Unflattering videos of Rittenhouse

Prosecutors wanted to present two videos taken of Rittenhouse in the weeks leading up to the shooting, arguing that they provided "crucial insight" into the teenager's state of mind in summer 2020. Kenosha County Circuit Judge Bruce Schroeder disagreed in both instances.

One of the videos, which circulated widely on social media, showed Rittenhouse punching a girl from behind. In their motion on Wednesday, Prosecutors wrote that the new video, taken just 15 days before the Kenosha shootings, showed Rittenhouse "saw something, jumped to a conclusion based on exactly zero facts, and then threatened to kill someone based on his baseless assumption and wrongful interpretation."

Prosecutors added that Rittenhouse didn't know the people outside the CVS or what they were doing, was merely watching from a vehicle parked across the street, and was not interacting with anyone involved.

"The video proves that the defendant was ready and willing to use deadly force in a situation where it was completely unjustified," the motion said.

"The video also demonstrates that the defendant fervently sought to insert himself as an armed vigilante into situations that had nothing to do with him," prosecutors added.

All of this is terrific news if one thinks every public gathering, indeed every public space, is enhanced by the presence of more guns. As the majority of the Supreme Court seems to have confirmed in this month’s oral arguments for New York State Rifle & Pistol Association v. Bruen, such a world is A-OK by them.

Justice Samuel Alito, for example, demonstrated his boundless concern for, as he put it, “law-abiding citizens” in New York City who are forced to “commute home by subway, maybe by bus,” and are unable to carry guns to protect themselves in a shootout, which would presumably occur on a crowded train or platform.

Yes, this is the world the current court seems likely to create, and it will leave the details of who intended to kill and who was just defending himself and who merely killed someone out of fear his gun would be wrested from him to any number of future juries.

Each of the three trials dominating the news this month features armed citizens taking up weapons to travel to public spaces where they believed themselves to be under threat.

In the trial of the three killers of Ahmaud Arbery in Georgia and the Rittenhouse trial in Wisconsin, the defendants claim that they were justified in their use of violence when they killed unarmed people in self-defense.

In both prosecutions “the defendants claim they were entitled to start shooting because the victims were trying to take their guns.”

White supremacists currently facing a civil trial in Charlottesville, Virginia, for harming others at a Nazi-style rally in 2017 are offering similar defenses, claiming that they too armed themselves and attacked peaceful counterprotesters out of a fear for their own safety.

Kimberly Kessler Ferzan, a professor of law and philosophy at the University of Pennsylvania, arguing in the Texas Law Review that “the problem is that with a citizenry armed with guns, we have blurred every line.”

Indeed, once everyone in public spaces is armed and operating under a sprawling regime of “stand your ground” and citizen’s arrest statutes plus a mushrooming mistrust of law enforcement, how will courts ever sort out who instigated and who responded? As Ferzan put it in her law review article: “What is defense? What is reasonable? When may one stand one’s ground and when must one retreat? And, when is a citizen entitled to step in as an aggressor in the name of the state?”

If you can arm yourself because you have declared yourself a substitute for law enforcement and then you claim people were grabbing for your weapon so you killed them with it, when are you every not justified in killing?

I have seen people who are slow and unsure about making big decisions in their own lives go to a gun store and purchase a weapon. Suddenly they feel powerful and capable of making quick life or death decisions for other people but they are no more capable than they were before making a gun purchase.

Republican Mark McCloskey, a candidate for the U.S. Senate in Missouri, was photographed Tuesday outside the Wisconsin courthouse where Kyle Rittenhouse was on trial for murder. McCloskey on Tuesday was photographed standing next to two men flashing an “OK” sign, which is associated with white supremacists. Rittenhouse was also photographed in January with two men as they made the “OK” sign with their hands. The judge in September ruled against allowing that to be discussed during Rittenhouse's trial.

