Supreme Court Chief Justice John Roberts has tried to keep the Supreme Court above the Partisan Fray. Confirming Kavanaugh would deal “a significant blow to the perceived legitimacy and integrity of the court.”

During a case last year involving gerrymandering, John Roberts said that if the court issued a ruling that favored the Democratic Party, people would ask, “Well, why did the Democrats win?…It must be because the Supreme Court preferred the Democrats over the Republicans.” A partisan reputation, he insisted, “is going to cause very serious harm to the status and integrity of the decisions of this court in the eyes of the country.” Since his appointment as chief justice in 2005, Roberts has also expressed concern that “partisan hostility” during Supreme Court confirmation hearings threatens the court’s integrity.

It was hard not to wonder what he was thinking during Thursday’s Supreme Court confirmation hearing, when the most vocal partisan hostility was coming from the nominee himself, Brett Kavanaugh. John Roberts has done quite a bit to try to lift up the institution as a fair and neutral place to bring claims. Kavanaugh’s partisan outburst during his testimony before the Senate Judiciary Committee has raised the possibility that Congress will confirm the most openly politically biased Supreme Court justice in modern history. His addition to the court threatens to undermine public confidence in an institution already struggling under criticism that it’s a captured agency, dancing to special-interest tunes.

Yup. You nailed it in your Op-Ed, Mr. Brady. Connect the dots and because somebody was accused of sexual misconduct 30+ years ago with no evidence to support it, he must be a pedophile as well.

THIS type of stuff is why the Leftists will lose and the Moral Panic is about to end. The claims will only continue to get further and further outrageous and on the fringe until the independent voters and the center-left turn their backs on the extreme. Once upon a time, I had a personality test done at work; it was for us to understand our personalities and approaches in the hope that we would work better together, and one aspect of my personality is that I like to consider ALL possibilities before making a decision. I think that is why I'm one of the people here saying ... Don't rush to judgment ... which it seems MOST people are intent on doing. But IMHO as long as there are equally-possible scenarios which explain events and EVIDENCE doesn't definitively point us in one direction or another then we should withhold judgment until better information comes along. For example there are women who said that Kavanaugh did (or may have) sexually assaulted them, but there are people who were there - pointed out as witnesses or friends by the self-proclaimed victims - who said HUH?? I don't even know you or I don't remember any such thing.

How to account for these accusations - and lack of corroboration?

Well, it DOES seem that there was a lot of drinking going on. That's one thing that people agree on. So it's very possible that these things happened, but unless they happened TO YOU, nobody would notice or remember out of sheer drunkneness. Possibly these events happened but the witnesses were also complicit, or don't want to get tainted/involved, and are backing away from the story.

It's also possible that the victims simply mis-remember; even THEIR memories are fragmentary, and piecing together fragile impressions warps them in some way (See FALSE MEMORY) especially if you combine it with a ideological motivation to put someone's face in the picture as the attacker. Or maybe the self-proclaimed victims are looking to make money or are attention-seeking.

At this point ... especially with the denials/lack of corroboration of the potential witnesses who were supposedly involved ... the evidence is equivocal.

There's ONE thing that I wouldn't rely on, however... people who "talked about" an event but who didn't witness it PERSONALLY. Unless YOU WERE THERE or there was a POLICE REPORT filed, hearsay shouldn't count.

I know how stories can run like wildfire and get completely overblown in the process; seen it happen at work and the inet only makes it worse.

In fact, I have a funny story about that. Maybe later.

And now for the funny story.

I did something at work that could have gotten me in hot water. I was talking with a guy, let's call him YYYY, in another department about how rumors can spread with NOTHING behind them because he was saying that with so many rumors about *** that there must be something behind them.

So I bet him that I could start a rumor about HIM. Now, you have to realize that this was one straight-laced guy. He was married, always talked about his family, worked hard at work and was very concerned about doing the job right, did at lot at home (he said), never drank to excess that I saw or heard of, never even swore that I heard (said "gosh" in private conversation when I might have said something stronger), never made a pass at anyone ... And just to add to the straightlaced impression that others had of him, he was Japanese, which many people interpret as being particularly polite and rules-oriented.

He said that if I could start a rumor about him he owed me a beer.

It was INCREDIBLY easy. I just walked up to some of his co-workers over the course of a week, and asked, in a quiet/concerned tone of voice Say, have you heard about YYYY?. And when I got the inevitable No! What?? I would act confused and say Well, I guess if he hasn't told you I better not say and walk away.

Mr YYYY got a little pissed at me because after two weeks he said They think I'm getting divorced. Or going to be a father again. Or getting fired. Or getting promoted. I want you to stop it. (He also wanted to know how I did it.) So I had to go around to his coworkers and explain it was all part of a joke and there was nothing behind it, which killed the rumor pretty quickly.

