Everyone has a theory. But what if this case means nothing at all?

During the five weeks of her murder trial, Lindsay Clancy, the Massachusetts mother accused of murdering her three young children in 2023, spoke barely a word. She has been on display for the entirety of her livestreamed trial, sitting in her wheelchair beside her lawyer at the defense table. At one point, when the prosecution walked the jury through the children’s autopsy reports, she hunched over, racked with sobs, crying out, “I can’t do this!” But mostly, Clancy has remained silent and wide-eyed, her gaze wandering around the courtroom as though searching for something.

The judge in the case has just declared a mistrial because the jury has been unable to reach a unanimous verdict. But the viewing public, in the absence of Clancy’s own explanation of her experiences leading up to and after the killings, has projected its own ideas onto the case and rendered its own verdict. Some people have interpreted Clancy’s trial as a referendum on women’s postpartum mental health. Others have developed elaborate conspiracy theories maintaining that Clancy’s ex-husband, Patrick, is actually the guilty party. Still others have construed Clancy’s story as evidence for their own niche political beliefs.

These are all comforting narratives, in some sense, because they imply an underlying logic that imbues the events with meaning and provides a road map for catharsis. Yet the jury’s inability to arrive at a verdict makes plain that a careful evaluation of the facts does not yield an easily intelligible conclusion. The reality may be darker and more despairing: that something so dramatic and destructive could, in the end, mean nothing at all.

As Clancy’s trial has progressed, dozens of women wearing pink have appeared at organized rallies outside the courthouse in Plymouth, Massachusetts, holding signs signaling a kind of support for her. “Any one of us who have dealt with mental health, anxiety, depression, postpartum—I think we just know that any one of us could be sitting in her chair,” the organizer of a recent event billed as an opportunity to “stand in peace for Lindsay” told a local news outlet.

There is something inherently unsettling about any public expression of support for a confessed killer, but these gatherings and their associated social-media movements have not seemed aimed at improving Clancy’s odds of success in court. Instead, these demonstrations suggest that Clancy has for some women become a symbolic figure: the devoted but suffering mother martyred by the relentless, punishing demands of her children’s early years and left to suffer by a flawed and fractured health-care system. Many women have felt overwhelmed to the point of drowning in the months after giving birth, and many have sought help but failed to receive it. Clancy’s case, in her supporters’ imagination, appears to be the sum of all those biological and social hazards. What happened to Clancy, in this view, was predictable, and thus preventable.

That’s a tidy narrative about what took place in Duxbury that night in 2023, when Clancy strangled her three young children to death, then attempted to end her own life by swallowing prescription drugs, slashing her neck and wrists, and then jumping out of a window. A possible upshot of this view is that it may raise awareness about the inadequacy of treatment options for postpartum mental illnesses—to the degree that raising awareness about any given issue ever meaningfully changes anything. And some elements of it seem inarguably true, such as the idea that Clancy’s psychiatric care was woefully uncoordinated. But this theory also has the odd effect of making Clancy the star of her own murder trial, for whom the viewer at home may be encouraged to root, which risks eliding the gravity of what she did.

Simultaneously believing that someone is relatable and vulnerable and that they are nevertheless guilty of and accountable for heinous crimes is, however, cognitively tricky. I suspect that that tension is the origin of a similarly enormous groundswell of conspiracy theorizing about Clancy’s case that has pervaded social media. Although those theories vary, they generally maintain that Clancy is factually innocent of the killings and that her ex-husband is instead guilty of murdering the children, attempting to murder Clancy, and framing his ex-wife for the deaths. Proponents typically cite as proof any number of purported facts presented at trial, such as that Clancy’s fingerprints weren’t found on the exercise bands used to strangle the children, or that her core body temperature upon her arrival to the hospital called the prosecution’s timeline of events into question. Clancy is, in these tellings, a victim of spousal abuse akin to torture, whose partner cruelly exploited her postpartum suffering in order to dispose of his family.

That, too, is a tidy story with symbolic significance: For those who deny her guilt, Clancy’s life and fate become a nightmare of female subjugation. This view morphs a reasonable claim that Patrick ought to have been more attentive to Clancy’s deteriorating mental state into a much stronger insistence that he is in fact fully culpable for what happened, having carefully plotted the entire sequence of events. Clancy’s story, then, becomes a parable about male violence against women.