McCloskey and his wife, Patricia, were both in Kenosha, Wisconsin, on Monday and Tuesday to show support for Rittenhouse. The McCloskeys gained national attention after they waved guns at racial injustice protesters who were marching in their gated St. Louis subdivision last summer.

Mark McCloskey compared himself to Rittenhouse in a statement Tuesday, saying they have both been prosecuted and were defending themselves from an “angry mob.” McCloskey said he hopes the jury finds Rittenhouse not guilty.

The McCloskeys pleaded guilty in June to misdemeanor charges after waving guns at protesters and were ordered to pay fines, but Mark McCloskey left the courthouse defiantly pledging to “do it again” if faced with the same circumstances. Both McCloskeys were pardoned by Republican Missouri Gov. Mike Parson.

It turns out that the prosecution had within its possession a high-quality video that it played for the judge after the trial ended. On this, and other evidentiary grounds, the defense moved for a mistrial with prejudice. [With prejudice: no retrial possible]

Defense attorney Mark Richards gives his closing argument on Monday

The defense motion states the facts with sufficient clarity that I'm going to reprint them here verbatim:

On November 5. 2021, the fifth day of trial on this case, the prosecution turned over to the defense footage of a drone video which captured some of the incident from August 25, 2020. The problem is, the prosecution gave the defense a compressed version of the video. What that means is the video provided to the defense was not as clear as the video kept by the state. The file size of the defense video is 3.6 MB and the state's is 11.2 MB. Further, the dimensions on our video are 480 x 212, the state's, 1920 x 844. The video which was in the state's possession, wasn't provided to the defense until after the trial concluded. During the jury instructions conference, the defense played their version of the video for the court to review. The state indicated their version was much clearer and had their tech person come into court to have the court review their clearer video. The video is the same; the resolution of that video, however, was not. The state did not provide their quality video to the defense until Saturday, November 13, 2021, and only did so upon specific request by Attorney Wisco — two days before closing arguments and after the evidence had been closed.

Under Wisconsin law, when the defense makes a demand, the prosecution must provide to the defense "[a]ny physical evidence that the district attorney intends to offer in evidence at the trial" and "[a]ny exculpatory evidence." That's Wisconsin Stat. § 971.23(1)(g) & (h). I don't have the time to research the law, but my bet is that if Wisconsin's appellate court ever had before it the question of whether the prosecutor may get away with producing bastardized, degraded versions of the requested evidence, it would say emphatically not.

The motion for a mistrial with prejudice also raises the fact that, when Kyle Rittenhouse took the witness stand, the prosecutors improperly accused him of keeping silent after his arrest. That right, of course, is enshrined in the famous Miranda rights warning that all arrestees in America receive: "You have the right to remain silent ..." The corollary to that right is that this silence cannot be used against the defendant in a court of law, but that's exactly what the prosecution tried to do.

That is where the judge went livid.

I'm going to add that, according to the video of the trial, prosecution's excuse for even bringing that up is that Rittenhouse only made a statement after having seen all most of the evidence both for and against him. However, one could say the same of the witnesses on that stand, whose testimony was certainly fortified by review of video evidence.

Also, as an aside, in the process of turning our hardcopy evidence into digital, when we scanned it, we ALWAYS used the full-resolution setting (.tiff). .jpg and other file formats are compressed to save space, but it ALWAYS means loss of pixel resolution here and there, sometimes as much as 10pct.

Thus, they argued, Joseph Rosenbaum, who had been setting fires, tried to burn police as they sat in their patrol cars, swung chains at people, and screamed the N-word, was himself acting in self-defense when he told Kyle earlier that he was going to kill Kyle, and then raced after Kyle, cornered him in a parking lot, and grabbed for his long gun.

To state the argument is to realize how ridiculous it is. However, it's consistent with the prosecution's other argument on closing, which was that anyone who isn't carrying a gun is not a threat and that the person with a gun should always yield gracefully to a non-gun beating. By contrast, said the prosecution, a gun is inherently a threat. This picture of Reginald Denny, with nothing more, shows how ridiculous the first argument is:



The second argument vitiates the Second Amendment. If carrying a gun is inherently threatening, then no one ever has a right to defend himself.

