The problem was never Trump, but the Democrats don't want to properly identify what is wrong. The wrongest people I know, from decades before Trump entered politics, all voted for Trump. What has always been wrong with them is wrong with Trump. Trump attracts people who are as wrong headed as he is. Trump's life has been one misadventure after another: bankruptcy, tax cheating, adultery, divorce, lying, breaking contracts, suing and being sued. But Trump has risen above the consequences because he inherited a $billion. Most Trump voters aren't insulated from consequences since they don't have his kind of money, but they can imagine rising upward in the class hierarchy that places Trump at the Mt Everest peak of status.

Trump's MAGA slogan? It means make me great again. The poor suffering Trump voters want to feel great about themselves, but still be the same dumb jerks as always, just like Trump has always been a jerk. What infuriates Trump voters is the idea that if Trump gets punished for top secret papers at Mar-a-Lago, or punished for cheating on his income taxes/real estate taxes, despite all his money and power, there is no hope for poor little Trump voters wishing to be made great again without working on themselves.

The Argument Against Making Trump Obey the Law

In 2016, James Comey, then the head of the F.B.I., was worried about what Trump’s supporters would think of the resolution of the investigation into Hillary Clinton’s emails.

First, in July 2016, Comey broke protocol to give a news conference in which he criticized Clinton even while announcing that she’d committed no crime. He reportedly did this because he wanted to protect the reputation of the F.B.I. from inevitable right-wing claims that the investigation had been shut down for political reasons.

Then, on Oct. 28, just days before the election, Comey broke protocol again, telling Congress that the Clinton investigation had been reopened because of emails found on the laptop of the former congressman Anthony Weiner. The Justice Department generally discourages filing charges or taking “overt investigative steps” close to an election if they might influence the result. Comey disregarded this because, once again, he dreaded a right-wing freakout once news of the reopened investigation emerged.

“The prospect of oversight hearings, led by restive Republicans investigating an F.B.I. ‘cover-up,’ made everyone uneasy,” The New Yorker reported. In Comey’s memoir, he admitted fearing that concealing the new stage of the investigation — which ended up yielding nothing — would make Clinton, who he assumed would win, seem “illegitimate.” (He didn’t, of course, feel similarly compelled to make public the investigation into Russian interference in the election.)

Comey’s attempts to pre-empt a conservative firestorm blew up in his face. He helped put Trump in the White House, where Trump did generational damage to the rule of law and led us to a place where prominent Republicans are calling for abolishing the F.B.I.

This should be a lesson about the futility of shaping law enforcement decisions around the sensitivities of Trump’s base. Yet after the F.B.I. executed a search warrant at Trump’s beachfront estate this week, some intelligent people have questioned the wisdom of subjecting the former president to the normal operation of the law because of the effect it will have on his most febrile admirers.

Andrew Yang, one of the founders of a new centrist third party, tweeted about the “millions of Americans who will see this as unjust persecution.” Damon Linker, usually one of the more sensible centrist thinkers, wrote, “Rather than healing the country’s civic wounds, the effort to punish Trump will only deepen them.”

The Atlantic’s Tim Alberta described feeling “nauseous” watching coverage of the raid. “What we must acknowledge — even those of us who believe Trump has committed crimes, in some cases brazenly so, and deserves full prosecution under the law — is that bringing him to justice could have some awful consequences,” he wrote.

In some sense, Alberta’s words are obviously true; Trumpists are already issuing death threats against the judge who signed off on the warrant, and a Shabbat service at his synagogue was reportedly canceled because of the security risk. On Thursday, an armed man tried to breach an F.B.I. field office in Ohio, and The New York Times reported that he appears to have attended a pro-Trump rally in Washington the night before the Jan. 6 attack on the Capitol. The former president relishes his ability to stir up a mob; it’s part of what makes him so dangerous.

We already know, however, that the failure to bring Trump to justice — for his company’s alleged financial chicanery and his alleged sexual assault, for obstructing Robert Mueller’s special counsel investigation and turning the presidency into a squalid influence-peddling operation, for trying to steal an election and encouraging an insurrection — has been disastrous.