Yet this embrace of Clancy as the true victim of her crimes has triggered an online backlash on the political right that maintains that liberal-female support for Clancy is a naked expression of latent female tendencies toward violence against children and an indication that liberal women are unstable and dangerous. (This despite the fact that women actually have varying views on the case, and that men kill the majority of children murdered in the United States.) That thinking also mistakenly takes Clancy to be a representative Everywoman, this time standing in for the threatening volatility of liberal women writ large.

All of these views of Clancy’s case strive to make sense of her alleged crimes: This trial must mean that mothers in America are crucially underserved, or that men in America are chauvinistically exploitative, or that women in America are secretly a danger to themselves and others. Some of those readings are more compelling than others, but they all seem to overemphasize what is generalizable about the case while understating what is unique, particular, and hyper-specific about what happened. The broader the statements about this case are, the less they have to do with the events as they really occurred.

Clancy’s experience was inarguably extreme. If, as the defense claims, she was suffering from postpartum psychosis, it was an ultra-rare expression of an already uncommon condition. Her psychiatric care was, per a subsequent malpractice lawsuit, allegedly mismanaged, and the severity of her purported adverse reactions to widely used medications was highly unusual. She was undoubtedly suffering in the months leading up to the murders, and it’s possible that the right degree of support could have prevented what happened, but it’s likewise true that nobody could have reasonably predicted what happened. More than any general theme or idea, Clancy’s crimes seem to have hinged on a moment of catastrophic dysfunction. Life, in the end, defies a great deal of neat storytelling.

For the past several weeks, Clancy’s case has been heard in the court of public opinion. At this point, people seem desperate for answers about why these deaths happened and what they mean, or at least a guarantee that something we’ve learned from this case will prevent similar tragedies from happening in the future. Many such onlookers have hoped that the trial verdict will supply such insights. This hope now appears to have been in vain.

Prosecutors in Clancy’s case must now decide whether to retry her, negotiate a plea deal, or drop the charges altogether. No matter what they choose, this case will continue to frustrate those trying to make sense of it.

Clancy herself, with her haunted, bewildered gaze, seems to already understand what her well-meaning supporters and their opponents can’t yet come to terms with: There is no making sense of what happened, and no greater wisdom to learn from it. At the core of all of this is a void, and nothing emanates from it but the assurance of everlasting pain.

SIX, I've been thinking about this.
So I'm doing what I suggested to SECOND: Changing the variables and testing my gut reactions to try to understand why I feel the way I do about events.

First of all, it's possible to be nutty as a fruitcake and still plan meticulous crimes. The Unabomber, Ted Kaczynski, is widely accepted as off his nut, and yet he managed to elude investigators for years. So the fact that someone preplans a crime doesn't necessarily mean they're sane.
Is he evil? Is he nuts?

James Holmes. Neuroscience grad student. Killed 12 ppl in a Colorado movie theater. No previous brushes with the law, had been.actung strangely for a while, no known motivation. Defense said he was schizo, jury disagreed and sentenced him to IDK how many lifetimes in prison. Nuts? Evil?

A man kills his three children ages 10-16, and his wife. He thinks he's saving them from a loose lifestyle. He leaves, remarries, lives a whole nother life and has a whole nother family. (Forensic Files). Are you outraged?

We watch Forensic Files (a true crime documentary). And we get to see a lot of crimes, the vast majority of murderers are men. I'm not outraged bc, I guess I don't expect any better from men. Sad to say.

So what is it about THIS case?
I think the difference is that men can't identify with moms, so they identify with the children.

I can't speak for ALL women, but not only do I think that women SHOULD be better, I assume they ARE better. I know that it heppens, that some women cold bloodedly kill their children, but my default is that a woman WOULDN'T kill her children. That women do the best they can to be good moms, unless they're being driven by something extreme. A psychosis or something like.

But IDK. Maybe she's just an evil byatch pretending to be nuts.

In any case, maybe the first thing to resolve is: Is "insanity“ ever a defense?

What this thread really needs is an injection of even more crazy, from corrupted minds the likes of Nilbog Bung Betty and kookoo kiki.