But I was shocked ... shocked, I tell you! ... how easily and quickly I could start a rumor. And Mr YYYY was also shocked ... and I would say also disappointed, upset, and a tad angry .... that people that he had worked with for EIGHT YEARS or more with unfailing professionalism and courtesy .... could tag him so quickly over literally nothing at all.

There's word that there will be an investigation into how this was handled, and how the information was leaked. I'd be more than a little worried about that if I was Feinstein. Unlike a 30+ year old rape investigation that has no corroborating witnesses, this would have happened only a few months back and there will be plenty of electronic evidence of it taking place if it did.

I'm glad Ford is going to get 3/4 of a million dollars at this point. Her family shouldn't have to pay for any security costs either. The Dems in power shamelessly used her and put her in that position. If the investigation shows wrong doing, those involved should be removed from their positions immediately, and the Ford's security costs should be paid for out of their pensions.

But it’s pretty clear that a key driver of pro-Kavanaugh sentiment from the grassroots to the White House and, likely, to Kavanaugh himself is simply a conviction that what Ford said he did is not seriously wrong.

Kevin Cramer (R-ND), currently a candidate for US Senate, is one of the few to actually say what conservatives largely seem to think about this: that since Ford got away, it’s essentially a “no harm, no foul” situation. Cramer called the Kavanaugh accusation "absurd" because they were drunk and assault attempt "never went anywhere."

CNN ran a telling segment featuring Republicans who simultaneously maintained that Ford’s accusations were an outrageous smear campaign and that Kavanaugh is merely accused of doing things that every boy does.

You are not just a little bit wrong, Signym. I don't see him as guilty of a 35 year old crime. But Kavanaugh did make a decision last week to handle these allegations from day one with angry denials and weird dissembling. Kavanaugh made statements highly hostile toward all Democrats in general, while Chief Justice John Roberts wants his court to be non-partisan. The future Justice Kavanaugh could be making angry denials and weird dissembling about his written Supreme Court opinions when he is accused in the future of being highly partisan instead of highly learned about law.

Judge Kavanaugh is certainly guilty of Colluding with the biggest Enemy the Democraps have! Oh, I remember reading that criticism of Thomas many many years ago ... a history of his votes and how closely they mirrored Scalia's, along with an analysis of his written opinions. In fact, at the time of that analysis, I believe he had written ZERO opinions; altho I could be wrong. Over the years, whenever a SC ruling came down, I never found any reason to change that opinion of Thomas. You never hear his opinions quoted, for example.

Once upon a time, I had a personality test done at work; it was for us to understand our personalities and approaches in the hope that we would work better together, and one aspect of my personality is that I like to consider ALL possibilities before making a decision. I think that is why I'm one of the people here saying ... Don't rush to judgment ... which it seems MOST people are intent on doing. But IMHO as long as there are equally-possible scenarios which explain events and EVIDENCE doesn't definitively point us in one direction or another then we should withhold judgment until better information comes along. For example there are women who said that Kavanaugh did (or may have) sexually assaulted them, but there are people who were there - pointed out as witnesses or friends by the self-proclaimed victims - who said HUH?? I don't even know you or I don't remember any such thing.

How to account for these accusations - and lack of corroboration?

Well, it DOES seem that there was a lot of drinking going on. That's one thing that people agree on. So it's very possible that these things happened, but unless they happened TO YOU, nobody would notice or remember out of sheer drunkneness. Possibly these events happened but the witnesses were also complicit, or don't want to get tainted/involved, and are backing away from the story.

It's also possible that the victims simply mis-remember; even THEIR memories are fragmentary, and piecing together fragile impressions warps them in some way (See FALSE MEMORY) especially if you combine it with a ideological motivation to put someone's face in the picture as the attacker. Or maybe the self-proclaimed victims are looking to make money or are attention-seeking.

At this point ... especially with the denials/lack of corroboration of the potential witnesses who were supposedly involved ... the evidence is equivocal.

There's ONE thing that I wouldn't rely on, however... people who "talked about" an event but who didn't witness it PERSONALLY. Unless YOU WERE THERE or there was a POLICE REPORT filed, hearsay shouldn't count.

I know how stories can run like wildfire and get completely overblown in the process; seen it happen at work and the inet only makes it worse.

In fact, I have a funny story about that. Maybe later.

And now for the funny story.

I did something at work that could have gotten me in hot water. I was talking with a guy, let's call him YYYY, in another department about how rumors can spread with NOTHING behind them because he was saying that with so many rumors about *** that there must be something behind them.

So I bet him that I could start a rumor about HIM. Now, you have to realize that this was one straight-laced guy. He was married, always talked about his family, worked hard at work and was very concerned about doing the job right, did at lot at home (he said), never drank to excess that I saw or heard of, never even swore that I heard (said "gosh" in private conversation when I might have said something stronger), never made a pass at anyone ... And just to add to the straightlaced impression that others had of him, he was Japanese, which many people interpret as being particularly polite and rules-oriented.

He said that if I could start a rumor about him he owed me a beer.