As of this writing, the jury spent Monday deliberating without reaching a decision. By the time you read this, the trial may be over. The jury may have found Kyle guilty, in which case the mob gathered outside will celebrate by destroying property. It may have found Kyle innocent, in which case the mob will try once again to burn Kenosha. And the judge may have granted the motion, in which case the mob will also try to burn it all down.

Wouldn't it have bolstered their case, instead of forcing jurors to squint at a grainy image, trying to decipher what it showed? Or did the better video show people in the mob making threatening gestures as well?

And why would prosecutors go against the judge's EXPLICIT instructions not to bring up Rittenhouse's "right to remain silent" (as well as contravene the Constitution)?

Either the prosecution is unimagineably imcompetent, or they're deliberately setting up a for mistrial.

Their performance is puzzling, to say the least.

There's a lot about this case that's puzzling.

BTW the judge has a standing order that he imposes on ALL cases heard in his court - that NOBODY gets called a 'victim' - at least before a guilty verdict is reached. He believes that calling someone a victim is prejudicial against the defense. So that wasn't a rule he imposed only for this case.

The prosecution impugning the defendant's silence was maybe 'theater'. Because, despite any instructions to the jury to ignore select statements, nobody can unhear them. Both sides do that, in order to plant ideas in the jurors, even if they get a ruling against them and a motion to strike. What the prosecution may not have expected is the judge's vehemence. Perhaps the judge had just heard that tactic too many times, and was having none of it from the prosecution, like calling people victims (though if there were similar statements made by the defense that didn't get that reaction, is unknown).

I've sat on 3 juries of increasing severity: grand theft and possessing a stolen vehicle; attempted murder; and murder. (The verdicts were guilty; not guilty; and guilty, in that order.)

BOTH prosecution AND defense often play a lot of games. For example, in the attempted murder trial, the defendant, who was a huge dood, was accused of trying to murder another guy by hitting him repeatedly with a baseball bat, such that the beaten guy spent a long time in the hospital recovering and was left with some disability. (The defendant had previously stolen the beaten guy's gun from a gym bag in a closet at a party they both mutually attended, which is why they got into a scuffle in the first place. The verdict in the stolen gun trial was guilty, which we found out afterwards.)

We reached our not-guilty verdict for a couple of reasons. First, we did recognize that there were provoking reasons for the beaten up guy to get in a scuffle with the defendant. Because in all likelihood, the defendant had stolen the gun and was taunting the beaten-up guy over it.

But 1) the beaten-up guy threw the first punch, and 2) as soon as the beaten-up guy stopped swinging at the defendant, the defendant stopped hitting him with a baseball bat. So even though it was a case of fists versus bat, it seemed to lean more toward self-defense and less toward attempted murder.

But AFTER we reached our verdict, the lawyers let down their hair and talked with us. And one of them (I forget which) basically said - you might think they'd bring in the beaten-up guy because with his permanent injuries he'd be a sympathetic character. But the reason why they didn't bring in the beaten-up guy was because while the defendant is tall and hefty he's a lard-ass, and the beaten up guy was even bigger and really buff. And they also did inform us that the lard-ass guy really did take the gun.

In general, lawyers will instruct witnesses to ONLY directly answer the question.

I can see how the tactic works for the defense. Your own lawyer is probably only going to ask you questions that elicit vanilla answers. And the prosecution is going to only ask you questions that can trip you up. If you start going off-script, you might pull on that one thread that unravels your defense. So sticking to short, limited answers is your best bet.

But in the juries I've been on I've seen questions dismissed that I think would have elicited revealing information, like for example, did the big guy with the bat really steal the beaten-up guy's gun?