Currently, we have mostly 2 regulars arguing back and forth. One who has finally sided with the Party which says Moms should Not Kill Their Kids. He keeps ending his discussion, but then restarts it.
And the other is our resident Jihadi Cheerleader and Terrorist Apologist, who has supported killing kids, sometimes before birth, sometimes after birth, sometimes because innocents are in the way of her favorite Terrorists. And now, she seems to be arguing herself into confusion.
She even mentions bellweather events or cases on the subject, yet still feigns ignorance.
RN Andrea Yates is on the list in the thread I already linked. From June 2001 (Haldol, Remeron, Effexor, Welbutrin), her case was one of the first to spotlight the homicidal results of psychotropic drugs. Because her husband was with NASA, she had "the best" medical care - which really just meant the unlimited supply of the most dangerous drugs.
James Holmes in 2012 (Clonazefam, Zoloft/Sertraline) is also on the list. His case was the first one where police failed to keep the facts hidden until after trail - in less than 2 weeks it was revealed which drugs had caused his homicidal rampage.

None of the other cerebral stragglers can keep up.

I think that whether someone is "crazy" or not should have a bearing on sentencing. But I think our whole approach to crime is kind of borked.

Maybe what we do with a person after they've committed a crime should be based more on whether they'll do the same again, and the risk to society. Bc whether you're crazy or just evil, if you pose a risk to society you need to be isolated if you can't be reformed. Whether you're in jail for the rest of your life or in a psych ward, you're still locked up.

But maybe we should be focusing on preventing murder, rape, pedophilia etc. to begin with. There's something seriously wrong with our so-called first world society where we have such a high murder rate, far above any other.

I think maybe violent crimes arise in the individual from three levels. Making a clumsy analogy to computers, there's the hardware (brain), software (upbringing, experience) and firmware (hormones and neurotransmitters).

I don't know what the answer is. I know that threat of punishment won't stop ppl from going schizo or restore absent impulse control. It doesn't seem to even stop most criminals bc they wind up back in jail, over and over. Threat of punishment would probably stop the person who calculated ahead of time ... most people, really. So punishment deters the detestable, but not the malfunctioning or badly programmed.

What Clancy did was horrible. I can't imagine what her eldest child went thru. And I think there are evil people, but I'm not sure Clancy qualifies. How can you be a good mom for eight years and then SUDDENLY become evil? I don't get it. I don't understand.

To me, evil people are so devoid of empathy they kill or harm others for fun or profit or convenience. Consciously.

I've known evil people. People who tortured their children for years. Even an evil child, whose small pets mysteriously died under his care, and whose playmates kept having mysterious, damaging "accidents". Some people are born evil. Others are made that way.

But my opinion is that people who are actively hallucinating aren't responsible for their actions. They're still dangerous, they still need to be locked up, but they wouldn't have done what they did if they were in their right minds. And punishment, revenge won't prevent people from going crazy in the future.

AFA your mom is concerned, given her disorder it sounds like she did the best she could under distress. I'm sorry you went thru that.

Clancy mistrial distracts from moms who actually deserve empathy

Lindsay Clancy killed her children and received a mistrial and a wave of support. A Virginia mother let her child go for a walk in her gated community and was convicted of 'delinquency.

Unlike the rest of the country, I have tried to stay away from the nonstop drama and news coverage following the Lindsay Clancy murder trial.

Every time I see Clancy’s face, all I can think about is her taking each of her three innocent children – one by one – and strangling the life out of them in the family's basement.

It makes me sick.

This trial wasn’t about whether she committed these heinous acts – it’s whether she should be held criminally responsible. After days of deliberation, a deadlocked jury forced the judge on Sept. 4 to declare a mistrial. That would likely mean a new trial.

Judge William Sullivan gave Clancy’s defense attorney an hour for a last-ditch appeal to remove the one holdout juror out of 12 who refused to acquit Clancy for her actions.

Clancy’s defense has argued she isn’t criminally responsible because she was suffering from “postpartum psychosis” (the insanity defense) when she murdered her children. Prosecutors argued Clancy acted “intentionally, rationally, and swiftly” to kill her children. And one juror appears to have agreed.

I’m not going to try to play armchair detective or attorney in this case.

All I care about is that justice prevails for the three young children who lost their lives at the hands of their mother.

Something that shocked me throughout this trial was all the women who spoke in defense of Clancy, as my colleague Nicole Russell has detailed. Many of them claimed they identified with Clancy’s disgusting actions.

