This helps explain the grave concern within American agencies that information from undercover sources was included in some of the classified documents recently removed from Mar-a-Lago, the Florida home of former President Donald J. Trump — raising the prospect that the sources could be identified if the documents got into the wrong hands.

Mr. Trump has a long history of treating classified information with a sloppiness few other presidents have exhibited. And the former president’s cavalier treatment of the nation’s secrets was on display in the affidavit underlying the warrant for the Mar-a-Lago search. The affidavit, released in redacted form on Friday, described classified documents being found in multiple locations around the Florida residence, a private club where both members and their guests mingle with the former president and his coterie of aides.

Nothing in the documents released on Friday described the precise content of the classified documents or what risk their disclosure might carry for national security, but the court papers did outline the kinds of intelligence found in the secret material, including foreign surveillance collected under court orders, electronic eavesdropping on communications and information from human sources — spies.

The Justice Department filed a 36-page response late Tuesday night to former President Donald Trump's request for a federal judge to appoint a third party to sift through the records seized at his Florida residence. After all this paperwork going back and forth, after Trump and his representatives do not testify, then the FBI forcefully takes the papers away from Trump. The FBI can't know if all the top secrets have been recovered because the Xerox machine can make copies. Trump refuses to testify about making copies. That is why he is still in trouble.

In the filing, federal prosecutors argued that Trump's request for a special master to review the records seized in the search "fails for multiple, independent reasons," and they accused the former president of leveling "wide-ranging meritless accusations" against the U.S. government in the motion he filed last week.

Trump has sought to use his mob of supporters, who threaten widespread violence, to intimidate the attorney general and convince him to back off the investigation. But that tactic has only made it much more likely that he will be indicted; he is making it very difficult for Garland not to prosecute him. If Garland backs off now, it will look like he caved to Trump’s threats.

Trump has also failed to take advantage of the way other high-profile officials caught up in similar cases involving leaks and the mishandling of classified documents have quietly negotiated with top Justice Department officials in order to avoid serious time in prison.

Wealthy and prominent government officials caught up in cases involving classified documents hire expensive and well-connected Washington, D.C., lawyers. Those lawyers, including many who previously worked at the Justice Department, hold private meetings with federal prosecutors long before their client is charged to try to convince the prosecutors not to issue an indictment. If the lawyers are really well connected, they hold very quiet meetings with very senior Justice Department officials — effectively going over the heads of the line prosecutors handling the case — and their client gets nothing more than a slap on the wrist.

Trump has burned so many bridges that it is hard to see how he could ever quietly work out such a deal with the Justice Department.

Magically, officials like former CIA Director David Petraeus are soon back on the lecture circuit and once again appearing on cable news as national security experts. That kind of VIP treatment is unavailable to low-level government whistleblowers in similar leak cases, who can’t afford such ultra-expensive legal defense.

And it is one that is not currently available to Trump either — but not because he doesn’t have the money. Trump has burned so many bridges that it is hard to see how he could ever quietly work out such a deal with the Justice Department. Even his cultishly loyal lawyers have become radioactive with prosecutors, angering the Justice Department with their efforts to politicize the case. In a court filing in the case Tuesday night, the Justice Department said that Trump’s lawyers have leveled “wide-ranging meritless accusations” against the government.

Top secret documents are NEVER copied, but Trump copied the documents and the proof is those empty folders, one for each secret document. Trump had to remove the document from the folder before he could use the automatic document feeder on the xerox machine and then gave a copy to the Russians.

DOJ wrote Trump "has characterized the government’s criminal investigation as a 'document storage dispute' or an 'overdue library book scenario.' In doing so, [Trump] has not addressed the potential harms that could result from mishandling classified information or the strict requirements imposed by law for handling such materials," DOJ argued.

The filing also said Trump "offers no response to the government’s multiple arguments demonstrating that he cannot plausibly assert executive privilege to prevent the Executive Branch itself from reviewing records that Executive Branch officials previously marked as classified."