What has strengthened Trump has not been prosecution but impunity, an impunity that some of those who stormed the Capitol thought, erroneously, applied to them as well. Trump’s mystique is built on his defiance of rules that bind everyone else. He is reportedly motivated to run for president again in part because the office will protect him from prosecution. If we don’t want the presidency to license crime sprees, we should allow presidents to be indicted, not accept some dubious norm that ex-presidents shouldn’t be.

We do not know the scope of the investigation that led a judge to authorize the search of Mar-a-Lago, though it reportedly involves classified documents that Trump failed to turn over to the government even after being subpoenaed. More could be revealed soon: Attorney General Merrick Garland announced on Thursday that the Justice Department had filed a motion in court to unseal the search warrant.

It should go without saying that Trump and his followers, who howled “Lock her up!” about Clinton, do not believe that it is wrong for the Justice Department to pursue a probe against a presidential contender over the improper handling of classified material. What they believe is that it is wrong to pursue a case against Trump, who bonds with his acolytes through a shared sense of aggrieved victimization.

The question is how much deference the rest of us should give to this belief. No doubt, Trump’s most inflamed fans might act out in horrifying ways; many are heavily armed and speak lustily about civil war. To let this dictate the workings of justice is to accept an insurrectionists’ veto. The far right is constantly threatening violence if it doesn’t get its way. Does anyone truly believe that giving in to its blackmail will make it less aggressive?

It was Trump himself who signed a law making the removal and retention of classified documents a felony punishable by up to five years in prison. Those who think that it would be too socially disruptive to apply such a statute to him should specify which laws they believe the former president is and is not obliged to obey. And those in charge of enforcing our laws should remember that the caterwauling of the Trump camp is designed to intimidate them and such intimidation helped him become president in the first place.

Trump shouldn’t be prosecuted because of politics, but he also shouldn’t be spared because of them. The only relevant question is whether he committed a crime, not what crimes his devotees might commit if he’s held to account.

Former homeland security adviser for Mike Pence said she once 'found classified documents in the ladies' room'

Olivia Troye, who served as homeland security and counterterrorism adviser to former Vice President Mike Pence, shared the anecdote on MSNBC on Sunday.

"I found classified information in the ladies' room of the White House one time in the Eisenhower Executive Office Building," Troye said. "I was not expecting to walk into the ladies' room and find a document like that."

She immediately reported the classified documents to security but that it would concern anyone with security clearance.

"I remember the panic," Troye said on MSNBC. "There is sort of a blood pressure rise in you where you pick it up, and you're like, 'Oh what do I do with this, I have a responsibility to protect it.'"

Troye added that it was a "known thing" that her colleagues did not properly handle documents.

"People would carry documents around, especially political appointees, around and traditionally you would put it in a pouch, and you would secure it, and you would lock the pouch and then carry it," Troye said. "That's not what was the norm in the White House, and I do think there were numerous situations where you would see this kind of behavior."

"For those of us that have clearances, again, you do have a responsibility to protect the information," Troye said. "You don't carry it home and store it for whatever number of months in an unclassified facility."

She added: "It doesn't matter what it says, what it actually contains. The bottom line is that information is stored and should be carried properly and secured because it could put lives at risk if that information gets into the wrong hands "

Michael Cohen, who was once former President Trump's personal lawyer, believes Trump kept top-secret documents at his Mar-a-Lago residence as potential bargaining chips that he could leverage if he were ever at risk of going to jail.

"My belief is that he was going to use it as a bargaining chip, as a get-out-of-jail-free card," Cohen said on CNN. "The second that they put him in handcuffs, he'll turn around and say, 'You don't seem to understand. I have the documentation showing, for example, where our nuclear launchpads are, or other information — sensitive national security information."

Cohen painted a scenario in which Trump would threaten to have his "loyal supporters" release the classified information he had kept to Russia.

The FBI removed 11 sets of classified documents — some of which were marked top secret and concerned nuclear weapons. According to the warrant, the Justice Department is looking into whether Trump broke three federal laws, including the Espionage Act.