Whether Clancy was in her right mind or not, she murdered her babies. It’s with them that my sympathies lie.

Hopefully, prosecutors learned from this trial and will modify their approach in a subsequent one. Because Clancy needs to pay for what she did, and she doesn’t deserve the adoring fans she’s amassed.

For instance, they’ve been showing in droves outside the courtroom, wearing pink in Clancy’s “honor.” I’m not sure what exactly that says about our society, but it’s nothing good.

Here's a mom who actually deserves our sympathy

If there’s a mom to feel empathy for, I would suggest you look to Karyann Parkinson of Virginia.

The mother of five was convicted recently of “the delinquency of a minor” – the child is her own. It’s a first-degree misdemeanor and comes with a six-month jail sentence. The judge suspended the sentence, pending good behavior, but the conviction remains.

Her crime? She allowed her 5-year-old son to go for a walk by himself in their gated community.

Lenore Skenazy, founder of the Free-Range Kids movement, recently detailed the case in Reason.

Someone saw the child walking and alerted security. Police were then called, and Child Protective Services also showed up and investigated Parkinson for abuse and neglect. They have since placed her on the state’s child abuse and neglect registry.

Talk about insane.

This is a mother who seems to love her family and was simply giving her son a little taste of independence. She didn’t harm him in any way.

If Clancy, who killed her children, could attract sympathetic women and moms to stand for her, I would like to think this mom could also garner an army of women to defend her.

Yet I doubt she will.

The Path to the Lindsay Clancy Mistrial

Both the prosecution and the defense tried to tell tidy stories. But, in the end, five weeks of testimony from more than eighty witnesses couldn’t resolve the central mystery of Clancy’s state of mind.

Some sort of resolution to the Lindsay Clancy trial seemed finally within reach on Thursday afternoon when, after six days of deliberations and two reports of deadlock, word came from the jury room. It wasn’t a verdict but an apparent complaint about a holdout. The foreperson wrote that a single juror was refusing to follow instructions from the judge, William Sullivan, on the standard for proving guilt beyond a reasonable doubt. Clancy, who was on trial for murdering her three young children, had pleaded not guilty by reason of insanity. The note itself wasn’t made public, but Kevin Reddington, Clancy’s defense attorney, said that it “clearly and unequivocally” showed an 11–1 split, with the lone juror blocking an acquittal. Reddington immediately asked Judge Sullivan to remove the dissenting juror, and a long, heated scrum followed at the bench. As lawyers crowded in, Reddington could be seen slapping down a sheaf of papers. Clancy, who was left paralyzed by a suicide attempt that followed the killings, was brought forward in her wheelchair to listen. Prosecutors argued that the jury’s dispute reflected not misconduct but a legitimate disagreement over the evidence. Judge Sullivan questioned the jurors one by one, removed none, and, on Friday morning, over the defense’s objections, refused to investigate further. Shortly before noon, after thirty-eight hours of deliberation, the jury returned a final message. “With a heavy heart,” it read, they still had not managed to come to a verdict. Reddington filed an emergency appeal seeking to block a mistrial, but the effort failed, and Judge Sullivan declared one anyway.

It should come as no surprise that the jurors had trouble reaching unanimity. Five weeks of nationally televised testimony, from more than eighty witnesses, did not settle the central question: What was going through the defendant’s mind when she killed her kids? The prosecution and the defense never disagreed about the case’s basic facts. One evening in January of 2023, after sending her husband out to pick up dinner, Clancy fatally strangled Cora, who was five, Dawson, who was three, and Callan, who was eight months old, in the basement of the family’s home in Duxbury, Massachusetts; then she cut her neck and wrists and jumped from a second-floor window. The jury was asked to determine whether Clancy, a labor-and-delivery nurse who’d been in the midst of a well-documented mental-health crisis, should be exempt from criminal responsibility under Massachusetts law, either because she lacked the capacity to understand that what she was doing was wrong or because she was unable to stop herself from doing it.

