Where was I? Oh yeah, I accomplished so much. We have our great, great health care plan, which I’ll be releasing in two weeks. It will be better than that disastrous Obamacare you idiots came up with. So that’s coming up soon, since I can still technically be president if I want to, since I won, by a lot, and you lost. I beat you in a landslide, you know that’s true.

By Far the Worst Thing Trump Did Was Flirt With Nuclear War With North Korea

Trump’s actions on this one issue outweigh everything else, yet it’s received less attention than many of his tweets. Just before noon Wednesday, when President Joe Biden took the oath of office, the nuclear codes in the briefcase carried by a military aide to Donald Trump became invalid. The United States and the world survived the four years of Trump’s presidency without him starting a nuclear war.

This was a genuine possibility during 2017 and early 2018, Trump’s first year in office, when he brought the U.S. far closer to a nuclear conflict with North Korea than most Americans realize. Incredibly, the American foreign policy establishment seemed to look upon this risk with equanimity at the time and by now seems to have completely forgotten it.

The significance of Trump’s actions on this one issue outweighs every other aspect of the Trump years, including his response to the coronavirus pandemic. A conflict with North Korea could have led to the deaths of millions, tens of millions, or even more. Yet it’s received less attention than many of his tweets.

Here’s what happened and why Trump’s behavior was extraordinarily dangerous.

It is NOT over. Trump can be reelected President, unless Biden uses the 14th Amendment to stop him. Impeachment is certain to fail, but the 14th will stop Trump from running again.

How to prevent Trump from being reelected.

First thing you have to recognize is that the Senate will never have 67 votes to convict. Not even Andrew Johnson could be brought to justice by the Senate. But there is another way that does not require 67 votes.

Andrew Johnson, the slaveholding white supremacist who became president after Lincoln was assassinated, got impeached by Congress. Johnson tried to reinstall ex-Confederates throughout the South. Johnson wanted to restore the antebellum status quo. You’d think the Senate would have crushed Johnson since he was sabotaging everything the Civil War accomplished, but the Senate couldn’t do it. There are similarities between Trump and Johnson.

I’m sure that Trump knows nothing about Andrew Johnson, historically. But, no doubt, he’s aware that Johnson was impeached. And if you go back, Johnson was a precursor to Trump in some ways. He used extreme language. He denounced the Republicans in Congress as murderers. He accused them of plotting the assassination of Lincoln. He didn’t have Facebook or Twitter to spread his views, but in speeches and other things, he used lunatic language like Trump. He encouraged people to break the law. He said the Reconstruction laws that were passed by Congress weren’t real laws that need to be obeyed. He encouraged violence. He absolutely stood up for white supremacy.

One of the articles of impeachment against him was helping to incite the Memphis and New Orleans riots of 1866, where armed whites assaulted Black communities. So a president whipping up hatred and violence is not new.

Trump launched his political career by claiming that President Obama was not really an American citizen. Johnson, 150 years earlier, vetoed the Civil Rights Act of 1866 because it made Black people citizens. He said Black people should not be citizens, that they’re incapable and intellectually unable to be citizens of the United States. I’m sure Trump never read Johnson’s veto message, but that same theme is there in Trumpism and in Johnson’s opposition to Reconstruction.

If you asked anyone what is Section 3 of the 14th Amendment, they would look at you blankly. It empowers Congress to deny a certain group of people the right to hold office at any level — president, Congress, member of a state legislature, etc. In order for this to apply to you, according to Section 3, you have to have taken an oath to support the Constitution. Trump has taken the oath and then violated it by either taking part in or giving aid and comfort to insurrection. Section 3 is what should have been invoked against Trump. It’s simpler and quicker than impeachment.

The 14th Amendment has no mechanism for removal in the provision. It could, however, be used to prevent Trump or other politicians who supported the attempted insurrection from holding office again.

If Trump is impeached by the House, two-thirds of the Senate would have to vote to convict him in a trial that would be held after he leaves office. Using Section 3 of the 14th Amendment wouldn’t require a super majority, historians noted, and wouldn’t complicate the start of Joe Biden’s presidency.

Gerard N. Magliocca, an Indiana University law school professor who has studied Section 3, said a majority vote in Congress would express lawmakers’ opinion that Section 3 applies. The courts would then have to make that legal declaration.

“It’s not just something that Congress can do,” he said in an interview.

The history of Section 3, though little known, is a remarkable one. Though it doesn’t mention them by name, the provision was specifically aimed at Confederates following the Civil War, seeking to bar them from holding public office during Reconstruction.

President Biden takes office with a ticking clock. The Democrats’ margin in the House and Senate couldn’t be thinner, and midterms typically raze the governing party. That gives Democrats two years to govern. Two years to prove that the American political system can work. Two years to show Trumpism was an experiment that need not be repeated.

Two years.

This is the responsibility the Democratic majority must bear: If they fail or falter, they will open the door for Trumpism or something like it to return, and there is every reason to believe it will be far worse next time. To stop it, Democrats need to reimagine their role. They cannot merely defend the political system. They must rebuild it.

Klein believes that Democrats understand the need for bold action that provides clear benefits to people who are struggling and skeptical of government. And he thinks they know what needs to be done. However, he is worried that good policy intentions will die in the Senate unless the filibuster is eliminated, which believes is unlikely:

But none of these bills will pass a Senate in which the filibuster forces 60-vote supermajorities on routine legislation. And that clarifies the real question Democrats face. They have plenty of ideas that could improve people’s lives and strengthen democracy. But they have, repeatedly, proven themselves more committed to preserving the status quo of the political system than fulfilling their promises to voters. They have preferred the false peace of decorum to the true progress of democracy. If they choose that path again, they will lose their majority in 2022, and they will deserve it.