Cohen was Trump's lawyer and close confidante for a decade. In 2018, he was the subject of a search of his home and office, as part of an investigation into illegal hush-money payments to adult-film star Stormy Daniels, a Trump liaison. Cohen was jailed for making the payments while Trump went free by pretending it was Cohen's, not Trump's, money paying the bribes. Trump was shocked, SHOCKED!, that his lawyer would do such a thing. Donald Trump Has His Own History With the Espionage Act

During the 2016 presidential election, Russia’s Main Intelligence Directorate of the General Staff, or GRU, launched cyberattacks in support of Trump’s campaign. In one of them, GRU sent spearphishing emails to local election officials in swing states hoping to trick them into opening the malicious attachment that would hack their computers. At the time, Trump called all of this “fake news.”

In 2017, then-National Security Agency contractor and whistleblower Reality Winner, who was 26, leaked a classified NSA document to The Intercept that described this GRU plot in detail. Trump’s Justice Department charged and convicted her under the Espionage Act. Midway through a trial, Winner entered into a plea agreement with prosecutors and pleaded guilty to one charge. She was sentenced to five years and three months in prison, and three years of supervised release: the longest sentence ever given for the unauthorized release of classified documents to the media. (In June 2021, Winner was released early from prison.)

State election officials first learned about GRU’s spearphishing attack against them because of media reports, but only thanks to Winner; the NSA had failed to warn them because Trump said it was “fake news.” Two former election officials told CBS News’s “60 Minutes” that Winner’s disclosure helped secure the 2018 midterm election.

Both were named as Trump’s representatives to the National Archives, so when the Archives discovered it was missing items, including the highly classified documents, NARA reached out to Philbin.

“Mr. Philbin tried to help the National Archives retrieve the material, two of the people familiar with the discussions said. But the former president repeatedly resisted entreaties from his advisers,” the Times’ Maggie Haberman reports.

“’It’s not theirs, it’s mine,’ several advisers say Mr. Trump told them,” according to the Times.

Little surprise that so many of the scandals of his presidency and post-presidency involved the military and national security concerns.

Last week, two stunning things came to light regarding our military and the intelligence it produces. The first was General Mark Milley’s written-but-never-sent resignation letter from 2020, accusing then-President Donald Trump of politicizing the armed services, being insufficiently patriotic, ruining the international order, and “doing great and irreparable harm to my country.” The second was the FBI’s execution of a search warrant of Trump’s current residence to recover government property, including eleven sets of classified documents.

These historic occurrences speak to just how deeply Trump believed the military not to be an instrument of national power but an apparatus for personal use. Milley composed his resignation draft after being asked to participate in Trump’s ego-stroke theater—first by conducting a military show of force against Americans upset about George Floyd’s killing days earlier and then being unwittingly drafted into Trump’s infamous march across Lafayette Square after it was forcibly cleared of protesters. Regarding the classified material squirreled away in Mar-a-Lago, the underlying explanation from Trump and his supporters appears to amount to little more than that it was his to do with as he pleased without any regard to the potential damage to our national security interests.

These occurrences bring to the fore a troubling issue usually lurking in the background of civil-military relations: When a president believes his interests supersede the nation’s—or, worse, that his interests become the nation’s—the democratic principle of “civilian control of the military” exposes the armed services to co-option as a partisan tool for domestic politics.

Much of Donald Trump’s presidency demonstrated this peril. His approach to the office resembled the conceit attributed to France’s Louis XIV: L’état, c’est moi—“I am the state.” He and his acolytes acted as though the Constitution meant whatever he said it meant, and thus, the oath military members took to it was received as fealty to the president (the person) and not the presidency (the office). Extending this monarchic view, everything the military does is presumed to be ultimately in service of the man; everything it produces, even highly classified material, is the property of the man. When considered alongside the toxic partisanship and democratic backsliding plaguing the nation—where political opponents are often characterized as existential threats—the line between defense of the nation and partisan expedience is dangerously blurred.

