George Papadopoulos, a foreign policy advisor during the campaign period, pleaded guilty to lying to investigators about, inter alia, the nature and timing of his interactions with Joseph Mifsud, the professor who told Papadopoulos that the Russians had dirt on candidate Clinton in the form of thousands of emails. Former Trump Organization attorney Michael Cohen pleaded guilty to making false statements to Congress about the Trump Moscow project.

You missed the entire point Mueller was making: Flynn would be charged with a minor crime in exchange for his cooperation. Aside from edit/ find the phrase "russian troll" to repost, I don't bother reading SECOND's posts at all. I can't imagine why anyone would.

When I come here I look for information and insight, or topics of interest, or at least rwe relevant interchange.

Before Flynn’s 2017 guilty plea, the government provided Flynn with (1) the FBI report for Flynn’s January 24 interview; (2) notification that the DOJ Inspector General, in reviewing allegations regarding actions by the DOJ and FBI in advance of the 2016 election, had identified electronic communications between Strzok and Page that showed political bias that might constitute misconduct; (3) information that Flynn had a sure demeanor and did not give any indicators of deception during the January 24 interview; and (4) information that both of the interviewing agents had the impression at the time that Flynn was not lying or did not think he was lying.

The government subsequently provided over 25,000 pages of additional materials pursuant to this Court’s broad Standing Order, which it issues in every criminal case, requiring the government to produce “any evidence in its possession that is favorable to [the] defendant and material either to [his] guilt or punishment.” Doc. 20, at 2. The majority of those materials, over 21,000 pages of the government’s production, pertain to Flynn’s statements in his March 7, 2017 FARA filing, for which the government agreed not to prosecute him as part of the plea agreement. The remainder are disclosures related to Flynn’s January 24, 2017, statements to the FBI, and his many debriefings with the SCO.

The government disclosed approximately 25 pages of documents in April and May 2020 as the result of an independent review of this case by the United States Attorney for the Eastern District of Missouri. While those documents, along with other recently available information, see, e.g., Doc. 198-6, are relevant to the government’s discretionary decision to dismiss this case, the government’s motion is not based on defendant Flynn’s broad allegations of prosecutorial misconduct. Barr dropped the case because Trump ordered him to. It's right in the government's brief, without saying "Trump", but rather saying "Executive":

Presumably, in Texas, nobody really knows about the Federal government because they have their heads stuck up the 'Republic of Texas's' ass. In this case, the missing information about the Federal government is that the DoJ, headed by Barr, IS PART OF THE EXECUTIVE BRANCH. It's not part of the Judiciary Branch of government, as one might assume, if one was too ignorant to know better and too lazy to look it up.

So when the government's response to the filing by Gleeson refers to the Executive, it refers to the DoJ as part of the Executive Branch.

In May, after Barr moved to drop the charges against Michael Flynn, Trump’s former national security adviser — even after Flynn had pleaded guilty to lying to the FBI — Barr defended his actions in the case by saying that “history is written by the winners.” That is the kind of statement that might be expected from an amoral bureaucrat in a police state rather than the chief law enforcement officer of the United States.

Barr’s latest move to protect Trump came over the weekend, when he fired Geoffrey Berman, the U.S. attorney for the Southern District of New York. One of the nation’s most important federal prosecutors, Berman has been conducting a series of sensitive investigations into Trump associates. Berman prosecuted Michael Cohen, Trump’s former personal lawyer, and has prosecuted two associates of Rudy Giuliani, who is another Trump personal lawyer. Berman also brought charges against a Turkish state-owned bank in a case in which Turkey’s autocratic president has personally sought Trump’s help.

Barr clearly thought that Berman was causing too much trouble for Trump — so he decided to fire Berman and install Securities and Exchange Commission Chair Jay Clayton, a Trump golfing buddy with no experience as a prosecutor, into the position. Barr tried to push Berman out late Friday night, no doubt thinking that a nation distracted by a pandemic and protests would barely notice.

But Berman refused to go quietly. He quickly saw Barr’s move for exactly what it was: a raw attempt to shut down ongoing Trump-related investigations.