Day after day, Judge Sullivan ordered jurors to ignore press coverage and commentary on social media, where self-appointed sleuths combed through testimony, diagnosed Clancy from afar, and seized on minor inconsistencies to construct a baseless theory that her husband was the culprit. The jury could hardly have missed the divisive displays outside the courthouse. Pink-clad Clancy supporters gathered by the dozens, holding up placards that read “COMPASSION BEFORE JUDGMENT” and “LISTEN TO MOTHERS,” while a smaller counter-presence carried signs of its own: “REMEMBER THE REAL VICTIMS”; “KIDSLAUGHTER.” As testimony came to a close, the judge granted a request from the defense to include involuntary manslaughter as a possible verdict, giving jurors an option in between convicting Clancy of murder and finding her not guilty by reason of insanity. In the end, though, there was apparently no compromise to be found.

In most states, defendants bear the burden of proving their insanity. In Massachusetts, it falls to prosecutors to prove criminal responsibility beyond a reasonable doubt. Leading the prosecution were Jennifer Sprague and Shanan Buckingham, a pair of stolid assistant district attorneys in structured suits and dark rectangular glasses. During opening statements, Buckingham, who wore her hair pulled back with the sort of bow that she said Cora had loved, promised to reveal an “extremely controlling, meticulous, and manipulative” version of Lindsay Clancy, a sinister inverse to “pictures you’ll see of the doting mother, the dedicated nurse.” But in the course of the trial this portrait never materialized. Many of the state’s own witnesses—a pediatrician, a preschool teacher, a colleague of Clancy’s, a local friend—supplied favorable character evidence for the defense, sometimes even before Reddington rose to cross-examine them. Elaine Rossi, the family’s nanny, repeated what she’d told the state police: “I observed a wonderful mom who loved her kids.”

No witness complicated the prosecution’s case more than Clancy’s ex-husband, Patrick, who spoke of his former wife with the same sympathy that he has maintained since their children’s deaths. He recalled Clancy inventing songs for them and cooking green eggs and ham for Cora, who adored Dr. Seuss. “She was very dedicated,” Patrick said. “She did everything.” During his testimony, the prosecution produced a spiral notebook in which Clancy had left instructions for caretakers on when to put down the baby, which vegetables to prepare for dinner, how to cut up the sweet potatoes. Was all this meant to conjure an insidiously controlling mother? Patrick testified, “I would’ve done the same.”

To supply a motive, the prosecutors tried to assemble evidence that Clancy had simply soured on family life. They got Christopher Clancy, Patrick’s father, to allow that, at Thanksgiving, she’d grown “a little frustrated” when one of her children wouldn’t be seated for dinner. They introduced a much discussed Facebook post, written a year and a half before the killings, in which Clancy had called Dawson, who was then nineteen months old, “the most difficult human I have ever encountered.” More than once, though, the prosecutors appeared oblivious of where their own lines of inquiry would lead. They confronted Patrick with text messages about an anniversary trip that he’d arranged a month or so before the killings, as if to contest his account of the family’s crisis, only for him to clarify that the plans were scrapped because Lindsay was too unwell to go. They held up prescription bottles still filled with pills, to suggest that she hadn’t been taking the medication she blamed for her deterioration, just for Reddington to haul out a bag containing empty bottles that the police had overlooked in a nightstand drawer.

Sprague seemed most self-assured when she pulled on latex gloves to lift the grimmest exhibits out of evidence bags: the clothes that the children were found in—Cora’s pink robe, Dawson’s dinosaur underwear, Callan’s snowflake-printed onesie—and the exercise bands that their mother had used to strangle them. But even the urge to keep jurors trained on the brute horror of the killings could get the better of the prosecution. While cross-examining Sue Clancy, Patrick’s mother, about the deaths of her grandchildren, Buckingham established that Sue was an active member of the Catholic Church, then asked, “So you’re aware that murder is considered a mortal sin?” Before Sue could answer, the defense objected, Judge Sullivan banged his gavel, and the question was stricken from the record.