A bulletin from the FBI and the Department of Homeland Security announced that, following the Mar-a-Lago search, the agencies “have observed an increase in violent threats posted on social media against federal officials and facilities.” Last week, a man attacked the FBI field office in Cincinnati; recent posts on Truth Social under the name of the attacker, Ricky Shiffer, had called for people to “get whatever you need to be ready for combat” following the FBI’s arrival at Mar-a-Lago. On Monday, prosecutors brought a case against another man, Adam Bies, who had posted threats against federal agents days after the search of Trump’s estate.

Such threats reveal the disturbing logic behind the GOP calls to defund the agency. The goal is not to critique law-enforcement overreach, but rather, as Zeeshan Aleem argues in MSNBC, to make the bureau “completely subordinate to the authoritarian political project.” And this project is authoritarian, because it locates total power in one person—even, it seems, when he has been voted out of office. This vision of Trump’s authority sets up a parallel structure of political legitimacy that competes with the Constitution.

This is the logic of insurrection. “HEY FEDS,” Bies apparently wrote on the social-media platform Gab two days after the Mar-a-Lago search. “We the people cannot WAIT to water the trees of liberty with your blood.” Meanwhile, Representative Bennie Thompson—the chair of the House committee investigating the insurrection—warned that such apocalyptic comments “are frighteningly similar to those we saw in the run-up to the January 6th attack on the U.S. Capitol.”

After all, if power flows not from structures of law and consent but from the will of a single person, then the measure of whether violence is justified and legitimate no longer turns on whether force is channeled through the proper processes of state authority. Rather, it boils down to a single question: Is that violence wielded on behalf of Trump? Or against him?

It turns out that the White House was directly involved in the raid and colluded with the DOJ and the FBI all the way back in May despite lying and saying they found out about it because of the News.

Not only that, but there's a bit of Entrapment going on here as well along with an unprecedented act of a sitting Administration revoking rights to classified documents of a former president, which may in and of itself be deemed unconstitutional. Not good for Biden* while the SCOTUS makeup looks like it does.

I think I've slipped into a different timeline. Fox News just posted this... yeah, that Fox News.

The government tried to recover the documents peacefully and quietly. They spent one year discussing the matter with Trump’s staff.

After identifying more missing records, the government returned in June with a subpoena and found more boxes of records that should have been returned. Both times, properly marked classified documents – up to and including documents marked as Top Secret and requiring Sensitive Compartmented Information access eligibility – were located within the boxes.

A Trump lawyer swore out an affidavit promising there were no more documents. The government gathered evidence that the Trump lawyer was not being truthful, and on August 8, 2022, a court-authorized search warrant was executed that, sure enough, located several more classified documents.

The truth needs to be set forth plainly and simply, and so let’s get down to brass tacks here. What happened on August 8, 2022, was not tyranny. It was not political persecution. It was not a minor dust up over bureaucratic processes blown out of proportion. It was the criminal justice system operating just like it does with any other private citizen on any other given day ending in a "y."

Trump was the president and commander-in-chief up until noon on January 20, 2021. The moment Joe Biden took the Oath of Office, Trump became just another private citizen in his 70s who vacations in Florida during the winter months to avoid the bitter cold back in his native home in the Northeast. He was no longer shielded by any privileges or protections of the Office of the Presidency at the point beyond physical security protection. He is subject to the laws of the United States just like anyone else.

What also is true is that Trump had particular legal obligation as the former president to properly turn over presidential records to the National Archives and Records Administration. That is mandated by the Presidential Records Act because those records are the property of the United States. They are not Trump’s personal property.

The result was apparently more than 25 boxes’ worth of presidential records were shipped to Florida and stored in a basement at Mar-a-Lago. If this were a mere issue of simply recovering unclassified presidential records, though, there likely never would have been a criminal element to this matter. But buried into those boxes were countless properly marked classified documents. Those documents lacked any markings indicating that Trump had ever declassified them. No actual substantiated evidence indicates Mr. Trump ever declassified them. No one viewing those records would have any reason to view them as anything other than properly classified documents.

Don McGahn had one foot out the door because he thought Trump was ‘crazy’

Don McGahn was ready to quit as White House counsel for Donald Trump until the managing partner of an influential conservative law firm persuaded him to stay.