The filing also noted Trump "does not actually assert—much less provide any evidence—that any of the seized records bearing classification markings have been declassified."

Former Pentagon special counsel Ryan Goodman said the brief "decimates Trump lawyers' brief" and said it "should be game over."

"Brilliant moves here by DOJ," he explained. "First, they call Trump's bluff here -- that he has never asserted in court that he declassified/made records personal. Second, if he did declassify any, it would be hugely important for IC/FBI/DOJ to have those records to assess the impact."

The senior federal judge tasked with reviewing the materials seized by the FBI from Donald Trump’s Mar-a-Lago estate sharply questioned the former president’s attorneys Tuesday during their first hearing in his courtroom.

Judge Raymond Dearie repeatedly challenged Trump’s lawyers for refusing to back up the former president’s claim that he declassified the highly sensitive national security-related records discovered in his residence.

“My view of it is: you can’t have your cake and eat it,” said Dearie, the “special master” picked by U.S. District Court Judge Aileen Cannon to vet Trump’s effort to reclaim the materials taken by federal investigators.

Trump has argued that the 11,000 documents taken from Mar-a-Lago by the FBI pursuant to a search warrant last month were rightfully in his possession, including about 100 bearing classification markings that suggest they contain some of the nation’s most closely guarded intelligence.

But Dearie bristled at the effort by Trump’s lawyers to resist his request for proof that Trump actually attempted to declassify any of the 100 documents that the Justice Department recovered from his estate. Without evidence from Trump, Dearie said his only basis to judge the classification level of the records was the fact that they all bear markings designating them as highly sensitive national security secrets — including some that indicate they contain intelligence derived from human sources and foreign intercepts.

From the outset of the 40-minute hearing, Dearie signaled that he was determined that Trump’s “litigation strategy” would not interfere with the review Dearie has agreed to do. The judge appeared to be referring to vague assertions of declassification by Trump’s side, without so far any facts to back that up.

A history professor who has predicted every presidential election correctly since 1984 said that he believes former President Donald Trump is "done" in politics and may not escape jail time after he was sued in New York for alleged real estate fraud.

American University history professor Allan Lichtman told The Irish Times that Trump cannot win another election because of his legal burdens. The professor who has been correct since 1984 did NOT say Trump will not run, but did say Trump will not win. I certainly hope Trump runs, but I predict he won't win if he runs.

If the FBI found any government property at Trump's, Trump can't be sworn in as President because it is a Supreme Court justice who does the ceremony. The justice will know that Trump’s punishment is to be disqualified from holding any office (maybe Trump will skip the ceremony in 2025 like he skipped it in 2021?):

The special master overseeing the Mar-a-Lago documents investigation has ordered former President Donald Trump's lawyers to back up out-of-court assertions that the FBI may have planted evidence at the property during their search last month.

Judge Raymond Dearie, the court-appointed special master, said in a filing Thursday that Trump's team needs to submit a sworn declaration saying if they believe the Justice Department included any items on their "inventory" of materials taken from Mar-a-Lago that were not actually seized during the search.

The declaration must include "a list of any specific items set forth in the Detailed Property Inventory that Plaintiff asserts were not seized from the Premises on August 8, 2022," Dearie wrote in the order.

This has come up as an issue in the case because Trump himself, some of his attorneys, and several of his outside Republican allies have publicly claimed that the FBI planted evidence at Mar-a-Lago during the August 8 search.

However, they have offered no evidence to support these accusations.

Trump’s lawyers, who understand they cannot lie under oath, have not repeated many of Trump’s statements before a judge. The latest twists in the case are therefore jamming them between their obligation to tell the truth and their client who has a famously flexible concept of facts and reality.

I believed that Trump's taxes would be his ultimate downfall, but that requires complex testimony in front of a jury. Much easier for a jury, Trump stealing top secret documents doesn't require a jury to understand accounting and taxes, so stealing documents will get Trump in trouble sooner. Trump saying the documents aren't stolen because he declassified the documents is not a convincing argument. If Trump gets a fine for stealing top secrets, he can't hold a federal office, which means he can't be President. Maybe when the GOP takes over Congress in Jan 2023, they can change the law for Trump, but I doubt the GOP will have a 2/3rd majority to override Biden's veto.