It was INCREDIBLY easy. I just walked up to some of his co-workers over the course of a week, and asked, in a quiet/concerned tone of voice Say, have you heard about YYYY?. And when I got the inevitable No! What?? I would act confused and say Well, I guess if he hasn't told you I better not say and walk away.

Mr YYYY got a little pissed at me because after two weeks he said They think I'm getting divorced. Or going to be a father again. Or getting fired. Or getting promoted. I want you to stop it. (He also wanted to know how I did it.) So I had to go around to his coworkers and explain it was all part of a joke and there was nothing behind it, which killed the rumor pretty quickly.

But I was shocked ... shocked, I tell you! ... how easily and quickly I could start a rumor. And Mr YYYY was also shocked ... and I would say also disappointed, upset, and a tad angry .... that people that he had worked with for EIGHT YEARS or more with unfailing professionalism and courtesy .... could tag him so quickly over literally nothing at all.

GOSSIP! HEARSAY! DON'T BELIEVE IT!

Kavanaugh’s defenders have tried to frame the question about Kavanaugh’s drinking as: Are you really saying his youthful excesses are disqualifying? But that’s not the right question. It won't make a difference. A while ago I asked the question 'what will happen if the FBI finds nothing?' Because I suspected that - as is proving to be the case - people will find a way to cling to the narrative they hold so dear, despite a lack of evidence.

Hey SECOND, BUSH proposed the "Patriot Act"; it was passed by Congress. BUSH started warrantless surveillance by tapping into the AT&T exchange in San Francisco (I posted about it at the time). BUSH also eliminated the concept of habeas corpus (Military commissions Act 2006).

OBAMA expanded the warrantless surveillance to include, well, everyone. In addition, he held Star Chamber proceedings and developed a "kill list" for a secret drone strike program (commanded by the CIA) which included an American citizen. So much for jury trials!!

Congresspeople of BOTH parties and Presidents of BOTH parties have torn up the Constitution, irrespective of who was on the Supreme Court.

Kavanaugh will likely be confirmed.

Get over it.

The focus now should be on Congress. If Congress writes explicit, comprehensive, proactive laws which protect the rights of ALL Americans and which benefit working Americans ... or if Congress REPEALS or FAILS TO EXTEND destructive laws ... or responds adequately to Executive Orders ... then it doesn't matter WHO is on the Supreme Court.

Can we count on Dems to do that? Or will they continue with their divisive identity politics and paranoid focus on other nations?

I heard something interesting the other day on NPR. If I understand this correctly, men are 10% MORE likely to vote REPUBLICAN as a result of the Kavanaugh hearings.

Sure, some "people" will cling to that narrative, but those same people wouldn't have been dissuaded even if time machines were real and you could take them back in time to witness nothing happening. The exact same could be said about some people on the other side who would deny what they saw if you could go back and show them the events going down exactly as alleged.

These people on either side are the extreme minority in the country.

On any given night only about 2 to 3% of the people in America are watching one of the Cable News Networks. Nobody could say that ALL of people tuning in all the time are extremists on either sides, but they are the ones most likely to be.


I'm starting to believe that most people are somewhere in the middle, they are rational, and they don't like being dictated to by anybody how they should think and feel about anything.


What we need are the facts. There needs to be a lot more transparency in the government that is supposed to be serving the people. There absolutely should be a complete and unredacted FBI report regarding this investigation after what the MSM has put the people through the last few weeks over the issue.

The democrats have a long history of failures starting in 1995 that brought us to this point. Despite that history, the party doesn't seem to feel the need to do anything different.

With the brief exception 2007 through 2011, republicans have held the House of Representatives since 1995. (Before that, democrats held the House nearly continuously for 60 years.)

In 2011 governorships flipped to republicans 29 to democrats 20 and one independent; the current number is now republicans 33, democrats 16, and one independent.

In 2015 democrats lost the Senate.

Democrats lost the presidency in the 2016 elections.

I agree with you completely! But facts don't change minds that are already made up. If anything, people will dig in deeper to reduce the discomfort of 'cognitive dissonance'.

Perhaps if the government and the media started the process of transparency, over time it would engender trust. Perhaps people would be more willing to listen to and credit facts over narratives. Maybe, over time, it would change the nature of our politics.

In this IMMEDIATE timeframe, though, I'm not sure if it would help.

BTW, one thing I do find fault with is the characterization of the FBI's efforts as an 'investigation', which gives people the idea that the FBI is looking for any criminal activity. It's more like a deep pre-employment vetting.

The only thing that might stop a Kavanaugh appointment are $wildcard$ republicans who might vote against the party line.

At this point, I'm actually going to predict that you're going to see a few Democrats that vote against the party line. It's already a 99% chance or more that he's getting sworn in and there are a couple of tight races that are coming up. I think people are going to be surprised how this vote goes.




As for how effectual complete transparency of this investigation goes, I can't disagree with you, but in light of how prevalent this story was in the mainstream for the last few weeks, I can't think of a better example of a time where this should start being the norm.
