to pay that $300, it will be easy for governor to give away money. The very hard part, sometimes even impossible, is having money in the bank so that you can give it away. President Biden will do the hard part by providing the money in the bank, leaving Indiana's governor to do the easy part, give it away. The governor's attorneys will say giving away $300 can't be done, but the judge might tell the governor that it can easily be done and if the governor doesn't hand out $300 checks then he will be guilty of contempt.
Quote:The Indiana Department of Workforce Development has not yet continued payment of federal unemployment benefits this week despite a judge ordering the state to do so temporarily. The state is appealing that decision. "DWD is determining how to proceed because the federal programs no longer exist after their termination on June 19," said DWD spokesman Scott Olson in an email. "There is no action that a claimant needs to take right now. Updated information will be provided on DWD’s website." It's unclear if DWD will pay out benefits during as the challenge to Holcomb's decision is hear in court.

At this point, it's really moot. It's being reported now that they might not even be able to get an appeal until after September 9th. But they're saying that they don't have the funds, and they aren't telling anybody anything. If the laws were applied equally to everyone, Holcomb would be sitting in a jail cell right now. https://www.wishtv.com/news/i-team-8/dwd-stay-tuned-for-federal-unemployment-benefits-put-in-question-by-judge/

Quote:INDIANAPOLIS — Indiana paid out 25,000 claims for federal unemployment benefits in the first day after reinstating them due to a court order. The state said around 120,000 people lost those benefits after Gov. Eric Holcomb ordered they be stopped as he moved to end Indiana's participation in the federal CARES program. ... Those began again July 15, and DWD said 25,000 had already been processed for more than $30 million. Those benefits include the $300 weekly add-on, Pandemic Unemployment Assistance (PUA) and Pandemic Emergency Unemployment Compensation (PEUC). Payments for those will be retroactive to the week ending June 26. The final payment after the governor's order had been made, went out the week ending June 19. Workers who have since found employment will still receive retroactive payments for claims filed for the weeks they were unemployed. If the courts later rule Holcomb can end the federal unemployment benefits in Indiana, no money will need to be paid back from anyone already receiving a payment.