All the other litigation involving Trump and his taxes and real estate, some of it going to the Supreme Court twice in one year, will stall because it is complicated. Stealing top secrets is as simple to litigate as stealing cigarettes from the local convenience store. And the DOJ knows that stopping the steal is very important. Trump's lawyers will have difficulty delaying justice for two more years in this particularly straight forward case.

You don't like comparing stealing top secrets to stealing cigarettes? Trump already confessed to taking the cigarettes, I mean top secrets. His defense is the cigarettes, I mean top secrets, were his personal property rather than the store's property. But the store politely asked for the return of the cigarettes, but Trump kept smoking the evidence, until the FBI took his stash in Mar-a-Lago. There might be another stash at his Bedminister golf course.

The 11th Circuit did not spell out how, exactly, Trump’s seizure of classified documents may have harmed the security of the United States. That reticence is understandable since many key details of the case remain secret. And yet, an unredacted portion of the warrant that authorized the Mar-a-Lago search showed that these records included information provided by spies. Some documents were marked HCS, or Human Intelligence Control System, which indicates that they may contain the identity of undercover informants. This is a problem for more reasons than the obvious: Just last year, the CIA warned that a shocking number of its informants had been arrested and killed by foreign nations. The agency also noted its struggle to recruit new informants. It is hard to imagine that anyone would want to sign up if they knew that a former president could keep documents revealing their identity in an unlocked room at his resort—then persuade a federal judge to prevent the FBI from ascertaining how much danger they’re in because of the president’s negligence.

Here, then, is the chief distinction between Cannon and the two Trump nominees who ruled against her, Andrew Brasher and Britt Grant. All three judges are extraordinarily conservative. All three might even bend the rules to favor Trump. But Brasher and Grant were not willing to fully break the rules, at least when doing so could subvert the U.S. government’s ability to protect itself from foreign threats. Cannon’s conduct places her in a separate class of hard-right judges—you might call them ultra-MAGA—who will do anything to further their political and ideological agenda. There’s an analogy here to the conservative judges who ordered the Navy to deploy unvaccinated SEALs and attempted to keep an insubordinate anti-vaxxer in command of a naval warship. There is no limit to the lunacy these judges will unleash in furtherance of their agenda. And so the somewhat less radical adults in the room must step in. Much like Justice Brett Kavanaugh shot down conservative judges who inserted themselves into the Navy’s chain of command, Brasher and Grant had to stop Cannon from wresting control over the FBI.

If Trump dares appeal the 11th Circuit’s decision to the Supreme Court, he will lose, perhaps unanimously. The appeals court made it abundantly clear that judicial interference in the government’s review of these classified documents crossed the line into lawlessness. Cannon’s wildly disruptive reign of madness is finally drawing to a close.

On Wednesday, a three-person Atlanta-based U.S. Court of Appeals panel ruled unanimously that the Department of Justice can continue investigating Donald Trump for having potentially violated the law by keeping presidential records, including classified documents, at his Mar-a-Lago residence and club in Florida. (One of the locations in which he allegedly stored such material was a closet near the Mar-a-Lago pool.)

Trump had moved to halt the investigation by arguing that an independent “special master” was needed to determine if any of the materials at issue are protected by “executive privilege”—the president’s right to keep certain records of internal deliberations private—and therefore lawfully his. A Florida district judge who Trump had himself appointed ruled in his favor, halting the DOJ’s work.

The government then brought the case to the appeals court, arguing that it should at least be able to continue working with the classified materials that were recovered from Mar-a-Lago.

On Thursday, the appeals panel took the government’s side, unfreezing the investigation into the classified material. In doing so, it rejected a number of arguments that Trump’s legal team had made, and in the process cited one particular Supreme Court decision that the folks at home got a kick out of:
