This is what I see as the pertinent bits of the thread. I'm surprised that anyone actually managed to get money back. We did buy ships an cards, too. Sad that the devs may not have gotten that money...

I contacted QMx and Fox for a refund. QMx is ignoring me, of course, and Fox said to contact Apple. I'm waiting to hear back from Apple... an automated response said I could expect a reply in 48 hours.

The last nail in the coffin -- the guy I've been talking to at Spark Plug didn't try to convince me to have more patience when I told him I was seeking a refund. He thanked me for my support and joked that I should check out Mechrunner if I was interested in a game that "wasn't being held down by 'the man.'"

I'll wait to hear what Apple has to say.

In any event, it took two tries, but Apple has granted my refund request. They originally said I waited too long to make the request. But I replied that this was essentially a pre-order that has not been fulfilled, and the companies involved refuse to comment on when it will be fulfilled. They said that was a valid reason for a refund. The money showed up in my account today. (Note -- I only requested a refund for the BDH... I didn't see a valid argument for refunding the cards I bought.)

I'm deleting the Cortex from Steam and my iPad, so there won't be much reason to haunt these forums. To my fellow pessimists, I recommend trying to get your money back, too -- especially with the possibility of a time limit. And to the optimists, I truly hope I made the wrong decision to give up and that you do get to explore the 'Verse in the game.

One Company wants to make the game (I'll let you guess who) and the other wants to just scrap the game and make merchandice (I'll let you figure that one out too). btw there would be no merchandice without the game so a pretence of a game is what a certain company is cashing in on. They want to make money at any cost it seems, even lying to fans so they will keep getting money from them.

In reality, Both companies should have been frozen until things could proceed, but that didn't happen. And I'm sure it's common knowledge on what company is making money while another has to fight through everything.

When I say proceed, I actually mean with updates and information to let backers know what was going on.

Now, the one question that no one has even entertained to fight back at FOX for what they are doing ...
(Which is making money from another company taking advantage of a delayed game in lue of a ruling that won't come until they make enough money off it)

...was creating a class action suit against them.

They took money that was to go to dvelopement that didn't seem to go to developement.

I'm not a lawyer, but I kind of thought that might be a little on the side of illegal. You know, take money for one thing and then turn around and the money never reaches there.
I thought that was something akin to Embezzlement (sp).

Since a lot of people, and I do mean A LOT of people, gave money to be in BDH club, that has to be somewhere in the millions if not more.

Theoretically, couldn't supporters like the BDH's actually start a class action suit?