Anyway, in terms of limiting witness's answers, on the one side, as an expert witness, I've been instructed to ONLY answer the questions in criminal trials. But when it comes to witnesses in general I wonder if witnesses can say - look, your honor - I swore to tell the WHOLE truth, and answering these questions is not it.

And as a juror, I've seen the games BOTH sides play with limiting information, framing questions, limiting questions, and rhetorical theatrics to sway juries.



With the Rittenhosue case, the judge actually seems to favor the defense side, in general, with his standing order to never use the term victim, and his strong reaction to prosecution theatrics.

In the instance of the grainy v HD videotape, if the judge lets its exclusion stand, I can only conclude that 1) the prosecution never intended to use it as evidence, or 2) it wasn't exculpatory (but might possibly be prejudicial to other pending cases).

Rittenhouse judge unloads wild rant about Black jurors after jury asks unrelated question

Judge Bruce Schroeder defended his actions and attacked the media at a hearing on Wednesday after the jury asked an unrelated question about the Kyle Rittenhouse trial.

Schroeder went off-topic at the hearing to address criticisms he has received in the media.

The judge defended his decision to not allow the people who were shot to be called "victims" because he said it was unfair to Rittenhouse.

"How would you like to be put on trial for a crime and the judge introduced the case to the jury by introducing you as the defendant and the person who's accusing you as the victim?" he asked. "Is it so difficult to use the term 'complaining witness' instead of prejudging what the jury is here to determine?"

He also explained why he allowed the defendant to control the lottery determining which jurors would decide the case.

"I am now reading about how bizarre and unusual it was to have the defendant pick the [juror] numbers out of the tumbler yesterday," Schroeder said. "I would admit that I don't know there's a large number of courts that do that. Maybe not any."

"I do it because of an incident that I had in a case I tried in Racine," he recalled. "I think it was a murder case but I'm not sure. And there was a Black defendant and there were 13 jurors. One of them was Black. And when the clerk -- the clerk, the government official drew the name out of the tumbler, it was a Black, the Black, the only Black."

Since that time, the judge said that he allows the defendants to select alternate jurors so they "feel better."

"We talk about optics nowadays," he said. "That was a bad optic, I thought. I think people feel better when they have control."

Before finishing his rant about the media, Schroeder threatened to remove future trials from live television.

"When I talked about problems with the media when this trial started, we were there in part," he complained, "because of grossly irresponsible handling of what comes out of this trial."

"I'm going to think long and hard again about live television for a trial next time," the judge added. "What's being done is really quite frightening" for a doddering old fool judge.

I was an alternate for a trial where some woman's BF was accused of beating up her boss, bc her boss made sexual advances to her and made it sound like a condition of employment.

well, the boss, WAS a young sleazeball. But he showed up in a suit that was 2 sizes too big for him, so that he would look small and helpless. (REALLY???)

The BF was a bigger buff dood. In the end, despite the fact that the boss really WAS a sleazeball ... you just don't go beating someone up for sex discrimination. There are people to complain to, especially since Sleazeball Boss was managing a Federal fund for black businesses in a black neighborhood. I'm sure the feds would have liked to have known what was going on. So the jury decided BF was guilty of assault and battery, and that was my independent decision, too.

KIKI- IMHO it's not a simple case of "who started it". And not a simple case of "equivalent" force either.

To me it's more of a case of "credible threat" .. would an average person's self defense be triggered by a credible threat.

Some weaponless nobody yelling at you from 25 ft away would make me feel uneasy, but not enough to shoot. But 20 weaponless people chasing me would definitely make me want a gun. This reminds me of the Bernhard Goetz shooting: four young punks were threatening him. True, they only had screwdrivers, but there were four of them So he shot them. There was some talk of murder charge but in the end he was convicted of illegal possession of a firearm.

If Rittenhouse was waving his weapon (the subject of the grainy video, apparently) what were the circumstances?

I don't know. I haven't been following this, too busy to track down all of the video evidence, which is where I think the heart of the truth is.

No matter how the M$M tries to spin it by "mind reading" and "name calling".