The prosecution wasn’t alone in straining for a tidier story than the evidence could sustain. Reddington, a beetle-browed veteran trial lawyer with a restlessly combative style, worked to cast Clancy as a casualty of the psychiatric establishment, misdiagnosed by doctor after doctor and fobbed off with a succession of thirteen hastily prescribed medications. As testimony showed, though, Clancy was never on more than two or three prescriptions at once, and she chose to stop several antidepressants well before they could have taken effect. According to medical records, she acknowledged to the psychiatrist Jennifer Tufts, “I keep reaching out to different people and not sticking with the plan.” Reddington’s cross-examinations of Clancy’s health-care providers yielded less and less as the trial progressed. At one point, he made a show of close reading Tufts’s notes to suggest that she’d recorded and then ignored a possible sign of bipolar disorder. (She hadn’t; Reddington’s argument hinged on an ambiguous comma.) The defense faulted Clancy’s providers for missing this particular diagnosis, but Rebecca Jollotta, a psychiatric nurse practitioner who took over Clancy’s care, testified that she had raised the possibility herself, at an appointment that Patrick attended. As Jollotta recalled, he interrupted her to say, “My wife is not bipolar,” and Clancy said nothing.

The haphazard trajectory of Clancy’s treatment does leave one to wonder how she might have fared with regular talk therapy and earlier inpatient care—both of which her providers had recommended—or with fewer prescriptions, better coördination among hospital systems, and a safety plan that accounted for the small but real risk of filicide. Three weeks before the killings, Clancy voluntarily admitted herself to McLean Hospital, a renowned psychiatric facility outside Boston. After five days, she asked to be discharged so that she could attend her daughter’s birthday party. Keeping her there against her will would have been a drastic intervention, permissible by law only if doctors believed that she was likely to cause serious harm. But Clancy’s medical providers had a limited view of the danger. She’d told them that she was having suicidal ideations but consistently denied having a plan to kill herself, and though she’d told her mother and Patrick about thoughts of harming her children she never disclosed those thoughts to a doctor. Reddington had to talk around this impasse, badgering Clancy’s providers about matters such as their use of telemedicine, as though this wasn’t standard practice. “So you couldn’t give her a hug, could you?” he asked Tufts, apparently trying to brand her as callous. She replied, coolly, “That’s not actually something that psychiatrists typically do.”

Clancy’s trial has generated the most intense national conversation about postpartum mental health in recent memory. Many commentators have, fairly, lamented that it has taken such a horrific tragedy to raise awareness of the issue; they point out that the kinds of struggles Clancy experienced are both common and underdiagnosed (roughly one in eight new mothers reported symptoms of postpartum depression in a recent survey), even if the actions she took are exceedingly rare. That Clancy was universally thought of as an excellent mother and an authority on infants—not to mention that her family was white, photogenic, and comfortably suburban—made her a potent symbol. If this could happen to a woman so seemingly with-it and well resourced—one with adequate insurance, months of maternity leave, medical expertise, a husband who worked from home, supportive in-laws a few towns over, and parents ready to drive in from out of state—then what hope was there for other troubled mothers?

In the courtroom, though, the general impression of Clancy’s togetherness cut against the defense’s argument that she had lost control. Reddington struggled to marshal legible proof that she was experiencing psychosis, because none of the providers who treated her before the killings had observed signs of it. Instead, he had to account for evidence that she appeared cogent on the day in question: that she’d taken her daughter to a pediatrician’s appointment in the morning; that she’d sent Patrick to pick up dinner from a relatively distant restaurant from which they’d never ordered takeout, then added on a last-minute stop at CVS, which kept him out of the house longer; that she sounded lucid when he called from the store and she picked up, possibly in the middle of the killings; and that one of her first questions, when she awoke in the hospital, was whether she had a lawyer. The defense would have benefitted from calling a specialist in postpartum mood disorders to explain how easily psychotic symptoms can be missed in high-functioning new mothers. That testimony was expected to come from the leading perinatal psychiatrist Margaret Spinelli, who’d attended portions of the trial, but on the afternoon that she was to take the stand Judge Sullivan dismissed jurors early, citing an “unforeseen circumstance.” (Later, Spinelli was dropped from the witness list without explanation.)

Much of Reddington’s case turned on Clancy’s claim that she’d hallucinated a male voice commanding her to kill the children. The defense’s most helpful witness on this front was the forensic psychiatrist Phillip Resnick, who has spent more than half a century studying maternal infanticide. Two decades ago, Resnick helped secure a verdict of not guilty by reason of insanity in the case of Andrea Yates, a Texas woman who drowned her five children in a bathtub. In Clancy’s case, Resnick testified that she’d been “frankly psychotic” in the moment of the killings, experiencing what he called a “delusion of influence”: “It was almost like she was a puppet,” he said, “and someone else was pulling the strings.” But what Clancy didn’t have, and Yates did, was a medical record documenting years of unmistakable psychotic symptoms. Although Clancy had repeatedly complained of intrusive thoughts, some about harming the children, she had never described hearing voices before the killings; nor has she reported them since.