McGahn had been personally responsible for picking Trump's judges, whose ranks he filled with conservatives approved by the Federalist Society, and gutting the administrative state, but less than six months into the job he was growing increasingly frustrated with handling the former president's legal problems, according to excerpts from the new book "Servants of the Damned" published by the New York Times Magazine.

"For his part, McGahn was growing worried about his own potential legal exposure — especially when Trump in June 2017 pushed him to fire Mueller," wrote author David Enrich. "McGahn refused and contemplated quitting. Around then, he called [Jones Day managing partner Stephen] Brogan. The president was crazy, McGahn fumed. Maybe, he ventured, he should cut his losses and return to Jones Day."

But Brogan, who had unsuccessfully sought the job as Trump's personal outside counsel, wanted to maintain the close relationship the firm enjoyed with the administration, whose ranks were filled with Jones Day alumni, and the firm handled a multitude of cases for the former president and his campaigns.

"Being unhappy is 'not a good enough reason to quit,' Brogan replied, according to McGahn’s confidant," Enrich wrote. "If McGahn threw in the towel so soon after joining the White House, it would look bad not just for McGahn but also for Jones Day. McGahn, who had gotten as far as packing up his office, heeded Brogan’s advice and stayed put until late 2018. By then, he had accomplished his mission."

"The Senate had just confirmed Brett Kavanaugh to the Supreme Court, the second justice McGahn had chosen, Trump had nominated and Mitch McConnell’s Senate had confirmed," Enrich added. "With McGahn in charge of selecting judicial nominees, the White House had nominated more than 130 judges to the federal courts in a span of 21 months. By the time they were confirmed, fully one-quarter of the appellate bench had turned over."

Inside Trump's public bravado and private resistance over Mar-a-Lago documents

Not long after the National Archives acknowledged in February that it had retrieved 15 boxes of presidential records from former President Donald Trump's Mar-a-Lago residence in Florida, Trump began fielding calls from Tom Fitton, a prominent conservative activist.

Fitton, the longtime head of the legal activist group Judicial Watch, had a simple message for Trump — it was a mistake to give the records to the Archives, and his team should never have let the Archives "strong-arm" him into returning them, according to three sources familiar with the matter.

Those records belonged to Trump, Fitton argued, citing a 2012 court case involving his organization that he said gave the former President authority to do what he wanted with records from his own term in office.

The Judicial Watch president suggested to Trump that if the Archives came back, he should not give up any additional records, according to sources with knowledge of their conversations, which have not been previously reported.

While Trump continued to publicly tout his cooperation with the Archives, privately the former President began obsessing over Fitton's arguments, complaining to aides about the 15 boxes that were handed over and becoming increasingly convinced that he should have full control over records that remained at Mar-a-Lago, according to people with knowledge of his behavior at the time.

Trump even asked Fitton at one point to brief his attorneys, said a person familiar with the matter.

"The moment Tom got in the boss' ear, it was downhill from there," said a person close to the former President, who spoke on the condition of anonymity to discuss internal matters.

Trump Will Be Indicted

(1) Trump was in unauthorized possession of national defense information, namely properly marked classified documents.

(2) He was put on notice by the U.S. Government that he was not permitted to retain those documents at Mar-a-Lago.

(3) He continued to maintain possession of the documents (and allegedly undertook efforts to conceal them in different places throughout the property) up until the FBI finally executed a search warrant earlier this month.

That is the ball game, folks. Absent some unforeseen change in factual or legal circumstances, I believe there is little left for the Justice Department to do but decide whether to wait until after the midterms to formally seek the indictment from the grand jury.

The cruelest irony for Trump is that it never needed to be this way.

If he had returned all of the records last year, this likely never would have become a criminal matter. DOJ would have declined to take any action, notwithstanding the existence of the classified records, and it would have been a “no harm, no foul” situation.

Nothing in the documents released on Friday described the precise content of the classified documents or what risk their disclosure might carry for national security, but the court papers did outline the kinds of intelligence found in the secret material, including foreign surveillance collected under court orders, electronic eavesdropping on communications and information from human sources — spies.