I read a random headline a week or so ago that said that Barr said that investigations will be completed by the end of summer. No analyst or commentator that I know picked up on it, and I didn't read the article, but I DO hope that he means investigations into the FIB. Because the FIB CLEARLY conspired to "get Flynn" in addition to conspiring to "get Trump", and initiated baseless investigtions and engaged in malicious prosecution.

Politicization in the FIB, CIA, DOHS should not be tolerated.

Sullivan urged the federal appeals court to also reject Flynn's bid to bring an end to the case, which has now ruled against the judge.

It is not funny that the Trump appointed judge gave Trump what he wanted. The dissenting judge mocks the “reasoning” of the Trump judges “respectfully”:

He did not opine as to what the final outcome of that ruling might be.

Judges are like umpires: they don't decide who should win or lose a case, and they definitely don't bring in a new pitcher or hitter if they don't like the way the game is going ... which is exactly what Emmett Sullivan did.

The majority of judges appeared to be responding to Sullivan's gross overstepping of his authority, and the appeals panel's objecting judge appears to concerned about timing.

I'm not sure what the resolution would be, because if Sullivan decided to drag the case out and delay his ruling indefinitely, then what? Maybe the appeals panel should have directed Sullivan to issue a ruling by date certain; then they could have ensured that all of the lower court steps were completed before issuing their own ruling? The Flynn's lawyer would have appealed the ruling (if unfavorable) and THEN the appeals panel would have issued theirs? That seems to be the remedy that Wilkins would opt for: adding two more steps to the process.

Judge Wilkins made it very clear: The Government may be entitled to “leave of court” under Rule 48(a) to dismiss the criminal information to which Flynn pled guilty, but that is not for us, as a Court of Appeals, to decide in the first instance. Donald Trump’s most brazenly partisan judicial appointee has come through for the president once again.

On Wednesday, in a 2–1 decision, Judge Neomi Rao forced a district court to dismiss the prosecution of Michael Flynn. Rao’s opinion is an exercise in outcome-driven sophistry that barely pretends to be a judicial opinion. While gutting a vital check of executive misconduct, Rao whitewashed the Justice Department’s flagrantly political decision to drop charges against Flynn — hours before the House Judiciary Committee heard whistleblowers testify about political interference at the DOJ, including in Flynn’s case.

There is ample evidence that Barr and Shea got Flynn off the hook at Trump’s behest. This political meddling in a federal prosecution is wildly unethical and extremely disturbing. Luckily, there is a federal rule, 48(a), designed to prevent well-connected defendants from pulling strings in Washington to get their case dismissed.

Because he entered a guilty plea, Flynn has already been convicted. Judge Sullivan’s only remaining task is to hand out a sentence, which had been delayed at the request of special prosecutor Robert Mueller III so that the sentence could be adjusted either up or down based on how cooperative Flynn was with Mueller's investigation.

Judge Rao made three arguments to justify not sentencing Flynn, and none of them can be taken seriously.

Circuit, sitting en banc, can and should reverse her opinion, which presents a shockingly expansive theory of executive power that overrides the federal judiciary’s ability to identify and stamp out prosecutorial corruption. Under Rao’s rule, federal judges must look the other way when politicians interfere in prosecutions to help their friends—a gross perversion of justice that plainly occurred here. Instead, federal judges must adopt a “see no evil” approach, rubber-stamping prosecutors’ rationalizations even when they reek of corruption. With this opinion, Rao has made herself and her court complicit in that corruption.

House Republicans Resort to Literally Drowning Out Testimony About DOJ Corruption

Moreover, appointing amicus to represent a lower court’s view that neither party will defend (as happened on appeal in Fokker) is far different from appointing amicus in trial court to represent an alternative prosecutor’s view of the case.

This ruling only needs to be appealed because the Trump appointed judge has no shame and wrote a legal opinion that was obviously paid for by a Trump donor. Also, the DOJ makes decisions in this and other cases to please Trump rather than follow established law.