Kirk Heilbrun, a forensic psychologist who assessed Clancy for the prosecution, testified that he is “always very careful” with symptoms that emerge only during the commission of an offense, because they provide “a convenient way of lessening your own culpability.” He added that the voice Clancy described had arrived without the kinds of delusions that usually accompany so-called command hallucinations. (Yates, for instance, was convinced that drowning her children would save them from Satan.) As prosecutors pointed out, even Resnick has written that command hallucinations are easy to fabricate, and Clancy’s own accounts of the voice were inconsistent. She told a hospital chaplain the voice had warned her that neither she nor her children would be safe unless she obeyed; she told forensic examiners that the voice had said to kill the children so that she could kill herself. She told one evaluator that the voice came on only after Patrick’s phone call from CVS, while she stood at the refrigerator preparing to make chicken nuggets. This claim, however, became a distracting point of dispute: Patrick had testified that Dawson was already eating chicken nuggets when he left the house. Such discrepancies would matter less if the voice were not so central to Clancy’s defense. But the prosecution was able to frame the voice as a mark of her unreliability rather than a sign of her illness.

To the extent that the state’s expert witnesses were credible, it was because they acknowledged what the prosecutors themselves tried to play down: that Clancy was in the grip of a serious psychiatric illness, and that her suicide attempt, which the prosecution had treated as half-hearted, was, in fact, deadly serious. Heilbrun testified that Clancy was “still in mourning for those kids,” and recalled her telling him, when he assessed her, “I have lost everything, and I don’t want to be here.” During a cross-examination of the forensic psychiatrist Gregory Saathoff, the prosecution’s final witness, Reddington read aloud the state’s pledge, from its opening statements, to expose a woman who “no longer liked the life she thought she wanted.” Saathoff replied that this characterization “really minimizes what she was going through.” By closing arguments, the prosecution had apparently absorbed the more nuanced story. “There’s no dispute that Lindsay Clancy was suffering from mental illness and that she tried to kill herself,” Sprague told the jury, as though her team hadn’t been calling both claims into question for the better part of the past three years. Now she argued that Clancy had killed the children to clear the way for her own suicide: “And I’m not saying she was happy about it,” Sprague explained. “I’m saying that it was what she had to do to end her misery. But it was a choice.”

If that is true, and Clancy chose to kill herself and take her children with her, was her act rational? Experts for both sides invoked the idea of “altruistic filicide,” a term that Resnick coined for parents who kill their children in the hope of sparing them real or imagined suffering. In his closing arguments, Reddington might have done more to follow the logic, or illogic, of that concept: Could a loving mother see strangling her children as a form of “altruism” unless her illness had substantially distorted her sense of reality? He might have sidestepped the fraught topic of the voice altogether, emphasizing instead the story of a mentally ill woman who fought horrific impulses, hallucinatory or otherwise, until they overtook her.

Throughout the televised trial, the jurors were kept off camera, but earlier this week, as the fourth day of deliberations ended, a fifty-six-year-old Clancy supporter and self-described “crime junkie” was arrested for allegedly filming them leaving the courthouse. Any jury considering this devastating case might have struggled to reach agreement, but it’s hard to imagine that the surrounding spectacle didn’t intensify divisions, making consensus more elusive. If prosecutors decide to retry Clancy, assembling an impartial jury will only be more difficult the next time around. As the case remains in the headlines, so will postpartum mental illness, but will Clancy’s story ultimately encourage women to report disturbing symptoms, or simply deepen the terror and stigma around them?

Roughly two dozen countries have statutes that classify maternal infanticide as less culpable than ordinary murder; the United States recognizes no such distinction, forcing cases like Clancy’s into the contentious framework of the insanity defense. This mistrial is one measure of how poorly that framework fits. Some people will continue to see Clancy primarily as a mother who killed her children; many others will see, above all, a woman who suffered a profound psychiatric crisis. The lingering dilemma, which may prove no easier for a future jury to resolve, is what the law should make of someone who was both.
